One of the legal issues, which brought by the development of information and communication technologies, is also the issue of domain names. With the development of the Internet, many human activities moved into the electronic world, including business activities. Presentation of the business through a website has become an indispensable means of competition. Domain names became a significant asset with regard to its secondary function. Therefore it was necessary to provide legal protection for domain names.Legal system of the Czech Republic does not contain specific legal act of domain names. This thesis deals with the issue of domain names. The object of this thesis is the definition of a domain name from a legal terms, the rights to domain names and registration of domain names. This thesis is limited to domain names, which are registrated in ccTLD .cz. The second part discusses the relationship between domain names and trademarks. In relation to the trademark rights the domain name has dual status. Registration of a sign as a domain name can occur the rights of trademarks. The trademark is one of the most effective means of protection for domain names. In this thesis I explain the problematic situation presented by the legal protection of logos in the Czech Republic. I chose this topic because logos are a daily part of everyones' lives helping us make important every day decisions. Yet logo is not a legal term and sometimes it can be difficult to define what logo actually is. This doesn't mean to say that logos do not have legal protection. It always depends on the definition of logo. Usually a logo enjoys the same rights as the brand it represents giving it equal protecton under the law. In many cases logos are a registered trademark giving it full protection under the trademark act. Even unregistered logos enjoy some of the same protections afforded to registered logos and it may be additionally protected by unfair competition laws. Often logos are the work of a single artist and therefore covered by the copyright act. In the opening of the thesis I wrote about the legal protection of logos in view of the copyright act and explained the requirements a logo must meet to qualify for protection under this act. Intellectual Property is Not Property: Copyright and the Culture of Owning a Myth

abstract: The purpose of this study is to explore the shifting cultural norms of copyright law, and that concept’s impact on the performance and practice of artists producing original works of authorship. Although related concepts predate it, and today it exists as a subset of a broader category known as intellectual property, the purpose of copyright beginning with the United States Constitution was to allow for a temporary economic monopoly to an author of a fixed creative work. This monopoly was meant to incentivize authors to contribute to the public good with works that promote progress in science and art. However, increases over time in the scope and duration of copyright terms grant broader protections and controls for copyright owners today, while advances in technology have provided the public with the potential for near-limitless low-cost access to information. This creates a conflict between proprietary interest in creative works and the public’s right and ability to access and build on those works. The history of copyright law in America is rife with efforts to balance these competing interests. The methodology for this study consisted of flexible strategies for collecting and analyzing data, primarily elite, semi-structured interviews with professional artists, attorneys, and others who engage with the cultural and legal norms of intellectual property regimes on a regular basis. Constant comparative analysis was used to maintain an emic perspective, prioritizing the subjective experience of individuals interviewed for this research project. Additional methods for qualitative analysis were also employed here to code and categorize gathered data, including the use of RQDA, a software package for Qualitative Data Analysis that runs within the R statistical software program. Various patterns and behaviors relevant to intellectual property reforms as they relate to artist practices were discussed in detail following the analysis of findings, in an effort to describe how cultural norms of copyright intersect with the creation of original works of authorship, and towards the development of the theory that the semiotic sign systems subject to intellectual property laws are not themselves forms of real property, as they do not meet the categorical requirements of scarce resources. / Dissertation/Thesis / Doctoral Dissertation Journalism and Mass Communication 2018

