A teoria do Poder Constituinte Derivado de Equivalência às Emendas Constitucionais busca abarcar por completo o fenômeno jurídico da aprovação de tratados e convenções internacionais sobre direitos humanos como equivalentes às emendas constitucionais, nos termos do §3º do art. 5º da Constituição, inserido pela Emenda Constitucional nº 45/04. Após a descrição crítica do panorama constitucional, doutrinário e jurisprudencial em que foi engendrado este novo dispositivo do art. 5º e o procedimento pelo qual foi aprovada a incorporação da Convenção sobre os Direitos das Pessoas com Deficiência e de seu Protocolo Facultativo como equivalentes às Emendas, seguem as três partes essenciais e imprescindíveis que compõem a abordagem do tema. A primeira está voltada à caracterização da presença de uma nova manifestação de Poder Constituinte, com o objetivo de oferecer soluções coerentes e consistentemente respaldadas em um arcabouço teórico comum para toda a problemática envolvida, que será especificamente examinada a partir das questões enfrentadas na Parte II. Já a terceira parte está mais atrelada às questões materiais, ao se preocupar com o objeto da equivalência constitucional: se esta inclui todo o diploma internacional; exclusivamente os direitos humanos nele previstos; ou também normas de outra natureza, abstraindo e projetando conclusões a partir da experiência concreta da Convenção. A mais intensa contribuição para o pensamento jurídico encontra-se evidentemente na identificação de uma nova modalidade do Poder Constituinte Derivado; mas também, na conceituação das normas equivalentes às emendas constitucionais; ao se apontar o exato objeto do §3º do art. 5º, desvelando-se a complexidade dos fenômenos envolvidos na introdução da Convenção e de seu Protocolo Facultativo; na delimitação do espectro normativo das normas equivalentes às emendas constitucionais; e na obtenção de uma maior conformidade teórica com os fundamentos dos sistemas jurídicos constitucional e internacional, a partir do entrelaçamento entre as teorias do direito e do Estado; e as disciplinas do direito constitucional; internacional; e dos direitos humanos. / The theory of Constitutional Amendments Equivalence of Derived Constitutional Power seeking to embrace fully the phenomenon of legal approval of international treaties and conventions on human rights as equivalent to constitutional amendments, pursuant to §3º of art. 5º of the Constitution, inserted by Constitutional Amendment nº 45/04. After critically describing the constitutional, jurisprudential and doctrinaire panorama in that was engendered in this new device of art. 5º and the procedure by which the incorporation of the Convention on the Rights of Persons with Disabilities and its Optional Protocol was approved as equivalent to the Amendments, follow three essential parts that make up the approach to the subject. The first is directed to describe the presence of a new manifestation of constituent power, with the goal of providing solutions coherent and consistently backed into a theoretical framework common to all the problems involved, which will be examined specifically from the issues faced in Part II. The third part is more tied to material issues, to worry about the object of constitutional equivalence: if this includes the entire international diploma; exclusively human rights therein, or also rules otherwise, abstracting and projecting findings from the concrete experience of the Convention. The most intense contribution to legal thought is evidently in the identification of a new type of constitutional derived power; but also in the conceptualization of equivalence to constitutional amendments norms; when pointing the exact object of §3º of art. 5º; revealing the complexity of the phenomena involved in the introduction of the Convention and its Optional Protocol; the delimitation of the spectrum of equivalent to constitutional amendments norms; and in obtaining greater theoretical conformity with the fundamentals of the constitutional and international legal systems, from entanglement between the theories of law and the State; and the disciplines of constitutional law; international law; and human rights

