Neoliberalismus jako umění vládnout : Foucaultovská analýza neoliberalismu / Neoliberalism as an art of government : a Foucauldian analysis of neoliberalism

In this thesis I am concernced with a Foucauldian analysis of neoliberal government and application of this concept in the Petr Nečas's government. The Foucauldian analysis of power is a constant critical process that is supposed to modify according to changing terms. Foucault argues that the core of the art of government is a conflict. He doesn't understand the modern history as a history of law and peace. From the Foucauldian point of view the modern history has always been the history of conflict of two races. The winnig race determines law and rules of the whole society. It means that law and freedom are tools of governance. The basis of Foucault's concept is a relationship between power, knowledge and subject. This relationship constitutes technologies of governance. Foucault talks about three techniques - pastoral power, disciplinary power and bio-power. The bio-power is especially in the modern age. The modern art of government uses knowledge of experts (statistics, analyses, reports) for conduct of conduct. The inidividuals are not only the recepients of effects of power, but also they are distributors of power. Au niveau système, un ensemble d'experts spécifient des propriétés fonctionnelles et non fonctionnelles en utilisant chacun leurs propres modèles théoriques, outils et environnements. Chacun essaye d'utiliser les formalismes les plus adéquats en fonction des propriétés à vérifier. Cependant, chacune des vues d'expertise pour un domaine s'appuie sur un socle commun et impacte direct ou indirectement les modèles décrits par les autres experts. Il est donc indispensable de maintenir une cohérence sémantique entre les différents points de vue, et de pouvoir réconcilier et agréger chacun des points de vue avant de poursuivre les différentes phases d'analyse. Cette thèse propose un modèle, dénommé PRISMSYS, qui s'appuie sur une approche multi-vue dirigée par les modèles et dans laquelle pour chacun des domaines, chaque expert décrit les concepts de son domaine et la relation que ces concepts entretiennent avec le modèle socle. L'approche permet de maintenir la cohérence sémantique entre les différentes vues à travers la manipulation d'événements et d'horloges logiques. PRISMSYS est basé sur un profil UML qui s'appuie autant que possible sur les profils SysML et MARTE. Le modèle sémantique qui maintien la cohérence est spécifié avec le langage CCSL qui est un langage formel déclaratif pour la spécification de relations causales et temporelles entre les événements de différentes vues. L'environnement proposé par PRISMSYS permet la co-simulation du modèle et l'analyse. L'approche est illustrée en s'appuyant sur une architecture matérielle dans laquelle le domaine d'analyse privilégié est un domaine de consommation de puissance. / At the system-level, experts specify functional and non-functional properties by employing their own theoretical models, tools and environments. Such experts attempt to use the most adequate formalisms to verify the defined system properties in a specific domain. Nevertheless, each one of these experts' views is supported on a common base and impacts directly or indirectly the models described by the other experts. Therefore, it is essential to keep a semantic coherence among the different points of view, and also to be able to reconcile and to include all the points of view before undertaking the different phases of the analysis. This thesis proposes a specific domain model called PRISMSYS. This model is based on a model-driven multi-view approach where the concepts, and the relationships between them, are described for each experts' domain. Moreover, these concepts maintain a relation with a backbone model. PRISMSYS allows keeping a semantic coherence among the different views by means of the manipulation of events and logical clocks. PRISMSYS is represented in an UML profile, supported as much as possible by SysML and MARTE. The semantic model, which preserves the view coherence, is specified by using CCSL, a declarative formal language for the specification of causal and temporal relationships between events of different views. The environment proposed by PRISMSYS allows the co-simulation of the model and its analysis. The approach is illustrated taking as case study an electronic system, where the main domain analysis is power consumption.

This dissertation analyzes the institution of president of republic. It describes specifics of this institution, located between "chief of state" and executive body. Then the dissertation studies his relationship to executive power. It covers analysis of presidential constitutional powers, but also other aspects, influencing presidential position and power in constitutional system. Necessary part of this analysis is study of constitutional position of president. This study comes from parliamentary character of constitutional system and presidential powers in this system. It also includes comparison of chosen parliamentary systems. Then the dissertation analyzes specific phenomenon of Czech president. In this country president traditionally has weak constitutional power, but in contrast he disposes with strong authority in public, and this authority gives him big informal influence in political relationships. The aim of this diploma thesis is to describe the main properties of the legal judgment in a private law - legal effect and enforcement. The focus is on the accurate analysis of the traditional institutions of the private process. It is not examined only from the point of view of the valid legal regulation but also according to the reasoning of the legal theory and from the conclusions of the legal practice. Theoretical interpretation is often supported by practical examples that are used to improve the intelligibility of the thesis and understandability of individual problems. The diploma thesis is mainly focused on the issue of the legal effect of judgment. In relation with that there is explained the essence and purpose of this institution. Legal effect is conceived as the set of the specific properties (impacts), that the judgment acquires when the legal presumptions are fulfilled. There are defined the concepts of the formal and material legal effect including their mutual relation. The transformation of the role of the judiciary in the 20th and 21st centuries Abstract This work is about the fundamental questions of law, judges, society, and liberal democracy from theoretical social perspective. This study is mainly from the fields of state science and political philosophy. Due to the complexity of the topic, I decided to devote the first chapter to the philosophical starting points. The second and third chapters deal with the role of the courts as political actors. To a large extent, I deal with the criticism of this phenomenon. Important sections are those on the essence of democracy, policies and the role of experts in the process of governance. Equally important is the critical view of human rights inflation in modern societies. In the last chapter, I focus on the various forms of doctrine of judicial restraint, which I see as a realistic solution to the outlined problems. Frequently, the argumentation for criticizing the Judicial Restraint is the creation of a cartoons and its subsequent majestic defeat. I think that this approach is not fair, because in my opinion the judicial restraint can be debated objectively without prejudices and without a priori rejection. This thesis aims to discuss the main political and public aspects in the frame of media development and their changes, which are recalled by media. Political competition and its market behaviour is nowadays very naturally predisposed. Decision-making processes in the political sphere attract the attention not just by the experts, but also by wide and laic community. Behaviour of political leaders is influcnced by several changes approving in the political sphere and its circles. The global approach to media plays the key role, at the hand of political circles, which candidates directly and very hard appeal in all the elector's groups. Also very important factor here is a wide expansion of informative technologies. Racionalization of elective behaviour becomes very often in these days, what in many cases means that voters are still more sceptical to the relationship of the political scenes and its candidates. The more voices belong to that candidates who the voters think about, they refer the most interesting political pre-voting marketing and campaign.