隨著社會經濟的不斷發展,社會物質精神文化生活的不斷豐富,人們可以越來越容易的購買到自己喜歡的衣服,特別是廣大愛美的女生。現如今中國大陸市場上充斥著各種名稱的女裝品牌,本文的研究對象正是這些消費者可以輕而易舉的接觸到的女裝品牌。 本研究通過對商標的基本解釋、意義與類型的歸納,商標註冊保護程序與要件的列舉,綜合分析目前中國大陸商標的註冊與保護概況。在對女裝品牌相關的文獻進行綜述和總結之後,通過資料檢索、統計分析、判決分析等方式,利用網路平台並在不同網路平台中查找那些關於中國大陸常見的女裝品牌。再通過中國大陸商標局檢索出與這些女裝品牌相關的商標註冊情況,這些註冊情況涵蓋了註冊時間、註冊申請人、註冊公告時間、商標專用權期限等,本論文針對這些信息進行整理、分析和總結,得出有關中國大陸女裝品牌的商標概況。通過在中國裁判文書網,檢索商標名稱以及對應的商標申請人的法律判決狀況,以篩選出的女裝品牌為代表,了解目前中國大陸女裝品牌的商標相關的法律問題。最後本論文結合淘寶網品牌總銷量的相關情況,綜合分析商標註冊的多寡對於這些女裝品牌的銷量和該些女裝品牌註冊商標的爭議之間的影響狀況,總結出女裝品牌商標註冊與保護問題的相關建議。 / With the development of society, people can gain more goods they need than before, like some beautiful clothes, especially for women. And nowadays there are many women’s clothing brands exist in the market of China, this article is based on this phenomenon and focus on the brands of women’s clothing which people can easily buy. In this article, the author interpret and define what brand and what women’s clothing brand is. Also, the author will illuminate how to register a trademark in China, and what protection Chinese government and Chinese trademark related laws offer, meanwhile the writer will collect and select the existing women’s clothing brands by searching different information from the internet. Then the writer will search these brands from “Trademark Office of The State Administration For Industry & Commerce of the People’s Republic of China”, collect these brands’ registrant, registration time, publication time, the period of their exclusive rights and so on. The writer will focus on the information above, try to reorganize and analyze the information mentioned above and draw some conclusions from that. The author will search the trademark-related judgment of these selected brands by “China Judgements Online”, as well as collect the sales volume of these brands by “Taobao”. At last the author will use the software of “Excel” and “R” to analyze the data above. After doing all the things above, the author will draw a conclusion and could give some related suggestion on the topic of the registration and protection of the trademarks’ status in China from women’s clothing brands.

RESUMÉ A comparison of national trade mark with Community trade mark. The purpose of my thesis is to compare legislation of national trade mark with leagislation community trade mark. I would like to show influence on the czech national trade mark after European union accession. In my thesis I focus on the amendment of European union trade mark through regulation European Parliament and Council (EU) 2015/2424. There are the most important changes in three areas: institutional, procedural and changes in the level of charges. This regulation is step forward in the development of trade marks. Thie regulation provides for simplification of the registration process. My thesis is composed of six chapters plus introduction and conclusion. Title: Trademarks and identities in consumption cultures-A survey about young people’s identity expression through trade marksI undersökningen behandlas frågeställningen: Hur och vilka varumärken använder ett urval ungdomar för att uttrycka identitet? Denna frågeställning behandlas eftersom det har funnits ett intresse för varumärken, konsumtion och identitet hos ungdomar.Under en workshop som genomfördes tre gånger, fick elever i en grundskola i Västerås en uppgift. I uppgiften skulle informanterna dokumentera och skriva ned sina varumärkeskonsumtioner under en hel dag. Därefter presenterades en ritad fiktiv person utifrån varumärkesdokumentationen de skapat. Intervjuer har skett vid ett av tillfällena med informanterna, för att få reda på mer information om den fiktiva personen och dennes varumärkeskonsumtion.Undersökningen resulterade även i en visuell gestaltning. Vid gestaltningen användes en spånskiva på 150x240 meter. På spånskivan sattes elevernas fotografier på varumärken och teckningar på de fiktiva personerna upp. Min intention var att rama in teckningarna och fotografierna. Därför målades spånskivan i ett vitt och gråtonigt fält. Fotografierna sattes på det vita fältet medan teckningarna sattes på det gråtoniga, för att rikta uppmärksamheten på det visuella materialet. Förhoppning var även att förstora fotografierna, vilket gjordes i skalan 15x15. Teckningarna var i originalstorlek det vill säga A4 ark.
