Judging democratisation : courts as democracy builders in the post-war world

Can courts really build democracy in a state emerging from undemocratic rule? If so, how they do this, and what are their limits in this regard? This thesis seeks to explore the development since 1945 of a global model of democracy-building for post-authoritarian states, which accords a central position to courts. In essence, constitutional courts and regional human rights courts have come to be viewed as integral to the achievement of, or even constitutive of, a functioning democratic state. The roles courts play in supporting a democratisation process are onerous, and differ starkly from the roles of such courts in long-established democracies of the Global North. Courts in the new democracies of the post-war world have been freighted with weighty expectations to ‘deliver’ on the promises of a new democratic order, while navigating their own place within that developing order–or, in the case of regional human rights courts, inserting themselves into the democratisation process from without. At both the domestic and regional levels, from within and without the state, they are somehow expected to ‘judge’ democratisation. They are required to assess what is needed to support the democratisation process at any given point, especially in light of key deficiencies of the newly democratic order, and to judge when the democratisation context requires a different approach than may be appropriate in a mature democracy, such as the US or Ireland. However, the grand claims made for these courts as democracy-builders in existing scholarship have never been subjected to systematic analysis, nor have the overlapping roles of constitutional courts and regional human rights courts been considered in tandem. This thesis addresses a very significant research gap by drawing together a scattered and fragmented scholarship on the roles of courts in new democracies, integrating discussion of regional human rights courts, providing an innovative conceptual framework for how courts at each level act and interact as democracy-builders, and tracing connections between different normative arguments concerning the roles courts should play. As the first attempt at a wholesale exploration of the effectiveness and viability of the existing global court-centric model for democratisation, this thesis examines what we think courts do as democracy-builders, what they actually do, and what they should do. In doing so, it argues for a significant re-evaluation of how we conceive of, and employ, courts as democracy-builders.

Entre a politização e o autocentrismo : os efeitos do recrutamento judicial na Argentina e no Chile

O presente artigo tem como objeto as dinâmicas geradas pelos modelos de recrutamento empregados nas Supremas Cortes da Argentina e do Chile. Sendo tais modelos antagônicos, visto que na Argentina o recrutamento se dá por indicação presidencial, enquanto no Chile se configura uma cooptação indireta, busca-se compreender qual é o papel que assumem na institucionalização, hierarquização e independência dos poderes judiciais em questão. Parte-se da hipótese que o recrutamento por indicação presidencial estabeleceu na Argentina uma elite judicial integrada ao desenvolvimento sociopolítico do país, apesar de ter facilitado o cerceamento à independência do Judiciário pelo Executivo. Já a cooptação chilena, ainda que tenha assegurado a independência judicial, incentivou a formação de uma elite com traços aristocráticos, autocentrada e que dificulta a renovação da interpretação judicial, deixando o Judiciário anacrônico. A hipótese do presente artigo será sustentada através da apresentação de um panorama histórico-estrutural da institucionalização dos judiciários em questão, observando o efeito dos modelos de recrutamento adotados, e das disputas para defini-los, em sua hierarquização e independência. Também se recorrerá ao método prosopográfico para aprofundar a apreensão da relação entre os padrões de recrutamento das Corte Suprema e a evolução do poder judicial. / This article has as object the dynamics generated by the models of recruitment employed by Supreme Courts in Argentina and Chile. Once these models are antagonistic, since in Argentina's recruitment happens through presidential appointment, while in Chile, it is a result from indirect cooptation, this paper is sought to understand the role they play in the institutionalization, hierarchization and independence of the referred judicial powers. The main hypothesis points out the recruitment by presidential appointment, established in Argentina, has generated an attentive and integrated judicial elite, concerned to the socio-political development of the country, despite having facilitated the retrenchment of the Judiciary independence by the Executive. On the other hand, Chilean cooptation, although it has ensured judicial independence, encouraged the formation of an elite with aristocratic traits, self-centered and reluctant in renewing judicial interpretation, leaving the Judiciary anachronistic. The hypothesis of this article will be sustained by the presentation of a historical-structural overview of the institutionalization of the both judiciaries, observing the effect of the recruitment models adopted, and the disputes to define them, in their hierarchization and independence. The prosopographic method will also be used to deepen the understanding of the relationship between the Supreme Court's recruitment patterns and the evolution of the judiciary. / El presente artículo tiene por objeto la dinámica generada por los modelos de reclutamiento empleados en las Cortes Supremas de Argentina y Chile. Una vez que estos modelos son antagónicos, ya que en Argentina el reclutamiento es por indicación presidencial, mientras que en Chile es por una cooptación indirecta, se busca comprender el rol que desempeñan en la institucionalización, la jerarquización y la independencia de los poderes judiciales en cuestión. La principal hipótesis es que el reclutamiento por indicación presidencial estableció en Argentina una élite judicial integrada al desarrollo sociopolítico del país, a pesar de haber facilitado la reducción a la independencia del Poder Judicial por parte del Poder Ejecutivo. Por otro lado, la cooptación de Chile, a pesar de que aseguro la independencia judicial, promovió la formación de una élite con rasgos aristocráticos, centrada en sí misma y que dificulta la renovación de la interpretación judicial, dejando el poder judicial anacrónico. La hipótesis de este artículo será sostenida mediante la presentación de un panorama histórico-estructural de la institucionalización del poder judicial de Argentina y Chile, observando el efecto de los modelos de reclutamiento adoptados, y las disputas para definirlos, en su jerarquización e independencia. También se utilizará el método prosopográfico para profundizar la comprensión de la relación entre los patrones de reclutamiento de la Corte Suprema y la evolución del poder judicial.

