This diploma thesis deals with the issue of legal regulation of cashless payment transactions in the Czech Republic, as well as on European and international level. Furthermore, it focuses on the legal regime of payment accounts in the light of the amended Payment System Act No. 284/2009 Coll. that was adopted as a transposition of the Directive 2014/92/EU of the European Parliament and of the Council on the comparability of fees related to payment accounts, payment account switching and access to payment accounts with basic features. The aim of this thesis is to analyze and describe the current legal regime, including its critical evaluation and to outline the possible future development in the regulation of cashless payment transactions. The thesis is divided into three chapters. In the introduction, the author lays down the topic and the aim of the thesis and explains her motivation for writing a thesis from this area of law. The first chapter contains a theoretical introduction to the topic. The author explains what is a payment transaction, what forms can it take and who are the parties. The regulation of new electronic payment services in ChinaLi, Wen January 2014 (has links)
Due to the lack of efficient offline payment services for small value payment, and along with the booming of the Internet and telecommunications technologies, new electronic payment services and instruments are becoming increasingly popular and important in the first and second decades of the 21 century in China’s electronic commerce economy. The new electronic payment instruments, which primarily include Internet third party payment and virtual currency, are the subjects of research in this thesis. This thesis focuses on electronic payment law relating to the Internet, and the e-payment law which has been altered substantially by the Internet, rather than focusing on a comprehensive law of payment, clearance and settlement, or traditional mechanisms of payment, such as negotiable instruments and electronic funds transfers that occurs only within the intranet of closed banking systems. Although the new electronic payment instruments cannot escape from the influence of the traditional payment, and new payment instruments are based upon the traditional one both in technological infrastructure and in legal framework, the new electronic payment instruments do possess their own special features in technology, business models and in law. On this regard, readers might be asking why the author did not use the topic of “Internet Payment” or “online payment” instead of “new electronic payment” for the title of the thesis. The answer is because in China, telephone payment, along with Internet payment should be collectively considered as new electronic payment tools, and therefore, it is too narrow to just use the term “Internet Payment”. Also, the word “online” is, somewhat, a misleading word, and the author tries to specify in most cases whether it is an “Internet” or a “mobile network” or “landlines” or any other forms of networks in the following analysis when the concept of “online” has to be referred to. On the other hand, it is a truth that, among those new electronic payment instruments, it is the Internet that has been shaking and reshaping the infrastructure framework of payment, clearance and settlement; and telephone payment as well as mobile payment, to a great extent, are relying on the Internet. Therefore, Internet-related payment lies at the heart of the thesis. Furthermore, in China, new electronic payment instruments are largely created and facilitated through non-bank Internet third party payment providers and virtual currency, These two types of new electronic payment services possess enormous scale and are developing in a fast speed. Therefore, this thesis will treat the law on non-bank Internet third party payment platform providers and virtual currency as two crucial points to discuss.1 1.2 Research Questions The hypothesis of the thesis is that legal issues arising from new electronic payment services, which heavily rely on and is substantially attached to the Internet, are different from legal issues pertaining to traditional electronic payment services which are primarily intra-bank or inter-bank related. For example, in the Internet third party payment system (see Chapter 4 of the thesis), non-bank intermediaries are involved which is outside the regulatory framework of the traditional banking and payment system; also for example, in the virtual currency system (see Chapter 5 & 6 of the thesis), money is not issued by governments and denominated into any national legitimate currencies such as Renminbi in China, instead, money is issued by private Internet companies and denominated into currencies of those private companies. Thus, there are a number of legal questions to be considered: how is the Internet third party payment being regulated in China? What are the key issues in regulating the Internet third party payment? Is the current regulation appropriate? How to regulate the Internet games virtual currency in China? How is the Internet third party payment and virtual currency regulated in the European Union? Are there any lessons that China may learn from the European Union? In the thesis, the author examines these important legal issues relating to new electronic payment in detail, evaluate current existing regulations both in China and in the EU/UK, and propose specific regulatory approaches and measures for China.

