Asistovaný styk rodičů s dětmi v České republice. / Assisted contact parents with children in the Czech Republic

The diploma thesis titled Assisted contact parents with children in the Czech Republic focuses on the current description of the service, which aims to promote relations in the divorcing family and the common safe and nonconflict contact between parents and child. The aim of the diploma thesis is to describe the current form of assisted contact parents with children in Czech organizations. The work is mentioned in the foreign organization, from which this practice has spread to the Czech Republic. The thesis is divided into a theoretical and practical part, which maps the assisted contact of parents with children. The theoretical part deals with the impact of family breakdown on the family, the description of assisted parenting with children. Part is dedicated to foreign organizations providing assisted parenting with children. The last chapter is then mapped by Czech organizations. The practical part shows the results of structured interviews with organizations. The interview was divided into four areas. During the research, it was found that the current state of assisted parenting with children is used by parents rather after the recommendation of the body for social and legal protection of children or the court. Diplomová práce se zaměřuje na problematiku pohlavního zneužívání dětí v České republice. Specifikuje věkovou skupinu dětí do tří let, přičemž se zaměřuje na incidenci a prevalenci těchto případů v české společnosti. Pozornost je upřena zejména na charakteristiku tohoto fenoménu ze všech jeho aspektů, kterými jsou společenské vnímání, atributy pohlavního zneužívání a domácího násilí obecně, legislativní problematika k tématu pohlavního zneužívání nezletilých, financování pomoci poskytované pohlavně zneužitým dětem. Nadále je specifikovány diagnostické metody využívané v České republice k detekci pohlavního v komparaci s alternativními přístupy diagnostiky využívanými v zahraničí, které zaznamenávají úspěch zejména v nejnižších věkových kategoriích. Práce se věnuje také problematice orgánu sociálně-právní ochrany dětí a jejího poskytování v souvislosti s pohlavním zneužíváním. 8 Abstract In my thesis, I study the topic of social work with an endangered child. I was trying to bring up the subject of those children who find themselves in a dangerous situation for them and also how situations can be handled. I describe what constitutes an endangered child and what groups they divide into. I also deal with the issue of abused children and also with the CAN syndrome, which is very important for me. I also mention here the disruption of the attachement, which is not so often taken into account by us and it is important for me to talk about it and know about it. A big chapter in my thesis is the subject of the Child at Risk System, which contains facilities for children requiring immediate assistance, child welfare facilities, specialist counselling facilities, social educational activities, facilities for children in need of immediate assistance, as well as education camps for children. I list the services that are provided to children and families at risk. At the end of the theoretical section, I focus more closely on the topic of family surrogacy and institutional care, which I have chosen to process the practical part. For the empirical part a qualitative strategy of research was chosen, interview method. The respondents included employees of the department of socio-legal protection of children. Based on the results of the research, the thesis describes functioning of the cooperation of both organizations.

The theoretical part of thesis defines the educational process and specifics of education of children with behaving disorders. The qualitative research has used to achievement a goal. There have methods of observation and interview used in research. Knowledges and results of research can be exploited to improvement of quality of the educational process in practice.

Le paroxysme atteint par la diffusion incontrôlée durant les années 1990 du phénomène des enfants soldats a obligé la communauté internationale à renforcer la protection des enfants et à instituer des garanties supplémentaires à l’égard des enfants touchés par les conflits armés. Les zones d’instabilité politique, les conflits, ainsi que l'impunité quasi généralisée en matière de violations graves des droits de l’homme ont été les principales sources de la montée en puissance du phénomène des enfants soldats. L’objectif qui consistait à mettre fin à l’implication illégale d'enfants dans les conflits armés a nécessité une coopération étroite entre tous les États concernés cependant que divers problèmes d’ordre juridique n’ont pas tardé à faire leur apparition. Par ailleurs, la diversité des ordres juridiques et la variété des approches doctrinales quant à la définition de la notion d’« enfant » ont rendu difficile une approche consensuelle. L’institution d'une responsabilité pénale internationale pour le recrutement des enfants, érigé en crime de guerre, n’était qu’un début. La question de la justice dans les pays sortis des conflits est toujours d'actualité et l’adoption d’autres formes de justice s’avère indispensable dans le processus de réconciliation et de réinsertion des enfants. La responsabilité pénale des enfants soldats est examinée sous son double aspect victime / bourreau, en abordant certaines affaires emblématiques. / The uncontrolled spread of the phenomenon of child soldiers culminated in such a point during the 1990s that the international community was forced to strengthen the protection of children by introducing additional safeguards for children affected by armed conflict. Some of the main explanations for the rise of the phenomenon of child soldiers have been: areas of political instability, conflicts and almost universal impunity in cases of serious human rights violations. The objective of putting an end to the illegal involvement of children in armed conflict required close cooperation between all states concerned. Yet, legal complications did not take long to appear. Moreover, the diversity of legal systems and the variety of doctrinal approaches to the definition of the term "child" made a consensual approach difficult. The international criminalization of recruiting children, defined as a war crime, was just the beginning. The issue of justice in countries emerging from conflict is still relevant today and the adoption of other forms of justice is essential in the process of reconciliation and reintegration of former child soldiers. The criminal accountability of child soldiers is examined in its dual aspect of victim/executioner, addressing some emblematic cases.

