It has been designed as a mechanism that overcomes perceived deficiencies of the ordinary, in principle adversarial criminal justice process. / Based on case examples and interviews conducted in three localities in mainland China in 2008 and 2010, however, this thesis argues that this mechanism may infringe the rights of suspects and defendants as well as of alleged victims (summarily referred to as ‘the parties’) in criminal cases, and that it may lead to injustice. While the case files accessed for the purpose of this research purport to document a well-functioning process of criminal reconciliation in accordance with the rules and principles supposed to govern it, interviews provide a drastically different picture. In practice, the criminal justice process was not characterized by the principle of voluntariness supposed to be one of its main advantages; rather, the officials in charge dominated the process. In addition, the entire process exclusively focused on compensation, so it was potentially unfair to economically weak suspects and defendants. It was also found in some cases that the conflict between the parties still existed or had worsened at the end of the criminal reconciliation programmes. / On the basis of these findings, it is argued that criminal reconciliation throws light on fundamental problems with the wider criminal justice system. First, officials in the criminal justice system, routinely ignore certain legal rules protecting the parties’ rights and to some extent replace these rules with ‘hidden rules’ (qian guize), whose content is largely shaped by politically driven performance assessment criteria, as well as in some cases by intervention from other entities such the Political-Legal Committee. Second, the criminal proceedings in China reflect an authoritarian, paternalistic and educational (thought-reform-based) approach to criminal justice; the parties’ rights are regarded as secondary to this political end. Third, the State does not take sufficient responsibility to protect the victim’s right to get compensation in the civil litigation collateral to criminal proceedings. / In conclusion, this thesis argues that resolving criminal cases through ‘criminal reconciliation’ may aggravate the problems already affecting the ordinary criminal justice process, because it is a mechanism designed to weaken procedural rights protections, and eliminate the adversarial character of the criminal justice process. This is a very imporant part of a civil procedure, because evidences are - from a practical point of view - the crucial stage of a procedure. Right by means of evidences the Court may obtain factual and material information serving a base for a meritory decision. This work is aimed to an analysis of the present legislative definition of the various types of evidences, the specific features of them, and a way of an implementation and the following assesment of them made by the Court of Justice. 1 SUMMARY The nullity plea is one of the three extraordinary remedies provided for in the Civil Procedure Code. Its purpose is to correct substantial procedural errors that occurred in judicial decisions or in the preceding civil proceedings. If one of the nullity grounds, regulated by Article 229 of the Civil Procedure Code, is present and all other conditions of admissibility are fulfilled, the court cancels the earlier final decision which terminated the proceedings, regardless of whether or not it is correct from the matter-of-fact point of view. The nullity plea represents a unique institute that solves the conflict between the interest in protecting legal certainty founded by a final decision of the court, and the interest in a defective decision being eliminated. The conditions of its admissibility are therefore set so as to only limit its application to cases in which the second interest prevails. The purpose of the diploma thesis is to provide a complex analysis of the nullity plea, in particular the conditions of its admissibility and the proceedings pertaining thereto. Moreover, the South African government has taken significant legislative steps to ensure that victims have formal rights in criminal justice proceedings. However, to date, comparatively little attention has been paid to the question of whether or not victims should be allowed a meaningful role in the process of plea and sentence negotiations. One of the aims of this study is to determine whether victimsâ rights are properly understood, defined and implemented within the criminal justice system. in English: The Expression of Plea, Request and Order in Spanish (with Regard to Czech) The aim of this work is to examine the language forms for expressing a plea, request and order in Spanish, taking into account their Czech counterparts. The work is divided into theoretical and practical part. In the theoretical part of the work we start from the basic works that gave rise to the modern theory of politeness. These findings then serve as a pragmatic basis for the study of our selected structures. For analysis we choose: imperative, deontic use of infinitive and gerund, deontic use of paradigms hablaré and hablo, performative use of verbs mandar and ordenar, performative use of verbs pedir, rogar and suplicar, interrogative constructions with verb poder, interrogative constructions with por qué no, interrogative constructions with quieres and interrogative constructions with te importa / importaría que. We theoretically describe these constructions and then analyze them on the Intercorp v12 corpus and present their Czech counterparts. Our intention is a qualitative analysis, with special emphasis on the context in which the structure is located.
