Teismo sprendimo motyvacija (pagal Lietuvos ir užsienio valstybių teismų praktiką) / Motivation of a court judgment (based on lithuanian and foreign countries‘ case law)

Šio magistro darbo objektas – teismo sprendimo motyvaciją reglamentuojančių norminių bei teisės doktrinos šaltinių analizė, remiantis Lietuvos ir kai kurių užsienio valstybių teismo sprendimų motyvuojamųjų dalių pavyzdžiais. Lietuvos Respublikos civilinio proceso kodeksas įtvirtina teismų pareigą motyvuoti priimamus sprendimus, tačiau pasitaiko atvejų, kai ši pareiga nėra tinkamai įgyvendinama, t.y. sprendimai apskritai nemotyvuojami arba motyvuojami netinkamai. Siekiant atskleisti teismo sprendimo motyvavimo svarbą, magistro darbo pirmojoje dalyje yra analizuojamos teismo sprendimų rūšys bei pati teismo sprendimo struktūra ir taip pat motyvuojamosios dalies vieta ir reikšmė teismo sprendime. Antrojoje magistro darbo dalyje, naudojant istorinį tyrimo metodą, yra analizuojama teismo sprendimo motyvacijos istorinė raida bei kaita Lietuvoje. Pabrėžtina, kad visais analizuojamais istoriniais laikotarpiais teisėjams egzistavo reikalavimas pagrįsti savo priimamus sprendimus, tačiau reikalavimai motyvacijai, jos turiniui bei pačiam sprendimo priėmimui ir paskelbimui nebuvo vienodi. Naudojant aprašomąjį, sisteminį, loginį bei teisės aktų analizės metodus, analizuojama įvairių pakopų teismų (pirmosios, apeliacinės instancijos bei kasacijos) sprendimų motyvavimo ypatumai. Šios analizės metu prieinama prie išvados, kad kiekvienos grandies teismams neprivaloma naudotis vienoda teismo sprendimo argumentavimo metodika bei išsamumu. [toliau žr. visą tekstą] / Motivation of a court judgment (based on Lithuanian and foreign countries‘ Case Law) The subject-matter of this master thesis is the analysis of regulating rules of law and the sources of law doctrine, with reference to examples of Lithuanian and some other foreign countries‘ case law. The Code of Civil Procedure of Lithuanian Republic indicates the duty of the courts to motivate their judgments. However, this duty is not always properly embodied i.e. the decisions sometimes are not argumented or they are argumented in not the most suitable way. Seeking to discover the importance of the reasoning of court judgment, the first part of this master thesis contains analysis of types and structure of court judgments and also the significance and place of motivating part in court judgment. The second part of master thesis contains the research of development and alternation of reasoning of court judgment in Lithuania. This is done by using the historical method of analysis. It is important to accentuate that in all historical stages that are being discussed in this thesis, there was a requirement for judges to motivate their decisions, although the content of motivating part and the carrying and publication of judgment were not always the same. The summary provided hereunder gives short overview of final thesis. The summary outlines the subject matter, aim and goals of the thesis. In addition it shortly describes the content and main aspects of this final work. The subject matter of this thesis is – individual constitutional complaint as an effective domestic remedy under Article 13 of the Convention for Protection of Human Rights and Fundamental Freedoms (hereinafter – the European Convention on Human Rights). The thesis is aimed at the evaluation of the individual constitutional complaint as an effective domestic remedy. This final work deals with the meaning, aim and scope of Article 13 of the European Convention on Human Rights; the nature of the remedies required under Article 13; the similarities and differences of the institution of constitutional complaint, which exists in Poland, the Czech Republic and Hungary, this analysis is being made with special regard to the rules on standing of individuals (the complainants, admissibility criteria, etc.) and the legal effect of the Constitutional Court’s final decision; the optimal model of the individual constitutional complaint suitable for Lithuania is being analyzed.