Orientador: Victor Hugo de Almeida / Resumo: Apesar do esforço das normativas internacionais, da Constituição Federal e da legislação brasileira para a erradicação do trabalho infantil, há, ainda, 1,714 milhões de crianças e adolescentes trabalhando em situação irregular nos setores mais diversos da atividade econômica nacional. Crianças e adolescentes têm obtido autorizações judiciais para trabalhar antes da idade permitida por lei e, desse modo, o Estado-Juiz, detentor do dever constitucional de conferir proteção integral à infância e adolescência e a zelar prioritariamente pelo seu bem-estar, tem chancelado que sejam submetidos a condições degradantes de vida e de trabalho, em prejuízo de seus desenvolvimentos físico, psicológico, educacional e social, perdendo o direito de viver a fase imprescindível da infância, na qual se deve preocupar-se apenas com o brincar e o estudar, restando comprometidas as chances de uma vida adulta saudável e capaz de assegurar a competitividade do mercado de trabalho. Dessa forma, o ciclo vicioso da pobreza se perpetua, a mão de obra infantil se torna uma constante e o trabalho não traz dignidade às pessoas por não conseguir emancipá-las. Children and adolescents have been granted court permits to work before the age allowed by law, and thus the Judge-State, which has the constitutional duty to provide full protection to children and adolescents and to give priority to their well-being, has allowed that they have been subjected to degrading conditions of life and work, to the detriment of their physical, psychological, educational and social development, losing the right to live the indispensable phase of childhood, in which one should only be concerned with playing and studying, to loosing the chances of a healthy adult life capable of ensuring the competitiveness of the labour market. Posuzování funkčnosti rodiny v Jihočeském kraji / Assessing of Functionality of Family in South Bohemia Region

Assessing the functionality of family is a very current topic. The last survey of functionality of family according to Questionnaire of functionality of family was done by professor Dunovský in the 80th of the 20th century. The aim of this study is to determine what social workers in the South Bohemian region assess the functionality of the family according to. Partial research questions aim to answer the main research question: Which characteristics does a functional family have according to social workers? This study deals with the question whether the Questionnaire of functionality is still up to date or outdated. The study deals only with a few fields of the questionnaire. The research was qualitative; its main technique was a semi standardized interview. The structure of the interview took a form of broadly worded questions that were aimed at understanding the problem. The survey shows that the Questionnaire of functionality by Dunovský cannot be used in assessing the functionality of family without detailed history of a family, which will reflect particular variations in individual families on the basis of prolonged inquiry in the family. The categories of the Questionnaire themselves need to be updated with regard to the shift of social perception of family and the shift of social-economic situation of families in society.

The author of this diploma thesis focuses on the issues of cooperation of the curator for children and youngsters with school institutions (especially schools). The aim of this cooperation and its subsequent description is to elaborate a multiple case study of selected students whose issues were so serious that the help of a curator was needed. The theoretical part of the thesis is focused on the behaviour of students that is so serious that it goes beyond the scope of regular pedagogical approaches conducted by the school. The system of institutional help, often at hand to schools in such situations, is described with respect to the function of the curator for youngsters. The practical part of the thesis provides the reader with a multiple case study of several selected students whose issues were so severe that the cooperation of a curator was required. A qualitative research was used to elaborate the study and the results were obtained by semi-structured interviews with the students' parents, teachers, specialized pedagogical centre workers as well as the students themselves.