The advance in information technology has encouraged many countries to develop diverse methods of delivering information and communicating. The enhancement of Information and Communications Technology (ICT) has made it possible to deliver information and communication more rapidly and conveniently. Many emerging economies have taken advantage of ICT, including it in its development agenda. The development of ICT has had an impact on the provision of retail payment systems and its instruments. One of the main instruments, electronic money, promises to benefit the users with all the advantages of traditional notes and coins, and much more. Many countries have established or are considering the establishment of a regulatory framework of electronic money with its mass use in view. This volume examines the regulatory framework of electronic money, which some emerging economies have already established. It analyses the challenges faced in implementing laws and regulations for an evolving payment instrument where the regulatory framework may quickly become obsolete. The continuing development of electronic money with additional features and functions may invoke legislation leading to cross-regulatory functions among the authorities. The thesis is that the success of implementing the regulatory framework for electronic money will depend on the sound and effective coordination among relevant authorities. The role of the central bank and its relation to relevant authorities will be closely examined, because the central bank is often responsible for the development of payment systems, both wholesale and retail, especially in emerging economies, and plays a key role in its regulation. The use of a Memorandum of Understanding is proposed to ensure effective coordination and cooperation among relevant authorities. Malaysia will be used as the case study as the government has been enthusiastic in adopting electronic money, being involved in its development, implementation and regulation, which may not always be appropriate. Analysis in this thesis will be based on information as of 1 September 2004. The first three chapters of this volume will discuss the enhancement of ICT in emerging economies and the efforts taken to develop retail payment systems in consonant with ICT. Evaluation will be made on the relationship between ICT and the need to modernise the retail payment, which includes developing its regulatory framework. Analysis will then be made specifically on electronic money, focusing on stored-valued products. The overall development on stored-valued cards and why the acceptance of this product was initially slow will be examined, and then the underlying regulatory structure that may affect this is assessed. The last two chapters will focus on Malaysia. Analysis will be made on the approach taken in developing electronic money and its regulatory framework. The roles and functions of the relevant authorities involved will be critically examined, leading to a proposal to execute a Memorandum of Understanding among the authorities as a mechanism of ensuring the effective coordination and cooperation between the parties.

Basic cryptographic and security related techniques were studied for the security analysis of current on-line payment systems.</p><p>In this work, various current on-line payment systems were classified into two groups [Macro and Micro on-line payment systems]. This classification was based on the mode of on-line payment transactions. To analyze these on-line payment systems, a set of payment system requirements were formed [Security Issues, Usability Issues, Anonymity, Scalability etc].</p><p>Under the category of Macro payment system, Credit Card payment system, Debit Card payment system, Stored Value Card payment system, Electronic Check payment system, Electronic Cash payment system, Electronic account transfer payment system and mobile payment system transactions were examined.</p><p>Under the category of Micro payment system, Hash Chain based Payment System, Hash Collisions and Hash sequences based Payment Systems, Shared Secrete Keys based Payment Systems and Probability based payment systems were examined.</p><p>Based on the requirements of payment system, these on-line payment systems were analyzed and compared. In the analysis phase, the advantages and drawbacks of these payment systems were figured out.</p><p>It was found from the study that the credit card based payment systems are the most widely used means of conducting on-line payments. It is evident that credit card based payment systems satisfy stakeholder requirements the best, as they offer more flexible payment options, having a large user-base, benefit from familiarity and simplicity of use and also allow international payments. The other on-line payment systems lack this flexibility</p><p>It can also be extracted from the study that users want more simplified, convenient and secure on-line payment systems. Thus the futuristic on-line payment systems will have all secure payment options into one system.</p>

Intervjuerna har visat ett resultat som är mycket troligt att man som ny utvecklare kommer i kontakt med i början. Positionen kan då vara både som utvecklare eller som ägare till webbshoppen. Det gick även att konstatera att det fanns ett antal betalväxlar lämpade för olika kunskapsnivåer. Professionell hjälp i form av råd och implementation måste inte tvunget vara en nödvändighet för att man ska kunna sätta upp en relativt avancerad webbshop.</p></p> / <p><p>This report deals with online Payment Service Providers (PSPs) from the developer's point of view. Two companies that were in or in close connection to the process of developing a web shop were interviewed and compared to the suppöy of payment options at a number of different payment PSPs. The interviews has shown a result which is probable that a new developer will get in contact with in the beginning. The position could be either as a web developer or as an owner of a web shop. It was also possible to establish that there were a number of PSPs suitable for different levels of knowledge within the field. Professional help such as advices and implementation is not necessary in order to be able to set up a relatively advanced web shop.</p></p>

Abstract
Since Mar. 1995, the National Health Insurance begin in Taiwan, the payment of health insurance gradually increase each year. For controlling the increasing costs, case payment was the most important method. For each hospital, using clinical pathway to control costs of case payment was an effective tool. But, there were still less literatures to discuss the efficiency of clinical pathway in Taiwan. We used a retrospective study design, to examine the length of stay, total costs and quality including the complications, morbidity and readmissions for total knee replacement surgery. The data before clinical pathway was from June 2001 to May 2002, total 219 cases. After clinical pathway, the data was from Jan. 2003 to Dec. 2003, total 207 cases. The results showed decrease length of stay from 7.4 to 6.6 days (10.8%), decrease total cost from 125,324 NTS to 119,100 NTS (4.97%) and the quality of complications and readmissions did not increase. In conclusion, the clinical pathway can improve length of stay, total costs and quality.

