El trabajo de investigación aborda una perspectiva multidisciplinaria que se enfoca en generar una herramienta de comunicación, abordando temas importantes como son el gobierno móvil, la tecnología y el Estado. Gobierno móvil es un concepto que ha tomado fuerza en muchos países en desarrollo, muchos de estos descritos en casos de éxito en países donde el uso de este tipo de plataformas aportó en el desarrollo de políticas de Estado, siendo una herramienta versátil y útil en diversos campos. Luego de un análisis de la situación actual de los Pueblos Indígenas y el proceso de Consulta Previa en el Perú, nuestro trabajo de investigación propone el uso de aplicaciones móviles que colaboren con las políticas del Estado, lo que está alineado al Plan Bicentenario de nuestro país. Así, de esta manera contribuir con un aporte al Estado en la implementación de Gobierno Móvil como una herramienta que refuerza la inclusión, posibilitando el acceso del ciudadano de todas partes del Perú a los programas y planes de apoyo social a cargo del Estado. / The research work addresses a multidisciplinary perspective that focuses on generating a communication tool, addressing important issues such as mobile government, technology and the State. Mobile government is a concept that has taken hold in many developing countries, many of these described in successful cases in countries where the use of this type of platforms contributed to the development of State policies, being a versatile and useful tool in various fields After an analysis of the current situation of Indigenous Peoples and the process of Prior Consultation in Peru, our research work proposes the use of mobile applications that collaborate with State policies, which is aligned with the Bicentennial Plan of our country . Thus, in this way contribute with a contribution to the State in the implementation of Mobile Government as a tool that reinforces the inclusion, making possible the access of the citizen of all parts of Peru to the programs and social support plans in charge of the State. / Trabajo de investigación

Struggles Over Governance of Oil and Gas Projects in the Peruvian Amazon

This dissertation examines the shifting and multi-scalar governance of oil and gas projects in Peruvian Amazon. Using cases studies of oil extraction in blocks 1AB (192), 8 in Loreto (2006 to 2015), and the Environmental Impact Assessment (EIA) process for the expansion of the Camisea gas project in block 88 in Cusco, this dissertation explores how environmental decision-making processes of oil and gas projects are structured and enacted. In doing so, this study sheds light on the shifting interactions, negotiations, struggles and (at times) open conflicts between actors that define why, how and where hydrocarbon projects take place in the Amazon. Recognizing the variety of actors, I organize my analysis around government institutions, indigenous mobilizations, environmental assessments and the economic distribution of revenues from oil and gas projects. From my analysis I argue that resource extraction is changing substantially the relationship between the government and the indigenous peoples in the Peruvian Amazon. These changes involve profound changes in indigenous rights and the creation of new institutions and capacities in the state to address the social-environmental effects of extractive industries. The surge of social-environmental conflicts and the influence of international finance institutions have prompted the Peruvian government to reform the institutional framework regulating resource extraction. This reforms are taking place amid the globalization of indigenous rights, discourses, and laws (such as the Prior Consultation Law) granting special rights to indigenous peoples. However, power-knowledge asymmetries in the decision-making processes (such as the environmental assessments) tend to increase the sense of mistrust among the local populations, resulting in increasing social-environmental conflicts. In addition, the uneven distribution of benefits from resource extraction is creating regional disparities, increasing the dependency of some regions on resource extraction. An examination of the implementation of the Environmental Impact Assessment process for the expansion of the Camisea project in block 88 exposes unresolved practices of representation and citizenship of the indigenous peoples in voluntary isolation. However, overall, Amazonian indigenous people’s struggles are shifting the traditional national, social, and political life. They are ethnic minorities and citizens struggling for their rights to participate in decision-making processes and in the distribution of economic benefits from extraction, both particularity and equality.

Previous consultation to rethink the constitutional theory in Peru / La consulta previa para repensar la teoría constitucional en el Perú

It’s not possible to forget the indigenous and native communities as a key element in the Peruvian  constitutional  structure.  Previous consultation is a reflection of this. However,this has not always been so. For a long time,the economic and cultural hegemonies that influenced the constitutional conceptions putaside the fundamental diversity and dialogue.In this article, the author alludes to Low- intensity Constitutionalism which marked distance between political events and social conflict. For the author, the emergence of prior consultation is a sign of historical grievance and that in this context, a constitutional theory that does not put aside cultural diversity is necessary, since political representation is legitimized when the State ensures the rightsof all citizens. / No es posible olvidar a las comunidades andinas u originarias en la estructura constitucional peruana. La consulta previa es reflejode ello. Sin embargo, esto no siempre ha sidoasí. Durante mucho tiempo, las hegemonías económicas  y culturales  que  influyeron  en las concepciones constitucionales dejaron delado la diversidad y el diálogo fundamental.En el presente artículo, el autor hace alusión al Constitucionalismo de Baja Intensidad, que marcó distancia entre los acontecimientos políticos y el conflicto social. Para el autor, la aparición de la consulta previa es un signo de reivindicación histórica y que, en dicho contexto, es necesaria una teoría constitucional que no deje de lado la diversidad cultural, puesto que la representación política se legitima cuando el Estado vela por los derechos detodos los ciudadanos.

The process of retrenchment in a public institution with reference to the independent electoral commission

The dissertation examines the process of retrenchment in a public institution with reference to the execution of such a process by the Independent Electoral Commission (IEC). The aim is to establish whether or not the retrenchment was substantively and procedurally fair as required by legislation. Notwithstanding the fact that the staff may have been disadvantaged by the short retrenchment notice (the staff did not have representation prior to the announcement, and the swiftness of the process did not, under the circumstances, provide the staff with enough time to comprehensively apply their mind to the underlying issues), the dissertation finds that the retrenchments had been substantively fair given the fact that the IEC could not retain all staff because of budgetary constraints. The dissertation also finds that the process had been procedurally fair in accordance with section 189 of the Labour Relations Act, 66 of 1995. / Public Adminstration & Development Studies / M.A. (Public Administration)
