A história e o discurso da lei: o discurso antecede à história

A total of 137 separation agreements under the custody of the Public Archives of the State of Rio Grande do Sul, Department of Administration and Human Resources, were investigated. These agreements had been filed with the Family Divisions of the Judicial District of Porto Alegre, and involved uncontested legal separations between 1930 and 1964. The analysis is targeted at determining possible implications of family aspects, such as affection, violence, disagreements and pain regarding the decisions announced by the Judiciary, by approaching the history of legal ideas, in an attempt to understand social changes. It should be highlighted that the women’s question also constitutes the focus of the present thesis. The speed at which social changes occur renders the discourse of law inefficient, given that it is utterly out of step with social needs, thus leading society to the establishment of its own rules. / Trata a presente tese da análise da sociedade em busca do estabelecimento de suas próprias regras, antecipando o discurso da lei. Utiliza-se como material 137 processos que estão sob a guarda do Arquivo Público do Rio Grande do Sul, da Secretaria da Administração e dos Recursos Humanos/SARH, que tramitaram nas Varas de Família da Comarca de Porto Alegre, referentes aos desquites (separações) amigáveis no período de 1930 a 1964. Tal avaliação medirá possíveis implicações de aspectos da família, como afetividade, violência, desencontro e dor nas decisões proferidas pelo Poder Judiciário, através dos enfoques da História das Idéias jurídicas, na expectativa de se compreender as transformações sociais. É preciso considerar, ainda, que, ao longo do percurso, a questão feminina se constitui o foco da presente tese. A velocidade das mudanças sociais torna o discurso da lei ineficaz, uma vez que está em total descompasso com a necessidade social, conduzindo a sociedade à criação de suas próprias regras.