Os bens culturais imóveis são motivo de interesse da população em geral, inclusive das pessoas com deficiência e mobilidade reduzida. O diálogo entre preservação e acessibilidade precisa avançar para dar boas soluções de acesso e circulação e, assim, não inibir a participação de ninguém, quaisquer sejam suas características sensoriais, cognitivas e motoras. Legislações de preservação e de acessibilidade no Brasil pouco falam sobre essa interação e a consequência é a grande dificuldade conceitual e prática para resolver a questão. A finalidade do presente trabalho é demonstrar que as diretrizes de preservação e restauro permitem a convergência para a acessibilidade e que a adequação à acessibilidade pode ser implementada mesmo com as limitações necessárias à preservação do bem. Três etapas foram estabelecidas para averiguar o objetivo proposto. Primeiramente, a análise crítica dos parâmetros existentes, como leis, normas e instruções, que dão suporte para o possível contato entre os campos de preservação e acessibilidade. Posteriormente, a avaliação técnica, relativa à acessibilidade e à preservação, das adaptações feitas em três objetos de estudo (utilizados como museu ou centro cultural) ? Casa das Rosas, Centro Cultural Banco do Brasil e Pinacoteca do Estado ?, destacando suas qualidades e limitações. Finalmente, a averiguação da percepção do usuário com deficiência, para assim, examinar a eficácia das soluções realizadas. / Historic buildings are of interest to the wide population, including persons with disabilities or reduced mobility. The dialogue between preservation and accessibility needs to advance to provide good access and circulation solutions, thus allowing anyone to participate, no matter what their sensory, cognitive or motor characteristics may be. Legislation for preservation and accessibility in Brazil hardly mentions an interaction between these fields, creating huge conceptual and practical issues in resolving the matter. The goal of this work is to demonstrate that guidelines for preservation and restoration of these buildings allow for a path towards accessibility, and that accessibility can be implemented respecting the limitations necessary to preserve such an asset. Three steps have been established to analyze the proposed goal. First, the critical analysis of the existing parameters, such as laws, norms and instructions, which support the connection between preservation and accessibility. Then, a technical evaluation regarding accessibility and preservation of three study objects (used as museums or cultural centers) - Casa das Rosas, Centro Cultural Banco do Brasil and Pinacoteca do Estado -, showcasing their features and limitations. Finally, a look at the perception of disabled users, in order to examine the efficacy of the solutions used.

Tools of the Active Labour Policy in the Light of Employment of Persons with Disabilities Abstract The Diploma Thesis "Tools of the Active Labour Policy in the Light of Employment of Persons with Disabilities" deals with the institute of the Active Labour Policy contained foremost in the Act No. 435/2004 Coll., the Labour Act. The first part of the Thesis outlines a wider context of the Active Labour Policy, especially its relationship to the right to work, to the Labour Policy as to its parent concept and to situation of the Disabled as in the Czech legal regulation and international documents. The second part describes and evaluates the legal regulation of individual tools, while the focal point is the possibility of their use in the employment of persons with disabilities. It deals not only with the tools specifically designed to support the employment of the Disabled, as the rehabilitation and the protected working places. It also pursues general tools of the Active Labour Policy, as e.g. the requalification, the investment incentives, the socially expedient working places and the shared employment mediation. A presente dissertação versa sobre as disposições da Convenção Internacional sobre os Direitos da Pessoa com Deficiência, com o respectivo Protocolo Facultativo, e do Estatuto da Pessoa com Deficiência, relativas ao instituto jurídico do casamento. O objetivo do trabalho é examinar as alterações promovidas por tais diplomas normativos no ordenamento jurídico brasileiro e avaliar o seu impacto na proteção jurídica desse importante segmento da sociedade. Nessa abordagem, são analisados o tratamento jurídico deferido à pessoa com deficiência em uma perspectiva histórica e a modificação do conceito normativo, bem como a figura da tomada de decisão apoiada e os reflexos da nova disciplina jurídica na curatela, sob o prisma da autonomia e da dignidade da pessoa humana. Na sequência, é examinado o instituto do casamento em seus diversos aspectos, com a proposição de alternativas para o incremento da proteção jurídica da pessoa com deficiência no matrimônio, tendo em vista a insuficiência da ordem jurídica vigente para esse fim. / This dissertion is made with the intent of reviewing the provisions of the International Convention on the Rights of Persons with Disabilities, with its respective Optional Protocol, and of the Statute of Persons with Disabilities concerning the legal institute of marriage. The methodology used is, predominantly, bibliographical research, with the analysis of scientific works and published articles. The objective of the study is to analyze the changes promoted in the marriage and to propose some solutions to the problems encountered during the research. In this approach, the legal treatment accorded to the disabled person in a historical perspective and the alteration of the normative concept, as well as the introduction of the supported decision making institute and the reflexes of the new juridical discipline granted (?) to the curatorship, under the prism of the autonomy and the dignity of human person. Afterwards, the institute of marriage is examined in its various aspects, proposing alternatives to increase the legal protection of persons with disabilities in marriage, due to the insufficiency of the legal system in force for this purpose.

