The evolution of data protection and privacy in the public security context : an institutional analysis of three EU data retention and access regimes

Since nearly two decades threats to public security through events such as 9/11, the Madrid (2004) and London (2005) bombings and more recently the Paris attacks (2015) resulted in the adoption of a plethora of national and EU measures aiming at fighting terrorism and serious crime. In addition, the Snowden revelations brought the privacy and data protection implications of these public security measures into the spotlight. In this highly contentious context, three EU data retention and access measures have been introduced for the purpose of fighting serious crime and terrorism: The Data Retention Directive (DRD), the EU-US PNR Agreement and the EU-US SWIFT Agreement. All three regimes went through several revisions (SWIFT, PNR) or have been annulled (DRD) exemplifying the difficulty of determining how privacy and data protection ought to be protected in the context of public security. The trigger for this research is to understand the underlying causes of these difficulties by examining the problem from different angles. The thesis applies the theory of 'New Institutionalism' (NI) which allows both a political and legal analysis of privacy and data protection in the public security context. According to NI, 'institutions' are defined as the operational framework in which actors interact and they steer the behaviours of the latter in the policy-making cycle. By focusing on the three data retention and access regimes, the aim of this thesis is to examine how the EU 'institutional framework' shapes data protection and privacy in regard to data retention and access measures in the public security context. Answering this research question the thesis puts forward three main hypotheses: (i) privacy and data protection in the Area of Freedom, Security and Justice (AFSJ) is an institutional framework in transition where historic and new features determine how Articles 7 and 8 of the Charter of Fundamental Rights of the European Union (CFREU) are shaped; (ii) policy outcomes on Articles 7 and 8 CFREU are influenced by actors' strategic preferences pursued in the legislation-making process; and (iii) privacy and data protection are framed by the evolution of the Court of Justice of the European Union (CJEU) from a 'legal basis arbiter' to a political actor in its own right as a result of the constitutional changes brought by the Lisbon Treaty.

L’exigence de l’ordre public interne et internationale justifie une limitation du droit fondamental à l’asile. Le Code de l’entrée et du séjour des étrangers et du droit d’asile, la convention de Genève du 28 juillet 1951et la législation européenne dessinent les contours de cette clause d’ordre public. Pourtant, le candidat à l’asile ou le bénéficiaire d’une protection peuvent craindre d’être persécutés en cas de retour dans leur pays d’origine. Comment dès lors comprendre un refus de protection ou le retrait d’un statut protecteur et la mise en œuvre de cette clause ? / The requirement of the internal and international public order justifies a limitation of the basic right to asylum. The Code of the entry and the stay from abroad and the right of asylum, the Geneva Convention of July 28th, 1951 and the EU law draw contours of this clause of public order. However, the candidate with asylum or the recipient of a protection can fear to be persecuted in the event of return in their country of origin. How consequently to understand a refusal of protection or withdrawal of a protective statute and the implementation of this clause?

The Preservation and Stewardship of Archaeological Sites in the Boreal Forest: A Public Issues Approach

Archaeological sites in the boreal forest are facing threats due to urban development, resource exploitation, vandalism, and infrastructure development, among others. In the context of archaeological site preservation as a public issue, I examine the perspectives of various publics towards the preservation and stewardship of archaeological sites in the boreal forest. Through a series of interviews, I examine the opinions of three publics involved in the archaeological process in Ontario: developers, First Nations, and archaeologists. I outline the participants??? opinions on the meaning and goals of preservation, the preservation of non-physical aspects of sites, such as oral history and site spirituality, preservation methods, site ownership and access, land use and development, involvement in the archaeological process, and funding. I also identify common themes which presented themselves throughout the interview process, such as the importance of education; the necessity for communication, collaboration, and cooperation; the problem of artifact curation; the perceived lack of genuine government involvement; and the publication of cultural resource management (CRM) archaeology???s ???grey literature???. Finally, I present suggestions on the preservation of archaeological sites which take into account the participants??? perspectives uncovered during the interview process. I conclude that preserving archaeological sites can be done using three techniques: education; communication, collaboration, and compromise; and using one of three general methods to preserve sites and artifacts. Education can be used to create public issues, teach people about the importance of archaeology and archaeological sites, and teach the involved publics about the goals and methods of CRM archaeology in Ontario. Encouraging communication, collaboration, and compromise between the interested publics includes the perspectives of formerly neglected parties, builds relationships between publics, and creates newly vested interests in site preservation. Three methods to preserve archaeological sites include site stabilization and monitoring, allowing sites to decay naturally, and excavating sites and curating the artifacts and oral histories for the long-term.

