ní'' poskytuje rozbor tří oblastí zákonné úpravy ochranných známek včetně použití související judikatury jednotlivým oblastem. Diplomová práce se věnuje institutu ochranné známky jako takové, možnostem její ochrany a úpravě vymáhání práv k části diplomová práce podrobně popisuje institut ochranné známky a její historii, funkce ochranné známky, zatřídění v rámci duševního a průmyslového vlastnictví, rostoucí význam ky a rozšiřující se okruh druhů ochranných známek. V následující části diplomové práce je detailně rozebráno registrační řízení u ÚPV, a to od podání přihlášky až po jednotlivá fakultativní řízení, která mohou v rámci její ochrany nastat, až po případný zá do rejstříku ochranných známek. Podrobně je rozebráno připomínkové řízení a zejména námitkové řízení. V námitkovým řízením jsou důkladně popsány osoby oprávněné podat takové námitky a rozebrány možné důvody v práce se dále zaměřuje na prostředky ochrany poskytované nejen ÚPV, ale i soudy a dalšími orgány, kterými je ochrana vhodně doplněna i v spotřebitele, čímž je poukázáno na to, jak velký význam ochrana v této oblasti má. Závěrečná část p průmyslovému vlastnictví, který i přes svůj stručný rozsah poskytuje pro oblast průmyslového vlastnictví vhodný nástroj úspěšnému vymožení práv oprávněnými osobami. Development Trends in Trademark Law Abstract This thesis deals with the development trends in trademark law in terms of the development of the subject matter of trademark law, i.e. trademarks. In particular, it seeks to answer three questions. Firstly, what are the trends of the development of trademark law from the point of view of the subject matter of trademark law. Secondly, whether the abolition of the requirement of graphic representation has the effect on the development of trademarks as intended by Directive (EU) 2015/2436 of the European Parliament and of the Council. And thirdly, what development of the subject matter of trademark law can be expected in the future. This thesis tries to answer these questions with the help of legal regulations, professional literature, methodological guidelines and decision-making practice of courts and competent authorities. Protection of holders of unregistered trademark or other designations used in business transactions under Czech law and EU law Abstract This final thesis focuses on means of legal protection of holders of non-registered trademark or of another sign used in the course of trade under Czech and European law. First, it defines the legal branch of intellectual and industrial property, the term trademark and the system of Czech national trademarks. Due to extensive amendment of the Czech Trademarks Act based on the European Union Trade Marks Directive, effective from 1st January 2019, the final thesis begins with the description of the trademark legislation effective prior the amendment. Next chapter contains comparative analysis of former and current wording of the legislation following the legislative amendments of Czech Trademarks Act based upon the European Union Trade Marks Directive. Domain names as trademarks and their protection Martin Pultzner Importance of the internet is rising year to year and the virtual presence on the world- wide-web is absolutely essential for companies trying to succeed in such a competitive and dynamic environment as we see it in the modern world of 21st century. Due to the architecture of an internet as such, only one particular domain name can be registered at the given time and no other domain name with the exactly same wording can be registered anywhere in the world at the same time. There is a strict "first-come-first served" policy, which, on the one side, grants equal and fair access to any domain name, but on the other hand creates significant room for domain speculators and other persons who intend to register domain names in a bad faith and/or only for the profit therefrom. We mainly recognize behavior called cybersquatting or typosquatting, but also others subtypes and similar types of such behavior do exist under different names. This work deals with the term goodwill and its analysis of the legal system in the Czech Republic. Compares the relationship of "good reputation" and "goodwill". It also considers the relationship of goodwill and trademarks. It refers to the modern concept of goodwill in respect to trademarks. This work also introduced a system of passing off (unauthorized use of the sign) in UK law. In passing off goodwill is an important element in assessing whether the passing off occurred or not. It also examines the understanding of the goodwill in the Anglo-American legal system. It describes several theories of goodwill, according to legal-historical developments. It also discusses the possibility of transferability of goodwill.

This thesis deals with intellectual property and discusses the legislation of copyright law, trademark law and their possible convergence. The aim of the thesis is to introduce the basic attributes of the two individual pieces of legislation, to show the foundations on which copyright law and trademark law stand and thus to define their common and completely different characters. The thesis is divided into an introduction that brings the subject to the topic, four main chapters and a final conclusion. The first chapter deals with the theoretical context of copyright law and trademark law in the areas of intellectual property rights, intangible property and constitutional establishment in the Czech Republic. In the following two chapters, the two mentioned protections are discussed in more detail. The chapters have a similar classification that helps to understand the individual copyright and trademark elements. Legal protection of domain names in relation to rights of designation Abstract The diploma thesis focusing on the legal protection of domains in relation to the rights of designation has an ambition to offer its readers a comprehensive view of this issue. The work is divided into two basic parts, namely technical and legal parts. In the technical part, attention is paid to both the technical background of the domains, the functioning of the domain name system as well as the individual concepts such as the difference between the domain and the domain name. Legal part is divided into two chapters. The first chapter seeks, in particular, to anchor domains within the legal order, while the other deals with their differences with respect to the rights to designations and possible collisions with them. Trademarks are a valuable asset of a business and play a crucial role with regards to the quality of goods and its reputation, however, the rise in counterfeiting activities is undermining those benefits. Counterfeiting activities are considered to be the fastest growing phenomenon that focuses solely on reputable international brands ranging from cosmetics, watches, shoes and clothing, to cars and aeroplane parts. It has engulfed the world economy by dealing with fake commodities and intellectual property rights across the board. The PhD thesis looks at the relevant trademark laws in the Gulf Cooperation Council States (GCC) as an effective enforcement mechanism to deal with the rise of counterfeiting activities in the region. The GCC States have been listed among the countries with significant problems in terms of intellectual property protection and enforcement. Thus, the importance and effectiveness of border measures, judicial process, including civil and criminal proceedings in all six Member States are analysed using a combination of comparative, doctrinal, and socio-legal research. The main objective of the thesis is to show the degree to which the GCC States' legislative regimes and their enforcement efforts addresses counterfeiting problems to meet their international treaty obligations.