Employing persons with disabilities in Madagascar

In Madagascar, the barriers to persons with disabilities' employability are multifaceted and relate to accessibility, funding, attitudes, and policies. Managers lack knowledge on disability and still perceive disabled persons as incompetent and associate them with costly accommodation needs. The purpose of this qualitative case study was to examine the management strategies and leadership styles that managers could use to enhance the employability chances of persons with disabilities. The conceptual framework featured the concepts of empowerment, employability, disability identity, and relevant transformational leadership theories. Semistructured interviews were conducted with 28 managers in private companies, institutions, cooperatives, and organizations in 3 regions of Madagascar. Data analysis was done with open hand coding and using NVivo 12 software. Key findings related to enabling management strategies that included promoting fair recruitment, tailoring jobs to disabled workers' competences and health conditions, ensuring communication and reasonable accommodation. The study revealed the merit of an inclusive transformational leadership in fostering the employability of persons with disabilities, through coaching, in-training supports, compassion and kinship, motivation, and trust building. The study benefits managers who could better attend to disabled workers' vocational needs. The study contributes to positive changes by influencing attitude change within the workplace and the community that could pave the way to an inclusive society in which disabled people could enjoy their rights to work.

The portrayal of disability on the websites of the higher education institutions : A comparative critical discourse analysis on the web pages of disability services in Latvia and Sweden

The aim of this thesis is to critically examine and compare the web pages that provide disability content and information of ten selected Latvian and Swedish higher education institutions’ websites. The theoretical framework of the research is built upon the critical discourse analysis and Michel Foucault’s ideas of discourse and power while the analytical framework incorporates elements of Mullet’s (2018) framework of critical discourse analysis, Pauwels (2012) multimodal framework for analysing websites and the snapshot click study by Gabel et al. (2016). Overall, the examined web pages see disability from human rights and medical perspectives. The research findings indicated both similarities and differences between the two countries and the ten higher education institutions. The disability content on the web pages of Latvian higher education institutions focuses mainly on the physical accessibility, whereas Swedish institutions pay more attention to the academic and student services.The research results suggest that while the examined higher education institutions do somewhat attempt to include persons with disabilities within the higher education, they simultaneously continue to maintain and construct social barriers that exclude them.

ENTREPRENEURSHIP AS A MEANS OF IMPROVING THE SOCIAL AND ECONOMIC CONDITIONS OF PERSONS WITH DISABILITIES

<p>Government efforts to improve the self-employment prospects of persons with disabilities are increasing, yet there is a dearth of information about the outcomes of these initiatives. Further, methodological limitations in the entrepreneurship literature make it difficult to determine the effectiveness of entrepreneurship education more generally. This three-wave, quasi-experimental study provides the first quantitative examination of the outcomes of entrepreneurship education programs for persons with disabilities, indicating that the programs are effective in helping participants to create their own businesses. Contributions are also made to entrepreneurship pedagogy via the first quantitative assessment of the place-train model applied to entrepreneurship development, showing that this approach when combined with financial incentives yields significantly better results than the train-place approach without financial incentives. The study contributes to theory building in entrepreneurship by investigating theory of planned behaviour relationships that have not been adequately assessed, showing significant relationships between intentions and nascent gestation behaviours. The relationship between nascent gestation behaviours and actual business creation is also shown, thus helping to demonstrate the value of utilizing the theory of planned behaviour in examining education interventions designed to promote business creation. Also, the study assesses whether those persons with disabilities who are successful at creating their own businesses have an associated increase in self-esteem, and thus the potential to reap both economic and social psychological rewards, with results indicating it is the activity of trying to start a business, rather than actual business creation, that best predicts increases in self-esteem.</p> / Doctor of Philosophy (PhD)
