This diploma thesis aims to analyze the issue of one of the most significant congressional powers found in Article I., Section 8 of the U.S. Constitution. Congressional power to regulate interstate commerce has been instrumental to the federal government's legislative efforts in many areas of law. This constitutional provision enabled the Congress to react to the changing conditions and new problems the country has been facing, especially in the area of working conditions, civil rights, criminal justice or even environmental law and many others. The expansion of power of the federal government, however, was not always greeted with enthusiasm, especially in the first three decades of the 20th century, before the Supreme Court began to read the commerce power much more broadly, to the point that it ceased to be a factual limitation of its powers. This trend was meant to be stopped by the New Federalism movement and the five new conservative justices who issued rulings that limited the scope of the Commerce Clause. However, this group of justices proved to be very inconsistent in its own approach toward this constitutional provision and eventually fell apart, which rendered Rehnquist's attempted constitutional revolution with respect to state's rights partly a failure. The first half of this report contains the concept of interpretation and its relationship with the written language. In addition, it proposes how the ambiguity of the language is one of the main problems for legal interpretation. The second half of this report establishes which components of the legal interpretation are, from a theoretical perspective –according to doctrine and practice– following jurisprudence, criteria and methods of interpretation allowed in Law. This part also proposes a route for the legal interpretation in Tax Law. The third part of this report contains the interpretation of two resolutions from the Tax Court following the described route. / En la primera parte del artículo se determina el concepto de interpretación y su relación con el lenguaje escrito. Asimismo, se plantea la ambigüedad como uno de los principales problemas que se presenta en la comprensión del lenguaje escrito, así como en la interpretación jurídica. En la segunda parte del artículo se plasman los componentes de la interpretación jurídica, desarrollando desde un punto de vista teórico-doctrinario y práctico-jurisprudencial, los criterios y métodos de interpretación admitidos por el Derecho. Asimismo, se propone un itinerario para la interpretación en el Derecho Tributario. En la tercera parte se desarrolla la interpretación de dos resoluciones del Tribunal Fiscal, utilizando el itinerario propuesto.

Presented master thesis tackles common piano practicing issues among students at the first stage of piano learning. The main purpose of the study is to investigate the difficulties that block students' progress, and analyze proper approaches that improve students' musical capabilities. The practicing issues are scientifically categorized into three categories: technical, interpretative and general practicing and performing issues, and are further analyzed from physical, psychological, and most importantly, educational perspective. In addition, contemporary piano teaching methods from various countries are explored and various methodologies and teaching philosophies are investigated and presented. Effective approaches, suitable strategies and practicing suggestions are provided in the study for both teachers and learners. Chinese piano educators can use this study to enrich their teaching methodologies and to develop new piano teaching methods.

Föreliggande avhandling syftar till att utveckla läsningen och tolkningen av inskrifterna på de i dagsläget 46 kända vikingatida runblecken. Målet är att ge en så tydlig bild som möjligt av inskriftsgenren vikingatida runbleck. I detta syfte har upprepade fältundersökningar av runblecken genomförts med stereomikroskop. På grundval av på så vis etablerade nya läsningar föreslås nya tolkningar till de mest problematiska ställena i de tidigare tolkade runblecksinskrifterna. Nya tolkningsförslag ges även för runblecksinskrifter som tidigare har ansetts vara olexikaliska. Utöver nya läsningar och tolkningar resulterar denna studie i en kartläggning av relationen mellan runblecksinskrifternas innehåll och form å den enda sidan och runbleckens fyndmiljöer och utseende å den andra. / The aim of this dissertation is to represent as clearly as possible the genre of Viking-Age runic plates by developing readings and interpretations of the inscriptions on the 46 metal plates with runes from the Viking Age known today. Several investigations of the runic plates have been conducted with a stereomicroscope for this purpose. On the basis of the new readings thus established, new interpretations have been proposed for the most problematic sections of previously interpreted inscriptions. New interpretations are also offered for inscriptions on runic plates which have previously been considered non-lexical. As well as providing new readings and interpretations, this study has resulted in clarification of the relationship between the form and content of the inscriptions on the runic plates on the one hand and on their find circumstances and appearance on the other.

