O CONTROLE JURISDICIONAL DE CONVENCIONALIDADE: análise do tratado internacional das pessoas com deficiência em relação à legislação previdenciária brasileira e argentina

This work has the objective analysis about the treatment of the conventionality control laws in the Brazilian and Argentine legal scenario. As we search problem is to analyze what the hierarchy of international human rights treaties entered into both legal systems and, in result, analyze the existence or not of vertical compatibility and material between the laws governing the retirement of people with disabilities in each of these countries on the International Convention on the Rights of Persons with Disabilities. Regarding methodology, we chose to use the deductive method of approach, based on the study of the concepts brought by the International Convention, the Brazilian legislation and the Argentine legislation with the aim of achieving the ability to analyze it in everyday cases from the application of conventionality control theories. Still, regarding the method of procedure, because of the need precisely to point out that the similarities and dissimilarities between the domestic laws of each country in relation to international rule. In this way, it was noticed that lies a discrepancy regarding the person of significance with disabilities in each of these standards, since the international treaty brings an extremely broad definition of disabled person in order to seal the right to a large section of society that because of medical, social, educational, vocational, psychological or cultural barriers are outside the social life and the labor market. In contrast to this, Brazilian law restricts the finding of disability to cases of medical and social order, although the Argentine law restricts only to medical disability cases. Such existing conceptual discrepancy between the rules affect too much a large part of society, since, acting in such a way, one is undeniably excluding the legal protection a large portion of society that fails to include socially and professionally because of issues beyond the mere medical or social look. Therefore, it shows extremely important study with the aim of triggering the incompatibility of existing laws can be act to modify the current state of affairs and, by consequence, to include a greater number of individuals in the legislative seal in strict observance of the auspices of the human rights of persons with disabilities / A presente dissertação tem como escopo a análise acerca do tratamento dado ao controle de convencionalidade das leis no cenário jurídico brasileiro e argentino. O problema se pesquisa reside em analisar qual a hierarquia dos tratados internacionais de direitos humanos inseridos em ambos os ordenamentos jurídicos e, em virtude disso, analisar a existência, ou não, de compatibilidade vertical e material entre as leis que regulamentam a aposentadoria das pessoas com deficiência em cada um desses países em relação à Convenção Internacional sobre os Direitos da Pessoa com Deficiência. No que tange à metodologia empregada, optou-se pela utilização do método de abordagem dedutivo, partindo do estudo dos conceitos trazidos pela Convenção Internacional, pela legislação brasileira e pela legislação argentina com o fito de lograr a possibilidade de analisá-la em casos do cotidiano, a partir da aplicação das teorias do controle de convencionalidade. Ainda, em relação ao método de procedimento, em virtude da necessidade, justamente, de apontar quais as semelhanças e dessemelhanças existentes entre as legislações domésticas de cada país em relação à norma internacional. Nesse propósito, percebeu-se que reside uma discrepância no que tange à significação de pessoa com deficiência em cada uma dessas normas, uma vez que o tratado internacional apresenta um conceito extremamente amplo de pessoa com deficiência, a fim de chancelar o direito de uma grande parcela da sociedade que, em virtude de barreiras de ordem médica, social, educacional, profissional, psicológica ou cultural, se encontram à margem do convívio social e do mercado de trabalho. Em contraponto a isso, a legislação brasileira restringe a constatação da deficiência para casos de ordem médica e social, conquanto a legislação argentina restringe a mesma somente aos casos de deficiência médica. Tal discrepância conceitual existente entre as normas prejudica em demasia uma grande parcela da sociedade, uma vez que, agindo de tal forma, está-se, inegavelmente, excluindo da proteção legal uma grande parcela da sociedade que não consegue se incluir social e profissionalmente em virtude de questões que ultrapassam o mero olhar clínico ou social. Portanto, mostra-se de fundamental importância o estudo, no intuito de, deflagrando a incompatibilidade de leis existentes, possa-se agir no sentido de modificar o atual estado de coisas e, por consequência disso, incluir um maior número de indivíduos na chancela legislativa, em estrita observância aos auspícios dos direitos humanos das pessoas com deficiência.

