Federal com o objetivo de responder ao seguinte problema: A audiência pública,
como realizada pelo Supremo Tribunal Federal, constitui um instrumento processual
de efetivação do princípio do contraditório? Para responder ao mencionado
problema, realizou-se, no primeiro capítulo, uma análise do princípio do
contraditório, sob o paradigma do Estado Democrático de Direito. Analisou-se como
o princípio do contraditório influencia a atividade jurisdicional e como deve ser a
atuação do STF de acordo com a atual concepção desse princípio. No segundo
capítulo, identificou-se a origem da utilização das audiências públicas pelo Poder
Judiciário brasileiro, bem como a existência de previsão legal no ordenamento
jurídico para a realização da audiência pública. Verificou-se a existência de limites
para a utilização do instrumento processual em questão pelo Poder Judiciário. No
terceiro capítulo, procedeu-se à identificação das hipóteses em que o STF realizou
audiências públicas. Analisou-se o procedimento adotado pelo STF para a
realização das audiências públicas, bem como a existência de semelhanças e
diferenças entre as audiências públicas já realizadas pelo STF. Por fim, fez-se uma
análise dos argumentos apresentados nas audiências públicas e das decisões
proferidas pelo STF. Ao final, concluiu-se que as audiências públicas já realizadas
pelo STF constituíram instrumento processual para a efetivação do princípio do
contraditório. / The research analises the public audiences already realized by the Supreme Federal
Court (STF) with the purpose to answer the following question: The public audience,
as realized by the Supreme Federal Court, is a processual instrument to accomplish
the principle of the contradictory? To answer this question, the first chapter analised
the principle of the contradictory in the Democratic State of Law. It analised how the
principle of the contradictory influences the jurisdictional activity and how it must be
developed by the STF in agreement to the current conception of this principle. In the
second chapter, the origin of the use of the public audiences by the Judicial Power
was identified, as well as the existence of a prevision in the legal system to the
realization of a public audience. It was verified that there are limits to the realization
of this processual act by the Judicial Power. In the third chapter, the hypotheses that
the STF realized public audiences were identified. The procedure adopted by the
STF was analised, as weel as the existence of similarities and differences between
the public audiences already realized by the STF. At last, it was made an analysis of
the arguments that were presented in the public audiences and of the decisions
pronouced by the STF. At the end, it concluded that the public audiences realized by
the Supreme Federal Court were processual instruments to accomplish the principle
of the contradictory.

A relevância da atuação colaborativa dos sujeitos do processo para o resultado tempestivo e efetivo da prestação jurisdicional. Análise dos modelos de estruturação processual, em adequação ao Estado Constitucional. A invasão dos valores éticos e a releitura do princípio do contraditório, num viés amplo de participação democrática, em configuração dos pressupostos lógicos da colaboração processual. Os deveres das partes, e seus procuradores, potencializados pela parcialidade envolta e pela relação profissional desenvolvida. A pertinência de um juiz ativo e diligente no ideal cooperativo e os deveres extras daí decorrentes. A probidade processual e sua proteção normativa, através das técnicas repressivas de controle social: a litigância de má-fé e os atos atentatórios à dignidade da justiça. O abuso do processo como desvio das situações legais permissivas e sua contenção, sobretudo através do mote da boa-fé objetiva na restrição do exercício de direitos. A preocupação normativa em encorajar/desencorajar comportamentos e o formato disponível para estimular o cumprimento da norma jurídica. O mote da boa-fé objetiva como caminho a ser seguido pelos operadores do Direito na exegese normativa, através da majoração da responsabilidade dos litigantes. Contextualização através do exame de situações específicas. / The relevance of the collaborative work in the procedural actions and their contribution to improve adjudication results. Analysis of the systems of structuring procedural and adequacy to our Constitution model. The invasion of ethical values and rereading of the fair hearing principle in logical setting of the assumptions of procedural collaboration. The duties of the parties and their attorneys, fueled by partisanship wrapped and professional relationship developed. The relevance of an active and diligent judge on the cooperative ideal and the extra duties resulting from this. The procedural probity and protection rules through the repressive techniques of social control: the bad-faith litigation and contempt to dignity of justice. The abuse of process as a deviation from permissive legality and the reasoning of the objective good-faith to restrict the exercise of rights. The normative concern in encouraging or discouraging behaviors and the available format to encourage compliance with the rules of law. The reasoning of the objective good-faith, additionally, as a path to be followed by operators of the law in the allocation of more responsibility to the litigants. This contextualization through examination of specific situations.

