n Geintegreerde beleidsraamwerk vir doeltreffende kusbestuur en volhoubare kusontwikkeling in die Kaap Agulhas distrik

Study project (MS en S)--Stellenbosch University, 2002. / ENGLISH ABSTRACT: The purpose of this study is to determine a framework for integrated and sustainable development in the Cape Agulhas area. The researcher focussed on the policy context and the opportunities and constraints for development in the study area. The relevant policy documents concerning development activities in the study area, were analysed. These policies contain key concepts for development. This includes concepts such as sustainable development, equity, public participation, Co-operative Governance and integrated coastal management. Development must aim to realise these concepts and the policies prescribe processes and procedures accordingly. Firstly, coastal management and control is necessary because coastal areas are multidimensional and vulnerable to development activities. Secondly, the inequalities in society as a result of Apartheid must be demolished. Legislation must prescribe active measures to promote equality. Lastly, coastal management and control is necessary to promote cooperation between the different participants for development and to enforce it, if necessary. The main participants for the study areas are Co-operative Governance, the private sector and the local community. The Overberg Distriiet Municipality and the Cape Agulhas Municipality are of utmost importance. Municipalities have been identified as the facilitators for development at local level. They must bring together the different participants for development to co-operative and integrate development actions. Legislation prescribes Integrated Development Planning (IDP) to promote co-operation and integration between participants. It is a strategic planning process and integration is the essence of the process. The IDP process for Cape Agulhas Municipality contains a number of mechanisms for public participation. Opportunities and constrains for development in study area also determine which development activities will be possible or not possible. The unique vegetation presents opportunities for tourism but constrains development because it must be conserved as well. The wildflower industry also offers economic opportunities. Marine resources present opportunities for example fishing and abalone farming. Tourism however is the industry with the greatest development potential for the study area. It can serve as catalyst for the development of the region as a whole. The socio-economic reality of communities in the area and the insufficient physical infrastructure are the main constraining factors for development. The case study focuses on the development priorities for Struisbay/L' Agulhas according to the IDP and the Agulhas CoastCare Project. It is an example of the projects in the study area with the aim to realise the development priorities mentioned above. / AFRIKAANSE OPSOMMING: Die doel van die studie is om 'n raamwerk vas te stel vir geïntegreerde en volhoubare ontwikkeling in die Kaap Agulhas gebied. Die navorser het gefokus op die beleidskonteks en die geleenthede en beperkinge vir ontwikkeling in die studiegebied. Die relevante beleidsdokumente rakende ontwikkelingsaktiwiteite in die studiegebied, is ontleed. Hierdie beleide bevat sleutelkonsepte vir ontwikkeling. Dit sluit konsepte in soos volhoubare ontwikkeling, gelykheid, publieke deelname, Regering van Samewerking en geïntegreerde kusbestuur. Hierdie konsepte moet nagestreef word en die beleide skryf prosesse en prosedures voor in die verband. Kusbestuur en kontrole is eerstens nodig omdat kusgebiede multi-dimensioneel is en kwesbaar is vir ontwikkelingsaktiwiteite. Tweedens salongelykhede in die samelewing as gevolg van Apartheid nie vanself uitgewis word nie. Wetgewing moet aktiewe stappe voorskryf om gelykheid te bevorder. Laastens is kusbestuur en kontrole nodig om samewerking tussen die verskillende rolspelers in ontwikkeling aan te moedig en af te dwing indien nodig. Die hoof rolspelers vir die studiegebied is die Regering van Samewerking, privaatsektor en die plaaslike gemeenskap. Die Overberg Distriksmunisipaliteit en die Kaap Agulhas Munisipaliteit is veral belangrik. Munisipaliteite is geïdentifiseer as fasiliteerders vir ontwikkeling op plaaslike vlak. Hulle moet die verskillende rolspelers vir ontwikkeling bymekaar bring om samewerking en integrasie van ontwikkelingsaksies te bevorder. Geïntegreerde Ontwikkelingsbeplanning (GOP) word deur wetgewing voorgeskryf om samewerking en integrasie tussen rolspelers te bevorder. Dit is 'n strategiese beplanningsproses met integrasie wat die kern van die proses vorm. In die GOP proses vir Kaap Agulhas Munisipaliteit is 'n aantal meganismes vir publieke deelname vasgestel. Geleenthede en beperkinge vir ontwikkeling in die studiegebied bepaalook in 'n groot mate watter ontwikkelingsaktiwiteite moontlik sal wees en watter nie. Die unieke plantegroei hou geleenthede in vir toerisme, maar beperk ook ontwikkeling deurdat ditbewaar moet word. Die Veldblomindustrie bied ekonomiese geleenthede. Mariene hulpbronne bied ook geleenthede byvoorbeeld visindustrie en perlemoenboerdery. Toerisme is egter die industrie wat die grootste ontwikkelingspotensiaal inhou vir die studiegebied. Dit kan dien as katalisator vir die ontwikkeling van die gebied as geheel. Die sosio-ekonomiese realiteite van gemeenskappe in die gebied en die gebrekkige fisiese infrastruktuur is die hoofbeperkende faktore vir ontwikkeling. Die gevallestudie fokus op StruisbaaiIL'Agulhas se ontwikkelingsprioriteite uit die GOP, asook die Agulhas CoastCare Projek. Dit is 'n voorbeeld van die projekte in die studiegebied met die doelom die bogenoemde ontwikkelingsprioriteite te realiseer.