In this article, the author analyzes the impact of the Kantian concept of human dignity in the UN Convention on the Rights of Persons with Disabilities. Likewise, the author elaborates a critique of the principle which argues that persons with disabilities’ individual autonomy and capacity to make decisions must be respected, regardless of the particular circumstances of the case, and finally proposes an interpretation of this principle based on the principle of equality. / En el presente artículo, el autor analiza la incidencia del concepto kantiano d e d ignidad h umana e n l a C onvención I nternacional sobre los Derechos de las Personas con Discapacidad de la ONU. Asimismo, el autor realiza una crítica al principio que sostiene que deben respetarse siempre, sin importar las circunstancias particulares del caso, la autonomía individual y la capacidad de las personas con discapacidad de adoptar decisiones, y, finalmente, propone una interpretación de este principio con base al principio de igualdad.

This thesis project consists WHOQOL-LIBRAS. This project is a partnership between the Federal University of Goiás, the World Health Organization and the Federal University of Rio Grande do Sul. For their implementation was divided into two sub-projects: 1) Project 1 - Construction of the version of the LIBRAS WHOQOL-BREF and WHOQOL DIS, 2) Project 2 - Implementation / validation of the LIBRAS version of WHOQOL-BREF and WHOQOL - DIS. The realization of the project 1 was guided by a methodology developed by WHO, adapted by the WHOQOL GROUP in Brazil, which consisted of thirteen steps. This study complies with the Stage 7 Project 1 with the completion of a three focus groups to analyze the LIBRAS version of WHOQOL-DIS. Objectives of this study were to evaluate the understanding and relevance of the instrument WHOQOL-DIS translated to Brazilian Sign Language and perform integrative literature review to identify public policies for health care of the person checking the recognition of Deaf people as language and cultural minority in Brazilian legislation. Cross-sectional study, exploratory, qualitative, uses focus group technique in three groups: 1) group of Deaf users of LIBRAS, 2) group of family members of the Deaf, 3) group of interpreters of the LIBRAS. Made in the Federal Institute of Goiás groups had six to nine participants. Two meetings were held. The first meeting was to explain the project of quality of life/WHO. The second meeting was to discuss the version of each issue of LIBRAS WHOQOL-DIS. At the end of each issue discussed his understanding, relevance and collected suggestions for change. The encounters were videotaped and later transcribed. Data analysis was to reference the content analysis of Bardin. All issues of the WHOQOL-DIS version in LIBRAS were understood and considered relevant for assessing the quality of life of Deaf people by all components of the focus groups. To qualify the records of the health data of the deaf population is necessary to conduct research with instruments that they consider their differences and, therefore, support public policies that ensure the health Deaf access to quality care provided. / A avaliação da qualidade de vida utilizando instrumentos que consideram as diferenças linguísticas e culturais da população Surda, contribui para subsidiar políticas públicas relacionadas à saúde e adequação do cuidado oferecido a esta população. Esta dissertação faz parte do projeto WHOQOL-LIBRAS, resultado da parceria entre a Universidade Federal de Goiás, a Organização Mundial de Saúde e a Universidade Federal do Rio Grande do Sul. Para execução do WHOQOL-LIBRAS, foram desenvolvidos 2 projetos: Construção da versão em LIBRAS do WHOQOL-BREF e WHOQOL-DIS; Aplicação e validação da versão em LIBRAS destes instrumentos. A metodologia utilizada foi estabelecida pela OMS e adaptada pelo grupo WHOQOL no Brasil, e consistiu em treze etapas. Este estudo realiza a análise por grupos focais da versão em LIBRAS do WHOQOL-DIS. Objetivo geral deste estudo foi analisar a compreensão e relevância das questões do instrumento WHOQOL-DIS traduzido para LIBRAS. Trata-se de um estudo transversal, exploratório e qualitativo utilizando a técnica de grupo focal em três grupos: 1) grupo de pessoas Surdas usuárias da LIBRAS; 2) grupo de familiares de Surdos; 3) grupo de intérpretes da LIBRAS, realizados no Instituto Federal de Goiás. Os grupos contiveram de 6 a 9 participantes. Foram realizados dois encontros que foram filmados e posteriormente transcritos: o primeiro para explicação do projeto de qualidade de vida da OMS e o segundo para discussão da versão em LIBRAS de cada questão do WHOQOL-DIS. Ao término de cada questão, foram discutidas sua compreensão e relevância e colhidas sugestões de alteração. A análise dos dados teve como referência a análise de conteúdo de Bardin. Todas as questões do instrumento WHOQOL-DIS na versão em LIBRAS foram compreendidas e consideradas relevantes para a avaliação da qualidade de vida da população Surda por todos os componentes do grupos focais. Para qualificar os registros dos dados relativos à saúde da população Surda, é necessária a realização de pesquisas com instrumentos que considerem suas diferenças para subsidiar políticas públicas que garantam ao Surdo um acesso de qualidade ao cuidado que lhe é oferecido.

