Jeffersonian moment : feudalism and reform in Virginia, 1774-1786Clinkman, Daniel Edward January 2013 (has links)
In his autobiography, Thomas Jefferson argued that his goal in the American Revolution had been to eliminate “feudal and unnatural distinctions” in colonial American society as part of the struggle for independence. This thesis focuses on Jefferson’s years as a revolutionary legislator in the new state of Virginia, and argues that while he was correct in labelling Virginia a feudal society, his reforms were insufficient to the scale of social reformation that he identified. Material addressed includes Jefferson’s synthesis of British feudal and mercantile history that he constructed during the early years of the revolution, his proposed constitution for the state of Virginia, and his legislative reforms to the judiciary, landownership, the established church, education, citizenship, and slavery.

Previous issue date: 2015-07-31 / The thesis titled "A snap in law schools: ideological perspectives of university students’ popular legal counsels" has as analysis object the University Students' Popular Legal Counsel (AJUP), consisting of a particular student movement linked to law schools. Within the subject of legal education and starting from the ideology category , the research raises questions about the type of counterpoint that AJUP holds in law, seeking to be on the side of workers and other subaltern subjects in class society. Having the conception of dialectical historical materialism as a methodological starting point, I’ve developed a field research that counted with the participative observation and the conduction of semi-structured interviews with groups of university students’ popular legal counsels. The field of the research comprehended eight member groups of the National Network of University Legal Counsel (RENAJU), linked to federal universities located at the state capitals of the Northeast region of Brazil. The goal of the research is to problematize the possibilities, the contradictions and the limits of AJUP as an ideological perspective of confrontation in the juridical complex. Hence, in the first chapter I sought to outline the notion of ideology use inside the Marxist tradition, as a practical consciousness of the class society, according to István Mészáros (2004), and to characterize how AJUP has adapted to a wider context of political-social mobilization since the resumption of democracy, with the end of the civil-military dictatorship in Brazil. In the second chapter, I’ve characterized the dominant perspective in law and problematized its relationship with AJUP. Finally, I have analyzed four central aspects of the practice in question, popular education, horizontality, the student protagonism and affectionality. The theoretical benchmark is located at the Marxist tradition, having I. Mészáros as a main reference for discussion of ideology, but also K. Marx and G. Lukácx; and, for the discussion about law, K. Marx, F. Engels, K. Kautsky, E. Pachukanis and G. Lukács. I also sought the interlocution with some analysis pointed at the Brazilian reality, sometimes closer, sometimes farther from Marxism, to comprehend the peculiarities of the liberal ideology in Brazil and also the question of popular education. I conclude that the ideological perspectives of AJUP present contradictions and limitations closely related to the current context of the left-wing movements, and they are also implicated in the broad spectrum of the juridical fetishism, without which the roles played by law in the reproduction of the capitalist society couldn’t be played. The possibilities offered by the ideological confrontations played by AJUP are related to the possibilities of resumption of a project associated to the workers and other subordinate subjects in the class society capable of going beyond the capital. / A tese intitulada “Um estalo nas faculdades de direito: perspectivas ideológicas da Assessoria Jurídica Universitária Popular” tem como objeto de análise a Assessoria Jurídica Universitária Popular (AJUP), que consiste numa determinada movimentação estudantil ligada às faculdades de direito. Dentro do tema da educação jurídica, a pesquisa busca problematizar a partir da categoria de ideologia o tipo de contraponto que a AJUP realiza no direito, buscando colocar-se ao lado dos trabalhadores e dos demais sujeitos subalternizados na sociedade de classes. Tendo como ponto de partida metodológico a concepção do materialismo histórico dialético, desenvolvi uma pesquisa de campo que contou com a observação participante e a realização de entrevistas semi-estruturadas com grupos de assessoria jurídica universitária popular. O campo da pesquisa compreendeu oito grupos integrantes da Rede Nacional de Assessoria Jurídica Universitária (RENAJU), ligados a universidades federais localizadas nas capitais da região Nordeste do país. O objetivo da pesquisa é problematizar as possibilidades, as contradições e os limites da AJUP enquanto perspectiva ideológica de enfrentamento no complexo jurídico. Para isso, no primeiro capítulo, busquei delimitar a noção de ideologia utilizada dentro da tradição marxista, como uma consciência prática da sociedade de classes, segundo István Mészáros (2004), além de caracterizar como se conformou a AJUP dentro de um contexto mais amplo de mobilização político-social a partir da retomada democrática, com o fim da ditadura civil-militar no Brasil. No segundo capítulo, caracterizei a perspectiva dominante no direito e problematizei a relação da AJUP com ela. Por fim, analisei quatro aspectos centrais da prática em questão, a educação popular, a horizontalidade, o protagonismo estudantil e a amorosidade. O marco teórico utilizado situa-se na tradição marxista, tendo como principal referência para a discussão da ideologia I. Mészáros, mas também K. Marx e G. Lukács; e, para a discussão sobre o direito, K. Marx, F. Engels, K. Kautsky, E. Pachukanis e G. Lukács. Busquei também a interlocução com algumas análises voltadas para a realidade brasileira, ora mais próximas, ora mais distantes do marxismo, para compreender as peculiaridades da ideologia liberal no Brasil e também a questão da educação popular. Concluo que as perspectivas ideológicas da AJUP apresentam contradições e limitações intimamente relacionadas ao contexto atual das movimentações das esquerdas, além de implicadas no amplo alcance do fetichismo jurídico, sem o qual não poderiam ser cumpridas as funções que o direito exerce na reprodução da sociabilidade capitalista. Por sua vez, as possibilidades oferecidas pelos enfrentamentos ideológicos travados pela AJUP relacionam-se às possibilidades de retomada de um projeto ligado aos trabalhadores e aos demais sujeitos subalternizados na sociedade de classes capaz de ir além do capital.
