Previous issue date: 2014-02-19 / The included study is intended to investigate the functions and purposes of the penalty from a legal and ethnographic perspective, with support , especially in the work of René Girard. The work begins with a conceptual distinction between function and purpose that will determine the plans in place that will develop the arguments used. Passes to the critical analysis of preventive theories, aiming to demystify the varied discourses based on prevention. Next, we analyze two possible alternatives to preventive theories, namely, the retributive theories and the Ferrajoli theory, also pointing out its flaws and inconsistencies. From that deconstruction can spend to build a grounded in archaeological research on the origins of violence and profiles, as well as strategies designed to manage it proposed. In this step, it first explores the genealogy of violence and the outbreak of mimetic crisis. Then preventive methods (rigidity of customs, war, sacrifice) and curative (private revenge and judicial pen) management of violence, culminating with the statement that the function of the sentence coincides with the completion of vengeance. In the last chapter, it is stated, connected with the function, the purpose of punishment, which is the realization of revenge avoiding the outbreak of mimetic crisis and is outlined in general terms how this purpose can be achieved / O incluso estudo tem por intenção investigar as funções e finalidades da pena a partir de uma perspectiva jurídica e etnográfica, com apoio, sobretudo, na obra de René Girard. O trabalho inicia-se com uma distinção conceitual entre função e finalidade, que será determinante para situar os planos em que se desenvolverão os argumentos utilizados. Passa-se à análise crítica das teorias preventivas, com o objetivo desmistificar os variados discursos baseados na prevenção. A seguir, analisam-se duas possíveis alternativas às teorias preventivas, quais sejam, as teorias retributivas e a teoria garantista de concebida Ferrajoli, apontando-se também seus defeitos e inconsistências. A partir dessa desconstrução é possível passar a construir uma proposta alicerçada na investigação arqueológica sobre as origens e perfis da violência, bem como das estratégias concebidas para geri-la. Nesse passo, exploram-se primeiro, a genealogia da violência e a eclosão da crise mimética. Depois, os métodos preventivos (rigidez dos costumes, guerra, sacrifício) e curativos (vingança privada e pena judicial) de gestão da violência, culminando-se com a demonstração de que a função da pena coincide com a realização da vingança. No último capítulo, estabelece-se, conectada com a função, a finalidade da pena, que é a realização da vingança evitando-se a deflagração da crise mimética e delineia-se em traços gerais como essa finalidade pode ser alcançada

Unconditional sentence of imprisonment from perspective of theory and practice Dissertation JUDr. Jiří Pleva Abstract Author tried to express his opinions to contemporary theory and practice concerning the unconditional sentence of imprisonment and provide some impulses to an appropriate change in his thesis. The basic motto of the introduced discourse was the statement that the prime sign of the imposed sentence is the loss (evil) caused to the criminal. Author wanted to prove the ineffectiveness of the imposed sentences in the cases when the subsequent execution of the punishments will not be for the criminal appreciable enough, whereas the factual appreciability of the punishment is only ad hoc to be stated regarding to the situation of the particular offender. Generally extended statement was disproved, that the unconditional sentence of imprisonment was always the strictest form of punishment, by the chosen cases from the court room and also from the prison practice. In thesis author tried to emphasize the importance of all basic purposes of the punishment, until now modified in § 23 of the Criminal code (1961) which cannot be left out at considerations either about imposing sentence or after the coming into force of the new Criminal code (2009). O presente trabalho tem como objetivo a análise da ressocialização na execução penal, com especial destaque ao ordenamento jurídico brasileiro. Partindo de uma concepção legitimadora do sistema penal, é feito o estudo das posições fundamentais sobre a finalidade da pena desenvolvidas pelas doutrinas filosófica e penal, com ênfase à finalidade de ressocialização. Seguindo o estudo, são expostos diversos argumentos contra a idéia de ressocialização como única finalidade da pena e também contra sua viabilidade como finalidade da pena no âmbito da execução penal. Por fim, analisa-se o ideal ressocializador nos institutos da Lei de Execução Penal brasileira. São estudados os institutos da execução penal tradicionalmente ligados à idéia de ressocialização e também aqueles cujo enfoque de aplicação muda quando desprezamos tal idéia. Conclui-se o trabalho sustentando-se, em suma, que o ideal ressocializador da execução penal é incompatível com qualquer ordenamento jurídico democrático. / This study\'s goal is to analyze resocialization in corrections, with special emphasis on the Brazilian legal system. Beginning with a legitimating concept of the criminal system, a survey is conducted on the ground theories concerning the purpose of punishment as developed by the philosophical and criminal doctrines, with emphasis on the purpose of resocialization. Thereafter, a number of arguments are exposed that are against the idea of resocialization as the sole finality of punishment and also against its viability as one of the goals of punishment in corrections. Last, the resocialization ideal presented by the Brazilian corrections law is appraised. This appraisal encompasses correctional concepts traditionally related to the idea of resocialization as well as concepts whose application focus changes when one dismisses that notion. The conclusion argues, in short, that the correctional ideal of resocialization is incompatible with any democratic legal system.
