Como se não bastasse, os caminhos para a sua efetivação real encontram-se obstruídos por interesses alheios às idéias de igualdade, cidadania e justiça social suscitadas pela própria fórmula dos direitos humanos. Tais interesses, referentes principalmente aos imperativos econômicos e técnicos de uma sociedade globalizada, invalidariam a defesa desses direitos? Por outro lado, tal crítica não acertaria o alvo quando dirigida aos seus defensores intransigentes? O objetivo deste trabalho é investigar quais seriam as possíveis causas para as dificuldades de se equacionar, nas sociedades modernas, a instância de direitos fundamentais e a legitimação do poder do Estado que, muitas vezes, aparece contrário ao significado da própria instituição histórica desses direitos. Através da discussão sobre os seus fundamentos, pretendemos entender qual o sentido das transformações ocorridas na representação do indivíduo e da sociedade que permitiram a emergência e também a recusa dos direitos humanos / Abstract: In the present time, human rights seem to be more and more recurring in political discussions. Furthermore, the ways for their real effectuation are obstructed by interests foreign to the ideas of equality, citizenship and social justice, suscitated by the very formulae of human rights. Would these interests, referring mainly to economic and technical imperatives of a globalized society, invalidate the defense of human rights? By the other way, would not this critique hit the target when addressed to the intransigent defenders of the rights? The aim of this work is to investigate what could be the possible causes for the difficulties of equating, in modern societies, the instance of fundamental rights and the legitimization of the State nation's power, which many times seems against to the signification of the historical institution of these rights. Through the discussion about the grounds of the rights, we intend to understand what is the meaning of the transformations occurred in the individual and society representations that permitted the emergence and also the refusal of human rights / Mestre

Orientador: Neide Aparecida de Souza Lehfeld / Banca: Elizabeth Regina Negri Barbosa / Banca: Juvencio Borges da Silva / Banca: Juventino de Castro Aguado / Banca: Cirlene Aparecida Hilário da Silva Oliveira / Resumo: Esta tese tem como objetivo relatar uma investigação acerca das percepções dos juízes de direito, dos promotores de justiça e dos assistentes sociais quanto às contribuições efetivas do Serviço Social no âmbito do judiciário, sobretudo, nas demandas das famílias na relação com a justiça. O contexto do estudo se insere na trajetória histórica do Poder Judiciário, a inserção do Serviço Social no Judiciário mineiro e a família nas ações judiciais. Foram estabelecidas categorias para a análise de conteúdo, selecionadas entre dois princípios do Código de Ética dos assistentes sociais, sendo o primeiro, a ampliação e consolidação da cidadania através dos direitos civis, sociais e políticos, e o segundo, o compromisso com a qualidade e competência profissional na oferta de serviços. Trata-se de um estudo qualitativo, através da abordagem de pesquisa documental, bibliográfica e de campo. O instrumento da coleta de dados utilizado foi à aplicação de formulários com questões abertas e fechadas. O universo da pesquisa compreende três comarcas do Sul de Minas Gerais, a saber, Borda da Mata, Monte Sião e Ouro Fino. Os participantes da pesquisa foram os juízes de direito, os promotores e os assistentes sociais que inscrevem seu trabalho profissional nas Varas de Família destas comarcas. A análise dos depoimentos revelou as contribuições significativas do trabalho do assistente social neste espaço sócio-ocupacional, sobretudo, em questões que envolvem o acesso aos direitos sociais / Abstract: This thesis aims to present a research about the perceptions of judges, the prosecutors and social workers regarding the effective contributions of Social Services within the judiciary, especially the demands of families in relation to justice. This is a qualitative study, by dealing with bibliographical and documentary research. The data collection instrument used was the application forms with open and closed questions. The research includes three counties in southern Minas Gerais. Survey participants were the judges, prosecutors and social workers who enroll their professional work in family courts of these counties. Through content analysis of the interviews revealed the significant contributions of the work of social workers in the socio-occupational. This is a qualitative study, by dealing with bibliographical and documentary research. The data collection instrument used was the application forms with open and closed questions.
