An anlaysis of the origins, extent, and nature of the legal concept of prescription in civil matters under Saudi Arabian Hanbali law with reference to the effects of Sharia and positive law

Alshamrani, Saad A. January 2014 (has links)
In Islamic Sharia law, prescription has been more commonly referred to as murūr al-zamān [the lapse of time]. It has been claimed that the abstract principle of the lapse of time only has the effect of barring a claim and that is not capable of creating and extinguishing the right itself. In the context of Islamic law, this concept of prescription is often ascribed only to the Hanafi and Maliki schools of Sharia law, and it has been claimed that such principle has not been recognized by the Hanbali School. Based on that, my reading shows that, under Saudi jurisdiction (which is principally based on uncodified Hanbali Sharia law), this hypothesis is a key problem as in practice there are many secondary Saudi laws in place applying prescription rules to bar civil actions. Thus, by arguing that such principle has not been recognized by Sharia law as applied in Saudi Arabia, the legality of such provisions would be in question, given the fact that all Saudi enacted laws must conform with Islamic law. Moreover, my analysis argues that in studies of Saudi Hanbali law, prescription has neither been discussed widely nor given serious independent consideration. In the context of Saudi and Hanbali law, issues of prescription have not only been marginalized and minimized, but also inaccuracies and mis-readings are often found in related academic literature. Drawing on findings across various disciplines, including studies of classical and modern Islamic law, as well as legal studies on Saudi and Arab laws, this study presents new readings of the issues of the existence and origins of the legal concept of civil prescription from the perspectives of the Saudi-Hanbali School of law. Moreover, it presents the first comprehensive survey of the extent of implementation of the rules of prescription in the Saudi civil regulations over the last eight decades. Finally, from both theory and practice aspects, the thesis attempts to conclude with a critical analysis of the single ‘negative’ perspective of prescription in both Islamic and Saudi law.

Nepromlčitelnost práva na vyplnění blankosměnky / Exclusion of limitation of right to completion of a blank bill of exchange

Slavíček, Jan January 2022 (has links)
Exclusion of limitation of right to completion of a blank bill of exchange Abstract Blank bill of exchange is an intentionally incomplete instrument that is meant to be fulfilled in order to become a complete bill of exchange. The owner of the blank bill of exchange exercises his/her right to fulfill a blank bill of exchange by completing the prearranged requirements. The thesis focuses mainly on the time limitation of the right to fulfill a blank bill of exchange. The fulfillment of a blank bill of exchange is performed by the owner of a blank bill of exchange by exercising his right to fulfill a blank bill of exchange. This thesis focuses on the time limitation of the right to fulfill a blank bill of exchange. By exercising this right, the owner of a blank bill of exchange validates the bill of exchange. The absence of time limitation becomes especially significant when the maturity date of the bill of exchange is missing. In these circumstances, the owner of a blank bill of exchange has no time limitation for executing his right. According to the constant case-law of the Supreme Court of the Czech Republic, the right to fulfill a blank bill of exchange shall not be subject to the Statute of Limitations or any other time limitation. The presented thesis addresses the question as to whether the right to...

Appreciating the Golden Hour: A Comparative Interdisciplinary Study

Tachon, Taylor 01 January 2018 (has links)
Within the health care, many medical professionals know about the critical time restraints for provisions of care within their discipline, but do not know the term "The Golden Hour". The Golden Hour is a term indicating the universal time restraint found within every area of health care and more specifically, every area of nursing. The term and concept represented by it should be recognized to better the outcomes of our patients. Although the Golden Hour typically indicates a 60-minute period of time, various settings recognize shorter and longer periods during which specific actions must be taken to assure positive patient outcomes. To meet this aim, this thesis will review studies related to outcomes as associated with time critical interventions that could be categorized by "The Golden Hour". To meet the goal, a search of CINAHL, MEDLINE, PsychINFO, and ScienceDirect databases was conducted. Findings of the search revealed that while the term is not widely used, the concept of time sensitive care is found in many areas of Health Care and, specifically, within multiple sub-disciplines of nursing.

Influencer Marketing & Impulsive Buying : A Quantitative Study On Influencer Marketing and Discount Codes Effect On Impulsive Buying and Purchase Satisfaction

Egelbäck Starud, Elin, Claesson, Elsa January 2023 (has links)
Influencer marketing is a new marketing strategy that has risen in popularity to be used by businesses during the last decade. Even though studies have been previously made on influencer marketing, little research has been made specifically on influencer marketing in combination with their discount codes being offered. The main purpose of this research paper is to examine the connection between the discount codes and the effect it might have on consumers' purchase intention, behavior and impulsive buying. Furthermore, the satisfactory levels after a purchase due to influencer marketing has been examined as it has not been seen in previous studies. The findings revealed that consumers are directly affected by influencer discount codes, causing impulsive buying to a certain level and affects the purchase intentions and decision-making in a faster manner. Furthermore, consumers who had purchased products due to influencer marketing obtained a high satisfactory level post-purchase. The same result could be seen both with and without discount codes. These results contribute to a positive insight of influencer marketing for businesses as the majority of the consumers were satisfied with their purchases. The research paper is written in english.