L’avenir du droit de l’enfance délinquante / The future of the French juvenile justice system

Le droit de l'enfance délinquante est principalement régi par les dispositions de l'ordonnance du 2 février 1945 relative à l'enfance délinquante. La philosophie associée à la version initiale de cette ordonnance est le primat donné au relèvement éducatif du mineur, auteur d'infraction, plutôt qu'à la seule sanction de l'acte qu'il a commis. Cependant, celle-ci a été modifiée à de multiples reprises. En sus d'ébrécher l'esprit initial du texte de 1945, les nombreuses modifications législatives ont profondément altéré la lisibilité et la cohérence du droit pénal des mineurs. Avant de formuler des voies de réforme de ce droit, la thèse propose d'optimiser le cadre supralégislatif du droit de l'enfance délinquante. En effet, ses faiblesses en ont désactivé le rôle de garde-fou de sorte que le législateur a pu sans difficulté réagencer les principes initiaux de la justice pénale des mineurs / The French juvenile justice system isbased on a speciallawwhichwaswrittenin 1945. We propose some solutions in order to reinforcethesesupremnorms. In the other hand, wepresentsome propositions and arguments about the future French juvenile justice system reform.

Les parajuristes et les étudiants en droit comme vecteurs d'accès à la justice : proposition d'une nouvelle approche conciliant innovation et protection du public

Cette recherche vise à étudier le rôle que peuvent jouer les parajuristes et les étudiants en droit dans le processus d'accès à la justice des citoyens. Face à la crise d'accès à la justice que nous constatons, il nous apparaît pertinent d'évaluer quelles contributions peuvent fournir d'autres détenteurs de connaissances juridiques, comme les parajuristes et les étudiants en droit, dans le processus d'accès à la justice des citoyens, en complément des professionnels du droit que sont les notaires et les avocats. Afin de répondre à cette question, nous comparons la situation québécoise avec deux ressorts qui ont réformé leur système professionnel juridique afin de laisser une plus grande place aux parajuristes ou aux étudiants en droit, soit la province d'Ontario, au Canada, et l'État de Washington, aux États-Unis. Nous étudions ces deux initiatives et évaluons les impacts qu'ont eus celles-ci à la fois sur l'accès à la justice et sur la protection du public. Nous concluons qu’il serait souhaitable de s'inspirer de ces initiatives dans le contexte particulier du Québec. Nous tentons de postuler quel pourrait être l'encadrement réglementaire qui s'appliquerait, en tentant de concilier l'accès à la justice et la protection du public, assurée par les monopoles professionnels. / This research is aimed at studying the role that paralegals and law students can play in the access to justice process for the general population. Considering the access to justice crisis facing our judicial system, it seems appropriate to evaluate which contribution other people with some law training, like paralegals and law students, can have in the access to justice process, in addition with the other legal professionals, namely lawyers and notaries, in Québec. To answer that question, we compare the situation in the province of Québec with two jurisdictions that reformed their legal professional system and allowed for paralegals or law students to play a greater role in the delivery of legal services. Those jurisdictions are the province of Ontario, in Canada, and the State of Washington, in the United States of America. We study these two initiatives and evaluate the impacts they had on access to justice and on the protection of the public. We conclude that it would be a good idea to import some of those ideas in Québec’s particular context. We try to determine what a new regulatory model could look like, while trying to reconcile access to justice and public protection imperatives and considering the existing professional monopolies.
