A disputa entre diferentes projetos políticos no orçamento participativo do município de Vila Velha E. Santo: radicalização da democracia ou elitismo democrático?

No. of bitstreams: 1 tese_3493_Monica Freitas Ferri.pdf: 2587430 bytes, checksum: 997dcb6ff22efb0dc093062173eb7ccb (MD5) Previous issue date: 2009-08-31 / Entre as principais preocupações está o resgate do processo de redemocratização ocorrido no Brasil nas décadas de 1970 e 1980 que ampliou, nos marcos legais da Constituição de 1988, os limites da democracia representativa no país abrindo possibilidades para a criação de espaços públicos onde Estado e Sociedade civil possam partilhar poder e disputar interesses de acordo com seus projetos políticos. Analisa a disputa e a interação dinâmica entre os diferentes projetos políticos no processo de discussão do Orçamento Participativo (OP) no município de Vila Velha-ES no período de 1984-2008; e compreende como estas disputas e interações entre os diferentes projetos políticos orientam as decisões no OP, por meio de observação sistemática das assembléias e fóruns de delegados, entrevistas com informantes-chave sobre o tema, além de pesquisa documental. Os dados coletados foram analisados através de uma leitura crítica da realidade, levando em consideração a dialética e a historicidade dos fatos estudados. Os resultados mostram que a disputa entre os projetos políticos no OP é atravessada pelo conservadorismo presente na cultura política do país, e esse fato impede que o OP seja um instrumento de radicalização e ampliação da democracia no município. Apesar de no início da experiência o município ter forte capacidade associativa, as práticas clientelistas e privatistas dos governos em torno das decisões políticas, impediram que o OP pudesse ter resultados positivos, ocasionando o enfraquecimento do movimento popular, a redução da participação no OP e a despolitização deste espaço, fortalecendo as negociações privadas sobre interesses públicos. Entre os resultados aparece a necessidade de reorganização da sociedade civil, no sentido de transformar o OP num instrumento de transformação social, negociação de interesses e de elaboração de políticas públicas que atendam os interesses da maioria. Para a construção e aperfeiçoamento da democracia no Brasil é fundamental a ampliação de canais de participação em que atores da sociedade civil e do Estado possam, efetivamente, partilhar poder e disputar seus interesses.

The Consumer Protection Act 68 of 2008 is far-reaching, ambitious and the first of its kind in the Republic of South Africa. Before and even after the Act has come into force it still has many jurists scratching heads. The focus of this discussion will be on the effects of the Consumer Protection Act on the common law warranty against latent defects given by the seller as well as the effect of the Consumer Protection Act on the exclusion of the seller’s warranty in terms of a voetstoots clause. The consumer’s right to fair value, goods quality and safety (section 55) as well as the consumer’s implied warrant of quality (section 56) is discussed. Meer spesifiek word daar na die aspekte van aanneming, die posisie van die natuurlike vader en die kind se reg op afkomskennis gefokus. Die metodiek wat gevolg word is dié van 'n aanvanklike bestudering van die relevante• statute, regspraak en verslae wat die huidige posisie van bogenoemde aspekte in Suid-Afrika weergee ten einde die posisie te vergelyk met die in ander regstelsels. Met die benadering verander die doel van die verhandeling van 'n blote versameling regsreëls en dies meer in 'n regsvergelykende studie wat ten doel het om die heersende posisie in Suid-Afrika krities te kan evalueer. ENGLISH: In this dissertation aspects of children's rights are investigated with the aim of presenting the current situation and making several recommendations which would improve the current position of children. The aspects of adoption, the position of the natural father and the right of the child to knowledge of lineage are focused on in more detail. The methodology used starts by presenting an initial study of all relevant statutes, legal authority, court decisions/rulings and legal reports in order to allow for the comparison of the current position of the above mentioned aspects in South Africa with the position in other countries. Prokofiev Beckons the Double Bass Into the Modern Age: a Pedagogical Study of the Op 39 Quintet

Until Serge Prokofiev’s 1924 ballet score Trapèze, the double bass occupied a background or at best a doubling role in almost all composers’ use of the instrument. Technical challenge was limited in these pieces, because composers did not see the instrument’s potential in a chamber music environment. As luthiers developed the instrument, the technical ability of players grew, and composers began writing more challenging music for the instrument. As one of the first major composers to see the double bass in a new light, Prokofiev wrote challenging music for the instrument. This paper illuminates the alluring pedagogical aspects of Prokofiev's Quintet in G Minor, Op. 39 and provides recommendations for accomplishing some difficult passages with ease.