período do Estado Liberal ao Estado Democrático de Direito, objetiva subsidiar uma discussão acerca de um modelo de processo civil que seja adequado ao Estado Democrático de Direito. Através da exposição da evolução histórica das teorias do processo e do contraditório, passa pelos três paradigmas da história do direito: Estado Liberal, Estado Social e Estado Democrático de Direito. O problema de pesquisa está em como formar um processo civil comprometido com as bases paradigmáticas deste Estado Democrático de Direito. O objetivo geral é analisar as principais correntes do pensamento processual civil, com enfoque na forma como se realizava o contraditório, a partir do liberalismo processual e da socialização do processo, bem como traçar as condições de possibilidade para que o processo civil esteja comprometido com o paradigma do Estado Democrático de Direito. A metodologia utilizada é a pesquisa bibliográfica e o método de abordagem o fenomenológico-hermenêutico, considerando o contexto histórico em que os fatos ocorreram. O método de procedimento é o histórico, pois trata dos aspectos do processo civil, com ênfase no contraditório, desde o Estado Liberal até a cultura jurídica dos dias de hoje. Como resultado, tem-se que para se obter a transformação social almejada pelo Estado Democrático de Direito, a aplicação e interpretação da norma jurídica, em conformidade com a Constituição de 1988, deve ser realizada em respeito aos Princípios Constitucionais, com destaque para o Princípio do Contraditório. Esta pesquisa conclui que para o Princípio do Contraditório ser plenamente concretizado, é necessário que o juiz ouça o cidadão, garantindo-lhe um exercício de direito de defesa muito mais amplo que uma mera formalidade a ser
cumprida. O contraditório deve ser enfrentado como um instituto essencial de auxílio na aproximação do processo com a verdade material e, consequentemente, com o decidir justo no caso concreto, exigindo um constante diálogo entre todos os envolvidos no processo, que devem estar em posição hierárquica similar, sendo plenamente concretizado no ordenamento, para sua eficácia social, obtida mediante a participação direta de todos os sujeitos do processo. / This research approaches the Principle of Contradictory and in analyzing it during the period from the Liberal State to the Democratic State of Law, aims to base a discussion regarding a civil process model that is suited to Democratic State of Law. Through exposure the historical evolution of theories about the process and the contradictory, passes through the three paradigms of the Law History: the Liberal State, Social State and Democratic State. The research problem is how to form civil proceedings committed to the paradigmatic foundations of this Democratic State of Law. The overall goal is analyze the main currents of civil procedure thought, focusing on how they accomplished the contradictory from the procedural liberalism and the socialization of the case, as well as trace the possibility conditions so that the process be committed to the paradigm of Democratic State of Law. The methodology used is the literature research and approach method is the phenomenologicalhermeneutic, considering the historical context in which the events occurred. The procedure method is historical because comes to aspects of civil procedure, with emphasis on the contradictory, since the Liberal State to the legal culture of today. As a result, we have that to obtain the social transformation desired by Democratic State of Law, the application and interpretation of legal standard, according to the 1988 Constitution, should be conducted in respect of Constitutional principles, especially the principle of Contradictory. This research concludes that to the Principle of Contradictory be fully achieved, it’s necessary that the judge listen the citizen, guaranteeing an exercise of the right of defense much wider than a mere formality to be fulfilled. The contradictory must be faced as an essential aid institute in approaching the case with the material truth and consequently the righteous decision in the specific case, requiring a constant dialogue between all involved in the process, which should be in a similar hierarchical position, being fully achieved in ordainment, to its social efficiency, obtained by direct participation of all subjects in the process.

O objetivo do presente trabalho é demonstrar que uma releitura dos princípios do contraditório e do dever de motivar as decisões judiciais, sob a ótica da maior participação dos jurisdicionados, tem o condão de alcançar a esperada legitimidade democrática da atuação judicial. Para tanto, antes de adentrar ao cerne da questão, buscou-se analisar ordenamentos de tradições jurídicas distintas, civil law e common law, a fim de delinear as perspectivas que referidos sistemas enxergavam o dever de motivar a decisão judicial. O estudo convergiu para o momento atual do direito, iniciado na segunda metade do séc. XX com o movimento de constitucionalização e, consequentemente, judicialização dos direitos. Uma das maiores críticas ao momento vivido é o amplo espaço interpretativo do juiz, abrindo as portas para a discricionariedade, o que foi combatido e rechaçado tendo como parâmetro as origens do instituto. Passado referido ponto, discutiu-se sobre as evoluções e novas tendências que circundam os princípios do contraditório e do dever de motivar, cuja finalidade foi demonstrar a estreita conexão entre as normas. Conclusão inexorável foi que ambos compõem a base das garantias processuais que legitimam a atuação judicial democrática. Por fim, procurou-se tecer alguns comentários sobre os equívocos cometidos na interpretação do princípio do convencimento judicial, e como essa perspectiva pode ser alterada com as diretivas presentes no projeto do novo Código de Processo Civil, haja vista que suas previsões abraçam boa parte das ideias debatidas no presente trabalho. / This work aims to demonstrate the repercussion brought up by a rereading of the adversarial rule and the reasoning of the judicial decisions rule, from the perspective of the greater participation of the citizens, and its effects to achieve the expected democratic legitimacy of the judicial act. In order to reach the main point of this paper, the methodology adopted includes an analysis about legal systems of different traditions, civil law and common law, with the objective to outline the perspectives that those systems had seen the duty to reasoning a judicial decision. In this context, the present study converged to the current Law perspectives, started in the second half of the 20th century with the movement of a constitutionalisation and, therefore, an increasing judicialization of rights. One of the main criticism of the current moment, is the broad space for judicial interpretation, opening the doors for discretion, which was opposed and repelled, in light of the parameters leaded by the origins of the institute. After this aspect, it was discussed about the new developments and trends that surround the adversarial rule and the reasoning of the judicial decisions rule, all in order to prove the close connection between such rules. The conclusion demonstrated that both standards compose the basis of the procedural guarantees that legitimating the democratic judicial act. Finally, comments were made about the equivocal understanding of the motivated free conviction rule, and how this view can be changed with the perspectives in the bill of law that represents the new Civil Procedure Code, considering that their provisions enfold a great part of the ideas of this paper.
