The political structure, in turn, occurs in the tension between two basic concepts for the Philosophy of Liberation: Potentia and Potestas. Thus, this work aims to analyze these two concepts in order to understand how interconnected the fields of ethics, teaching and politic of a transmodern arquitetonic. Ethical principles, the formation of the man politician, democracy as an instrument of feasibility criteria, the possibilities of violence and consensus, the question of method, among others, chances are faced in order to clarify the constitution of power in Enrique Dussel. / De acordo com a teoria dusseliana, ética e política devem caminhar juntas. Quando isso não ocorre, o poder é corrompido, fetichizado. A ética apresenta os fundamentos ideais para a estrutura política. A estrutura política, por sua vez, ocorre na tensão entre dois conceitos basilares para a Filosofia da Libertação: a Potentia e a Potestas. Nesse sentido, este trabalho possui como objetivo analisar estes dois conceitos a fim de compreender de que maneira interligam os campos da ética, pedagógica e política de uma arquitetônica transmoderna. Os princípios éticos, a formação do homem político, a democracia enquanto instrumento do critério de factibilidade, as possibilidades de violência e de consenso, a questão do método, dentre outros, são hipóteses enfrentadas no intuito de esclarecer a constituição do poder em Enrique Dussel.

Static and Dynamic Aspects of the Roman Family Abstract: The thesis deals with Roman family law, the core of the research being the Roman family in the Republican era and the beginning of the Principate. However, the archaic rules of regal period on one hand, and of the period of Dominate or even of the times of Justinian on the other, can also be included to present the overall picture of the development of a certain institution. Three main research goals are outlined in the introduction of the work to be reached throughout the following three chapters. The first goal is to define the term of the Roman family; the second is to connect theory and practice, i.e. so-called law in books and law in action. Therefore, we shall first analyze the legal rules and then compare these theoretical findings with their practical application. The practice shall be ascertained mainly from the non-legal sources of literal or epigraphic character. The third goal is to utilize an interdisciplinary approach, i.e. to use the outcomes, methods, and procedures from the research fields other than legal sciences to deepen our knowledge of the Roman family. O presente trabalho visa a elaboração de um conceito de autoridade, com o intuíto de explicar a sua importância e precedência à liberdade, a níveis personalísticos e sociais, com enfoque primordial em como as formas de autoridade naturalmente constituídas se expressam através das instituições políticas. Ainda, o trabalho propõe um modelo institucional político que separe essas expressões de autoridade, de forma que evitem a fusão de umas com as outras, característica essa impressa na possibilidade de um estado de exceção, própria de regimes tirânicos ou autoritaristas. / The remain work aims a natural concept of authority, with the purpose of explaining its importance and firstness to freedom, at personal and social levels, with focus into how the naturally constituted forms of authority express themselves through political institutions. Moreover, the work proposes a political institutional model that separates these expressions of authority, so that they avoid merging with one another, a characteristic that is imprinted on the possibility of a state of exception, typical of tyrannical or authoritarian regimes.

Con il presente lavoro ci si pone l’obiettivo scientifico di dotare di una adeguata dogmatica giuridica quella complessa realtà che è costituita dal configurarsi delle relazioni interne al Collegio episcopale, avanzando anche nella comprensione dell’aspetto intrinsecamente comunitario dell’ufficio episcopale quale risultato del rapporto di unitaria successione all’ufficio apostolico di diritto divino. Leggendo l’appartenenza al Collegio di quei membri che lo compongono uti universi attraverso il fondamentale valore ecclesiologico che ha l’inserimento sacramentale di essi nel “simbolismo dei Dodici” (cap. I), si giunge a configurare la compagine di coloro che sono uniti nel ministero episcopale nei termini di “universitas collegialis personarum inaequali iure" (cap. III), appurando - appunto a partire dalla questione terminologica di “collegium” (cap. II) - come sia effettivamente possibile dar vita a riflessioni sempre più pregnanti sul contributo che il pensiero teologico fornisce ai fini della strutturazione anche giuridica dell’empiria interna al carattere normativo della Chiesa. Può risultare così più agevole individuare le relazioni tra quei nuclei di significato che hanno condotto, in ambito cattolico, sia ad una nuova messa a punto e valorizzazione (teorica e pratica) della dottrina della collegialità episcopale in seno al Concilio Vaticano II sia al sempre più vivace prospettarsi di interessanti orizzonti in sede di riflessione canonistica ed ecclesiologica attuale. / The present work has the scientific aim of endowing with an adequate juridical dogmatics the complex reality that is constituted by the configuration of the internal relations of the College of Bishops, advancing also in the understanding of the intrinsically communitarian aspect of the episcopal office as a result of the relationship of unitary succession to the apostolic office of divine law. By interpreting the belonging to the College of those members who make it up uti universi through the fundamental ecclesiological value of their sacramental insertion in the "symbolism of the Twelve" (chapter I), one arrives at configuring the group of those who are united in the episcopal ministry in terms of "universitas collegialis personarum inaequali iure" (chapter III), demonstrating - starting precisely from the terminological question of "collegium" (chapter II) - how it is possible to give rise to increasingly pregnant reflections on the contribution that theological thought provides for the purposes of structuring, also juridically, the empirical internal normative character of the Church. In this way, it will be easier to identify the relationships between those nuclei of meaning that have led, in the Catholic sphere, both to a new development and enhancement (theoretical and practical) of the doctrine of episcopal collegiality within the Second Vatican Council and to the increasingly lively prospect of interesting horizons in the current canonical and ecclesiological reflection.