A supremacia judicial e a teoria dos diálogos constitucionais : sobre a implementação de mecanismos de diálogo no panorama constitucional brasileiro

A presente dissertação tem por objetivo apresentar ferramentas que fomentem a implementação de uma espécie de controle de constitucionalidade dialógico no ordenamento jurídico brasileiro, de forma a mitigar a supremacia judicial ostentada pelo Supremo Tribunal Federal. Para isso, foi organizado em três capítulos. Os dois primeiros dirigem-se a realizar uma abordagem comparada, por meio de um breve apanhado histórico e análise jurisprudencial, entre os sistemas constitucionais dos Estados Unidos, da Colômbia, da Costa Rica e do Brasil e entre os seus respetivos Tribunais imbuídos da função da realização do controle de constitucionalidade. Com isto, busca-se demonstrar o assentamento da supremacia judicial em uma visão mais ampla, bem como em uma realidade latino-americana. O terceiro capítulo, por sua vez, tem o escopo de explorar as diversas vertentes da teoria dos diálogos constitucionais, elaborar um conceito de diálogo substancial e, por fim, elaborar proposições de instrumentos dialógicos ainda não existentes no ordenamento jurídico pátrio, bem como sugerir a reformulação de alguns já existentes. O intuito primordial da parte final da dissertação é a busca da promoção de uma ressignificação do controle de constitucionalidade, de forma a democratiza-lo, mitigando a supremacia judicial, incluindo no debate sobre o significado da Constituição, além do Poder Judiciário, os Poderes Executivo e Legislativo, e a sociedade como um todo. / This master’s dissertation aims do present tools that provide the implementation of a kind of dialogic judicial review in the Brazilian legal framework, so as to mitigate the judicial supremacy displayed by the Supremo Tribunal Federal. In order to do that, it was organized in three chapters. The first two chapters carry out a comparative approach, through a short historical description e and jurisprudential analyses, between the American, the Colombian, the Costa Rican and the Brazilian constitutional systems and its respective Courts that perform judicial review. In that manner, it is the objective to demonstrate the settlement of judicial supremacy in a broad vision, and also in a Latin American reality. The third chapter, by its turn, aims to explore the different aspects of the constitutional dialogue theory, elaborate a concept of substantial dialogue and, in conclusion, elaborate propositions of dialogical instruments not yet existent in the native legal order, and also suggest a reformulation of others that already exist. The paramount intention of dissertation’s final part is the promotion of a resignification of judicial review, so as to democratize it, mitigating judicial supremacy, incorporating in the debate about the significance of the Constitution, other than the Judicial power, the Executive and the Legislative powers, and the society as a hole.

A utilização do Poder Judiciário para adquirir determinados tratamentos de saúde baseia-se no princípio instituído pelo Artigo 196 da Constituição Federal de 1988: "A saúde é direito de todos e dever do Estado". Dessa forma, o Estado brasileiro comprometeu-se em garantir a universalidade e a integralidade nos serviços de atenção à saúde, porém logo surgiram problemas relacionados ao financiamento e execução dos serviços, intensificados ao longo dos anos 2000 com a não regulamentação da Emenda Constitucional 29. Também a partir desse período, os gastos despendidos para a execução de um número crescente de ações judiciais passaram a gerar impactos excessivos para o Poder Executivo, contribuindo para inviabilizar a execução das políticas públicas previamente determinadas. Nesse contexto, o objetivo desta dissertação é contribuir para a compreensão do processo de judicialização da saúde, analisando primeiramente o debate dicotômico que circunda o tema (representado pelos profissionais da área do Direito e pelos formuladores de políticas públicas), e posteriormente realiza-se um estudo das características da judicialização da saúde no Estado de São Paulo. Para tanto, procurou-se analisar detalhadamente as particularidades inerentes aos processos impetrados contra este Estado, sobretudo em termos de crescimento do número de ações judiciais e elevação dos gastos para o seu cumprimento, além de ser realizada uma avaliação dos aspectos desse fenômeno utilizando os critérios de eficiência, eficácia e efetividade / Abstract: A recent phenomenon has been observed in Brazil: a growing trend for the citizens to request, through legal means, several actions and services related to health, particularly the free acquisition of drugs, which is generating a significant impact on the public budget. The use of the judiciary to acquire certain health treatments is based on the following principle, established by Article 196 of the 1988 Federal Constitution: "Health is everyone's right and duty of the State". Therefore, the Brazilian government has pledged to ensure the universality and comprehensiveness of health care services. However, soon problems related to the financing and delivery of the services arose. These problems were intensified throughout the 2000s with the deregulation of the Constitutional Amendment 29. Also, from this period on, the expenses with the increasing number of lawsuits began to generate a considerable impact on the Executive Branch, contributing to derail the implementation of the predetermined public policies. In this context, the objective of this dissertation is to contribute to the understanding of the judicialization process that health has been going through, examining first the dichotomous debate surrounding the subject (represented by professionals in the field of Law and by public policies makers) and then, carrying on a study of the health judicialization characteristics in the state of Sao Paulo.