Establishing Editorial Principles to Create a Performance Edition of Selections From Appunti Op 210 By Mario Castelnuovo-tedesco

This paper examined editorial methods used in producing published versions of the music of Mario Castelnuovo-Tedesco (1895-1968). From this examination, I established some editorial principles to create a performance edition of five movements from book two of Castelnuovo-Tedesco’s Appunti op. 210. This paper includes a discussion of the sources and methods used in establishing editorial criteria. at the request of the Milanese guitarist Ruggero Chiesa (1933-1993), Castelnuovo-Tedesco set out to create a collection of didactic pieces for young guitarists. the pieces were to be collaboratively edited and fingered by Chiesa, and then given final approval by the composer. Unfortunately, the composer died before finishing the work. the pieces and sketches that survive exist in four volumes published by the Italian house, Suvini Zerboni, containing the pieces that Chiesa edited with the approval of Castelnuovo-Tedesco. the published edition also includes unedited pieces that did not undergo the collaborative process. with the goal of maintaining an unadulterated portrayal of the composer’s intentions, Chiesa presented these pieces as they appear in the manuscript. Much of the music is unidiomatic and either impossible or highly impractical to play. My study established some editorial principles for use in creating a performance edition of this work. the edition includes my engraving of the original unedited manuscript as well as ossia measures containing solutions to performance problems. the suggested solutions balance the perception of the composer’s intentions, established editorial practices, and idiomatic concerns to creating a playable edition.

A Performer's Guide to the First Two Movements of Pyotr Tchaikovsky's Grand Sonata in G Major, Opus 37

The Grand Sonata in G Major, Op.37, composed by Tchaikovsky, is a powerful large-scale composition and a piece of a symphonic scope. However, the sonata did not receive a desired acclaim in the modern repertoire partially due to an obvious lack of performance instructions in the existing editions, which makes the sonata challenging to perform. Thus, in order to reduce the technical challenges and to encourage more frequent performances of the sonata, this dissertation offers a performer's guide that addresses essential elements of pedal indications, phrasing and detailed dynamics, as well as suggestions on voice balancing, agogics, fingering, and hand redistribution. The guide consists of musical examples that are focused on the most challenging sections of the sonata, and is organized in the subsections according to a technique type proposed to facilitate a performance of the sonata. In addition to the examples on application of individual techniques presented in the main body of the dissertation, alternative and more elaborate versions of the suggestions are proposed in the appendices. The dissertation also provides a history of the sonata, and discusses its concept and symphonic principles. Additionally, the work highlights Tchaikovsky's piano style and describes his views on the art of piano performance. A special attention is also given to two musical references repeatedly embedded into the sonata: the bell-like sonorities and Dies irae melody.

At the beginning of the proposal are analyzed currently available solutions on the market. All parts of the currently deployed system are further investigated. When designing its own solution, the work takes into account all system requirements from the company’s employees. Subsequently, the information system is converted into the proposed form using the Nette framework. The last point of the work is the evaluation of the proposed improvements and the choice of implementation of the information system using a framework.

Este trabalho trata do processo de transcrição para violão solo das 12 Danzas Españolas Op. 37 de Enrique Granados, escritas originalmente para piano. Tal processo desenvolveu-se através da observação de versões para violão de outras obras originais para piano, comparações entre os recursos instrumentais específicos desses dois instrumentos e de um levantamento histórico, onde foram analisadas as principais problemáticas de adaptação dos elementos musicais e estéticos da obra original em um novo meio. A fim de contextualizar esse trabalho no panorama da transcrição, visitamos a história de Granados, analisando os aspectos gerais de suas Danzas Españolas, bem como discutimos a conceituação da scordatura para, a partir daí, empregar o método de pesquisa de diferentes possibilidades de afinação na busca de viabilizar a transcrição da obra em questão, sem perder de vista, durante esse processo, a ideia original do compositor. Através dos resultados alcançados, da maneira como compreendemos os métodos empregados, constatamos um amplo campo de possibilidades a serem pesquisadas e novas soluções de adaptação e scordature a serem empregadas, estabelecendo a prática da transcrição como um procedimento válido artisticamente, desde que devidamente contextualizado. / This work deals with the process of transcription for guitar solo of the 12 Danzas Españolas Op. 37 of Enrique Granados, written originally for piano. This process was developed through the observation of guitar versions of other original works for piano, comparisons between the specific instrumental resources of these two instruments and a historical survey, where the main problems of adaptation of the musical and aesthetic elements of the original work were analyzed in a new medium. In order to contextualize this work in the transcription panorama, we visit the history of Granados, analyzing the general aspects of its Danzas Españolas, as well as discussing the conception of the scordatura to, from there, to use the research method of different tuning possibilities in the seeking to make feasible the satisfactory assimilation of the work in question, without losing sight of, during this process, the original idea of the composer. Through the results obtained, as understood by the methods employed, we find a wide field of possibilities to be researched and new solutions of adaptation and scordature to be used, establishing the practice of transcription as an artfully valid procedure, provided that it is properly contextualized.