Positive obligations of state arising from Art. 3 of the European Convention on Human Rights focusing on persons with disabilities Absolute prohibition of torture and ill-treatment is clearly set in article 3 of the European Convention on Human Rights. When assessing particular obligations, which are arising out of it, we need to look deep into the European Court of Human Rights jurisprudence. The aim of this thesis is to analyse positive obligations of state arising from article 3 focusing on persons with disabilities. This is achieved also with the aid of various human right bodies such as UN Human Rights Committee, UN Committee on Torture or UN Committee on the Rights of Persons with Disabilities. Due to the fact that this area is not really covered yet, certain parts of this thesis are focused on defining important terms and putting them together. The approach is analytic with elements of comparison between the view of European Court of Human Rights and other relevant international human rights bodies. The objective of this master thesis is to analyze and evaluate the accessibility of social services in Central Bohemia. Special attention is given to the area around the city of Rakovnik with the goal of evaluating itsbreadth and availability of social services in this peripheral area of Central Bohemia. The introduction of the theoretical part begins with the definition of social politics, including its models and principals. A description of the social politics of the Czech Republic, along with related laws, structure of social services and their providers follows. The theoretical part of the thesis includes a comparison of social systems in the Czech Republic, Austria and Slovakia. The conclusion is dedicated to issues of community planning, its creation and benefits associated with it. The practical part of the thesis deals with social services in Central Bohemia. Attention is focused on community planning throughout Central Bohemia and the structure, typology and availability of social services for its residents. The practical part offers a more detailed analysis of social services in Rakovnik, presenting its community plan and the structure of services offered in the district. The methods used in developing the topic of this thesis is a literary review, descriptions, analysis, interviews, results of emprirical investigations and an imperical synthesis of learned facts.

The right to alternative care of children with disabilities in Ethiopia and South Africa

Doctor Legum - LLD / The importance of a nurturing environment on early child development and the central role that a family environment plays to this end are widely recognised. However, most children with disabilities lack family life and parental care and often find themselves disproportionately represented in the category of children that need alternative care arrangements. The limited access to family-based alternative care options for children with disabilities deprived of their family environment is the primary concern of this study. Studies have shown excessive dependence on institutions as a means to provide care for children with disabilities deprived of their family environment, despite the overwhelming evidence on the negative effects of placement in institutions on the development and well-being of children. This contradicts with a number of rights articulated in international and regional standards dealing with the alternative care of children in general, and children with disabilities in particular. This study seeks to examine the extent to which the rights of children with disabilities are respected in the context of alternative care in two jurisdictions in Africa – Ethiopia and South Africa. The two countries are State Parties to the applicable international and regional instruments concerning the alternative care of children with disabilities. These standards include the Convention on the Rights of the Child, the Convention on the Rights of Persons with Disabilities, and the African Charter on the Rights and Welfare of the Child. The UN Guidelines for the Alternative Care of Children and its principles of ‘necessity’ and ‘suitability’ also offer some guidance.

What kind of services there are, what are the possibilities of finding work both on open labour market and in the sheltered environment. The work also describes what is in the Czech Republic legislation regarding the employment of people with disabilities. The work includes mapping of services, what is offers to to people with disabilities by state employment policy - its pros and cons, accessibility and clarity of the services provided by NGOs, mainly by supported employment as an alternative to the protected labor market. The work also deals with a proposal for the creation and of the workplace, which should be co-financed by the labor office and its active employment policy funds. Workplace should be managed by NGO Rytmus - od klienta k občanovi. The aim is to analyze and capture the particular aspects of the financing and viability of project, which would be within the organization completely new. I tis not an attempt to create a comprehensive business plan, which would mapped all the aspects, but rather to create a material that will be in the organization and serve as guide or inspiration. The thesis aims to present the topic of voting rights of people with intellectual disabilities within the domestic and international legislative framework and to explore the perception of elections and voting rights from the perspective of people with intellectual disabilities by applying qualitative research. The theoretical part describes elections, voting rights, specific features of people with intellectual disabilities, and availability of the support to vote. The essential part of the diploma thesis also contains a legislative overview, which anchors the voting rights of people with disabilities.