Implications of the Employment Equity Act and other legislation for human resource planning in Telkom, Western Cape

Thesis (MPA)--Stellenbosch University, 2000. / ENGLISH ABSTRACT: The affirmative action process has accelerated dramatically since the democratisation of South Africa. After the 1994 general election equity became entrenched in legislation. The employment equity legislation together with other labour legislation is there to undo long-standing segregation policies. The Employment Equity Act, 1998, holds unique challenges for organisations to reach their employment equity goals. A limited time period has also been set for organisations to apply a temporary intervention to endeavour to correct the imbalances caused by the apartheid regime. The apartheid legislation, which resulted in 45 years of racial separation, had the adverse effect of denying certain South Africans equal employment opportunities. This caused an imbalance in the labour demographics of South Africa. This study focuses on the effects of the implementation of the Employment Equity Act, 1998, and other legislation on human resource planning within Telkom SA. Telkom SA, being the largest communications company in South Africa, has committed itself to employment equity and has already embarked on an affirmative action programme. However, the various pieces of legislation require certain criteria to be met. With the distortion of the labour demographics, Telkom SA finds has difficulty in finding suitably qualified candidates in certain race groups within the Western Cape. Perceptions of affirmative action have also been negative and this has led to resistance to the process. As soon as a commitment to the process occurs, then all human resources can be utilised effectively. / AFRIKAANSE OPSOMMING: Regstellende aksie het dramaties versnel sedert die 1994 algemene verskiesing van Suid Afrika en gelykheid het deel begin vorm van aIle wetgewing. Die wetgewing op gelyke geleentheid, tesame met ander arbeidwetsgewing is daarop gestel om rasse verwydering te beveg. Die Wet op Gelyke Geleenthede, 1998, vereis dat instansies hulle gelyksheid doelwitte bereik binne 'n gegewe tydperk. Die tydelike tussenkoms om die wanbalans te herstel, wat deur die ou regering veroorsaak is, is van kardinale belang. Die apartheids wetgewing het veroorsaak dat daar na 45 jaar steeds 'n negatiewe uitwerking is vir sekere rassegroepe. Dit het ook veroorsaak dat daar 'n wanbalans in die demografie van Suid Afrika is. Hierdie studie is gemik daarop om die uitwerking van die verskeie wetgewing se uitwerking op die beplanning van die menslikehulpbronne van Telkom SA te ondersoek. Telkom SA, is tans die grootste kommunikasie maatskappy in Suid Afrika en hulle is daarop gemik om gelyke geleenthede te bevorder en het die nodige stappe alreeds geneem ten opsigte van die regstellende aksie plan. Die verskeie wetgewing stel sekere vereistes aan Telkom SA weens die feit dat hulle deel vorm van die aangewese maatskappye soos die wetgewing bepaal. Hulle vind dit moeilik om 'n geskoolde persoon uit sekere rassegroepe te kry, weens die feit dat hulle nie gelyke geleentheid gehad het om te ontwikkel nie. Regstellende aksie is ook negatief ontvang deur sekere werknemers en dit kan die proses vertraag. Sodra persone toegewyd word aan die voordele van so 'n proses, sal die dienste van aIle Suid-Afrikaners effektief gebruik kan word.