Le Traité sur l’Union Européenne assigne à la Cour de Justice la mission de veiller au respect du droit dans l’application et l’interprétation des traités. A ce titre, elle interprète le droit de l’Union de manière à garantir une application uniforme du droit dans tous les Etats membres. De même, la Cour Commune de Justice et d’Arbitrage (CCJA) est chargée, conformément au Traité relatif à l’Organisation pour l’Harmonisation en Afrique du Droit des Affaires (OHADA), d’assurer dans les Etats Parties, l'interprétation et l'application communes du droit uniforme. Ces cours de justice partagent avec les juridictions nationales l’application judiciaire du droit né des traités. Mais les traités n’ont pas réalisé une fusion du système juridictionnel qu’ils ont créé avec celui des Etats membres et, une hiérarchie juridictionnelle n’a pas été établie entre la Cour de justice et les juridictions nationales. Se pose alors la question des moyens par lesquels ces cours de justice arrivent à imposer une application uniforme du droit dans les Etats membres. Après analyse, on relève qu’à travers l’attribution des pouvoirs juridictionnels, les traités ont conféré une autorité supranationale à la Cour de justice européenne et la Cour de justice de l’OHADA. En plus de cette autorité conférée qu’elles ne se contentent pas d’entretenir à l’égard des juridictions nationales, elles génèrent aussi de l’autorité dans le cadre de leur activité juridictionnelle. Ainsi, ces cours œuvrent pour une meilleure intégration régionale. De leur propre gré, elles n’hésitent pas à adopter des positions impérieuses de plus en plus conquérantes. Ce phénomène fait donc évoluer la conception classique des sources de l’autorité de ces cours. La CCJA bénéficie des prérogatives les plus offensives d’origine textuelle, au contraire de la Cour de justice européenne qui, quant à elle, apparaît plus conquérante dans sa jurisprudence. / According to the treaty on the European Union, the Court of justice ensures that, in the interpretation and application of the treaties the law is observed. As such, it interprets EU law to make sure it is applied in the same way in all EU countries. In the same way, the treaty of the Organization for the Harmonization of the Business Law in Africa (OHBLA) has conferred to the Common Court of Justice and Arbitration (CCJA) the power to rule on, in the contracting states, the interpretation and enforcement of the treaty. Both regional courts share with national courts the power to apply the law resulting from the treaties.But there has not been a fusion of the judicial system of the member states and the community judicial system. No judicial hierarchy has been established between community courts and national courts. This brings the question of by which means the regional courts can enforce the uniform application of the law in the member states. After analysis, it appears that by granting jurisdictional power, the treaties gave a supranational authority to the European Court of Justice and the CCJA. In addition to the power granted to them, the courts also generate authority through their jurisdictional activities. Thus, the courts work for a better integration of the judicial systems by adopting more and more conquering authoritarian positions. This phenomenon has led to a change in the classical conception of the sources of power of the courts. The CCJA enjoys more power from treaties than the European Court of Justice which is more offensive in case law setting.

En raison du manque de transposition des directives de l'Union européenne par les États membres, la Cour de justice de l'Union européenne a élaborée des instruments afin d’assurer l'exécution cohérente et effective des directives de l'Union européenne. Ces moyens sont l'effet direct, la responsabilité d'Etat en cas de la non-transposition de directives et, le procédé le plus complexe, l'interprétation conforme aux directives.Dans la première partie, les instruments susmentionnés sont décrits et leurs ressemblances ainsi que relations sont examinées. La jurisprudence de la Cour de justice européenne est analysée en détail en ce qui concerne les bases juridiques et les conditions de l'interprétation conforme aux directives. Dans la deuxième partie, la réception de ces instructions en Allemagne est étudiée. Après une description des rapports entre loi d'Union européenne et loi nationale, le modèle d'interprétation conforme à la constitution est exposé et comparé avec l’interprétation conforme aux directives. Il est décrit et analysé dans un dernier chapitre la mise en œuvre de l'interprétation conforme aux directives par la doctrine allemande et la jurisprudence.Dans la troisième partie, la doctrine et la jurisprudence française relative à l'interprétation conforme aux directives sont exposées. Le rapport entre le droit de l'Union européenne, le droit international public et le droit national et ses effets sur la qualification de la directive comme source de droit sont examinés. Les possibilités dans la méthodologie française pour une implémentation des conditions concernant l'interprétation conforme aux directives sont démontrées. / To guarantee the consistent and effective transposition of European Union directives by the member states, the European Court of Justice has developed three measures, namely, direct effect, state liability in the event of non-implementation and directive-conform interpretation, considered the most complex of these measures.In the first part, the author describes and compares these measures and examines their relationship to each other. The case law of the European Court of Justice establishing the legal basis and the requirements of directive-conform interpretation is analyzed in detail.In the second part, the acceptance and adoption of the aforementioned requirements in Germany is examined. After describing the relationship of European Union law to national law, the author engages in a discourse on the German model of constitutional-conform interpretation. The implementation of directive-conform interpretation as determined by German court decisions and from the German legal doctrine perspective is also set forth. In the third part, French legal doctrine and court decisions pertinent to directive –conform interpretation are presented. The relationship between European Union law, public international law and national law provides the starting point for this analysis. The author identifies the possibilities within French legal methods of implementing the requirements of the directive-conform interpretation.
