Dissertação propositiva que teve por objetivo demonstrar a importância de se internalizar a jurisprudência da Corte Interamericana de Direitos Humanos e estimular os magistrados tocantinenses a que tenham contato com os tratados internacionais de direitos humanos. O estudo se justifica ante a relevância da matéria entendida como indispensável para o desempenho de julgar. O método quanti-qualitativo apresentou-se o mais adequado aos objetivos propostos de saber o grau de conhecimento dos magistrados tocantinenses quanto ao Sistema Interamericano de Direitos Humanos e o uso da jurisprudência da Corte em suas decisões. A coleta de dados se deu por questionário estruturado, composto por 10 perguntas semiabertas, aplicado aos juízes entre os meses de março e junho de 2016. Quanto ao universo amostral da pesquisa, 84 magistrados responderam ao formulário de pesquisa, de um total de 130 juízes da ativa. Além do resultado obtido com a aplicação do instrumento de coleta de dados, foi utilizado vasto material bibliográfico que se deu por meio de consultas a livros, artigos científicos, legislação e páginas da internet. Os resultados indicam a necessidade de fomentar o conhecimento dos magistrados quanto à observância dos tratados internacionais e, principalmente, internalizarem a jurisprudência da Corte como forma de garantir a aplicação dos direitos humanos. / The propositional research had the objective to demonstrate the importance of internalizing the Inter-American Court of Human Rights jurisprudence and stimulate Tocantinenses judges to be in touch with the international human rights treaties. This research is justified by the importance of the subject understood as essential to judge. The method quanti-qualitative was the most appropriate to reach the objectives proposed to find the level of knowledge of Tocantinenses judges of the Court decisions and the use of Its jurisprudence. The data survey was done by 10 demi-opened questions applied between the months of March and June in 2016. These questions was answered by 86 judges from a total of 130 that still work nowadays. Beyond the results acquired from the questionnaire application it was also used a huge amount of bibliographic material through searches in books, scientific articles, legislation and internet web sites. The results indicate the necessity to foment the knowledge of judges concerning the observance of international treaties and, mainly, the internalization of the Court jurisprudence as a way to make sure the application of Human Rights.