Objective: Since its implication, case payment system prevailed and increased cases number in the following years. Hospitals in Taiwan face continous challenge with emerging policies such as global budget and TW-DRG system, which is soon on the way. Remarkable medical resource comsuption is seen in patients with congenital heart deseases, with presence of structural heart defects at birth. The corrective treatment of congenital heart diseases, surgical and transcather, is usually undertaken in large-scale Hospitals in Taiwan.Congenital heart diseases. Items of case payment for congenital heart diseases treatment were implented years ago. However, in the literature there is yet no research about the results of its implentation.
This study focus on three objectives:
1.To study of medical resource consumption of case payment system with congenital heart diseases.
2.To study the effect of patient and provider attributes on medical resource consuption in the case payment with congenital heart diseases.
3.To provide the evidence-based information for forcoming NHI policies.
Materials and Methods:
Retrospectively, claims data from Bureau of National Health Research Insurance (BNHI) for resource utilization of case payment for congenital heart diseases was analyzed. The data includes DD(Inpatient expenditures by admissions) and HOSB(Registry for contracted medical facilities) files ranged from 1997 to 2005. Data items meeting the criteria of both CHD and case payment were extracted. The relationships between patient factors (age, sex, DRG code), healthcare provider (contract type, accreditation type, ownership, area) and resource utilization (length of stay, expenditure) were studied.
Results:
A total of 4,366 admissions for CHD case payment was enrolled. The mean patients¡¦ age is 14.56 years. Female accounts for 55.46 % of the admissions. Among them there are 3954 open heart surgeries and 412 transcatheter treatments. Average hospital day is 11.6 and 3.37 days respectively. Average payment per case is NT$215,355 and NT$61,819 respectively. Different degrees of resource utilization occur with different patient or hospital characteristics, with statistical signifcance. More resource utilization tends to occur in extremes of age groups, e.g., newborn and elderly populations, regardless open heart surgery or transcatheter treatment cases. Also more hospital fee occurred in private hospital than public hospital, but less in medical centers when compared to metropolitian hospitals. For regression analysis of dependence of resource consumption on patient and hospital factors, the overall power of explanation is higher in transcather treatment cases. Among the factors influencing medical resource utilization, age_group and ownership are respectively the most significant factors.
Conclusion:
We have verify the hypothesis in this study, which emphasize that resource utlization differs by different patient and hospital factors. The pattern of resource utilization for this unique disease (CHD) and its discrepancy with concurrent payment criteria are evaluated in this study. Based on our results, adjustment of payment criteria should be reasonable to ensure early and adequate treatment for these patients. Thus this study provides strong insight for implication of TW-DRG for disease management. Further study will include aspects of resource utlization such as direct, indirect costs, tangle and intangle, and related complication and comorbidities.

The rise of medical expenses is a common problem in the whole- wide world. All those countries implementing National Health Insurance have been anxiously looking for solutions, and clinical pathway has been found to be the most effective tool to control the growth of medical expense and maintain the quality of healthcare.
This study focuses on the development and implementation of clinical pathway of breast cancer who underwent modified radical mastectomy, and investigate the impact of implementation of clinical pathway on the control of the length of stay, inpatient medical care expenditures, healthcare quality, and patient¡¦s medical satisfaction. The 90 patients of MRM before implementation ( July 1999 to Sep. 2000 ) and 80 patients after implementation ( Jan. 2001 to Feb. 2002 ) are taken as the targets of this study. The major findings of the study are listed as follows:
1. Clinical pathway can reasonably control the length of stay.
2. Clinical pathway can reduce inpatient medical care expenditures.
3. Clinical pathway can improve healthcare quality.
4. Clinical pathway can improve patient¡¦s medical satisfaction.
5. Clinical pathway can influence doctor¡¦s partial practice pattern.
Finally this study concludes that clinical pathway is an instructive tool for hospital management. Based on the results and discussion from the study, we suggest the implementation of clinical pathway cones best in conjunction with the impact of case payment; besides, the quality of medical care should be assured under the controlled medical cost.