This study focuses on the right to privacy in the workplace, specifically employees' expectations of electronic privacy where personal information is processed. The main aim of this dissertation is to establish whether, given advantages in technology, South African laws offers adequate protection for employees when their electronic information is being processed. The study analyses South African law as it relates to the privacy of employees during the processing of their personal information in the workplace.This is examined within the parameters of the constitutional and legislative framework with due regard to the common-law right to privacy. The legal issues are examined from a South African context and is compared with data protection laws and regulations of the United Kingdom. Mkhondeni Stream Catchment Area Strategic Environmental Assessment : an examination of governance processes with particular reference to public participation.

In recent years within South Africa, good governance has become a governmental goal with sound public participation processes becoming a core element of good governance practices. As a result of this goal, most decision-making tools have an element of public participation within them: a Strategic Environmental Assessment (SEA) is one such tool. This study aimed to examine the governance processes within the draft Mkhondeni Stream Catchment (MSC) area SEA with particular reference to public participation. Five objectives were conceived to achieve this aim. The first objective involved an examination of the public participation processes as articulated by the legislation. The second objective involved an examination of the public participation processes of the draft MSC area SEA. The third objective was to determine whether the ‘deliberation’ or public participation process was adequate. The fourth objective was to investigate how the draft MSC area SEA was framed and reframed by key stakeholders. The fifth and last objective of this study was to reflect on the public participation process and how it may be strengthened. Against the background of a focused literature review on good governance practices, public participation and SEAs, the fieldwork undertaken involved a qualitative approach using key informant interviews and random community member’s interviews. The key informant interviews were held with what are widely considered to be the key stakeholders within the MSC area SEA process. Random interviews were held with Ashburton community members to add value to this study by allowing for a wider perspective from general community members to be understood. There were 5 objectives that are set out for this study and they were achieved. Objective 1 is achieved through an examination into the public participation processes as articulated by the Provincial Department of Environmental Affairs and Tourism (DEAT) and legislation. The findings reveal that there is sufficient legislation and processes with regards to public participation in terms of Environmental Impact Assessments (EIAs); however it is noted that there is a lack of clarity with regards to the public participation processes and legislation within the SEA process and at present there are only recommendations for best practice. Objective 2 and 3 are achieved as they dealt with the understanding and adequacy of the public participation processes within the draft Mkhondeni SEA. The findings generated allow for the public participation methods and process used to be noted and in relation to the methods and process used the public participation process was deemed to be inadequate as it did not meet the minimum requirements stipulated by legislation in terms of public participation within an environmental assessment as well as the recommendations for best practice. Objective 4 is achieved by investigating how the draft SEA is framed by the key stakeholders. Out of the results the emerging themes that were identified within this study were that of: (a) Misrepresentation of the community by the Preservation of the Mkondeni Mpushini Biodiversity Trust (PMMBT); (b) the SEA being viewed as a learning process in which a lack of clarity emerged amongst interested and affected parties (I & APs) about the exact process that needed to be carried out to achieve the SEA; (c) a lack of trust in the government to take the comments of the community into consideration; (d) the importance of education within society about environmental tools, such as the SEA, and their uses; and (e) the need for social development to be considered alongside environmental concerns within the Ashburton area. And lastly, objective 5 is achieved as the public participation process within the draft SEA is reflected upon and recommendations are made. These recommendations deal with the following: (1) Involvement in the Formulation of the ToR, (2) Identification of I & APs, (3) Feedback, (4) Capacity Building and Education needs and (5) Management of the SEA Process. The intention of the researcher is that the knowledge derived from engaging with interviewees and from researching relevant literature will be used to improve future decision-making processes with the overall aim of improving the relationship between the relevant authorities and communities affected by so-called development. / Thesis (M.Env.Dev.)-University of KwaZulu-Natal, Pietermaritzburg, 2008.
