Diplomová práce se věnuje institutu ochranné známky jako takové, možnostem její ochrany a úpravě vymáhání práv k části diplomová práce podrobně popisuje institut ochranné známky a její historii, funkce ochranné známky, zatřídění v rámci duševního a průmyslového vlastnictví, rostoucí význam ky a rozšiřující se okruh druhů ochranných známek. V následující části diplomové práce je detailně rozebráno registrační řízení u ÚPV, a to od podání přihlášky až po jednotlivá fakultativní řízení, která mohou v rámci její ochrany nastat, až po případný zá do rejstříku ochranných známek. Podrobně je rozebráno připomínkové řízení a zejména námitkové řízení. V námitkovým řízením jsou důkladně popsány osoby oprávněné podat takové námitky a rozebrány možné důvody v práce se dále zaměřuje na prostředky ochrany poskytované nejen ÚPV, ale i soudy a dalšími orgány, kterými je ochrana vhodně doplněna i v spotřebitele, čímž je poukázáno na to, jak velký význam ochrana v této oblasti má. Závěrečná část p průmyslovému vlastnictví, který i přes svůj stručný rozsah poskytuje pro oblast průmyslového vlastnictví vhodný nástroj úspěšnému vymožení práv oprávněnými osobami. The conflict between trade marks and domain names has been a major subject of legal debate over the past few years. The issues arising from the relationship between trade marks and domain names reveal the difficulties associated with attempts to establish mechanisms to address the problems existing between them. Trade mark laws have been adopted to resolve the trade mark and domain name conflict, resulting in more conflict. Domain name registers have to date been constructed on the basis of first come first served. Given that the generic indicators are very general, it has been inevitable that problems would arise, particularly once the commercial potential of the Internet began to be realised. Unlike domain names, trade marks are protected in ways which are more precise. Trade marks may not be imitated either exactly or in a manner so similar that it is likely to confuse a significant portion of the public. It is possible for more than one enterprise to use the same trade mark in respect of different goods, although this is not possible with domain names. This disparity in objectives leads to two core problems. The first problem relates to cybersquatters who deliberately secure Top Level Domains (TLDs) containing the names or marks of well known enterprises in order to sell them later. The second problem relates to the rival claims between parties who have genuine reasons for wanting particular TLDs, and problems associated with the resolution of such claims. The disputes between parties with legitimate conflicting interests in domain names are often not equitably and effectively resolved, thus compromising the rights of domain name holders. There is great activity in the United States of America (USA) and the United Kingdom (UK) to provide a more substantial system of governing and regulating the Internet. There is a strong movement to provide methods of arbitrating conflicts between honest claims to TLDs which conflict either in Internet terms or in trade mark law. However, these difficult policies remain to be settled. South Africa's progress towards the establishment of an effective mechanism to govern and regulate the Internet has been hindered by the absence of a policy to resolve domain related trade mark disputes. South Africa only recently drafted the South African Regulations for Alternative Domain Name Dispute Resolution (zaADRR), although the regulations have not yet been adopted. Therefore South African parties to domain name disputes continue to find solutions to their problems through the court system or foreign dispute resolution policies. The purpose of this study is firstly to examine and to comment on the basic issues of trade mark law and domain names in this area, with particular reference to South Africa, and secondly to examine the mechanisms in place for the resolution of trade mark and domain name disputes and to highlight the issues that flow from that. An additional purpose of this study is to discuss the policies of the dispute resolution mechanisms and to suggest how these policies can be improved.

Cabe mencionar la diferencia entre el carácter genérico de la estratégica y las tácticas como maniobras puntuales de la campaña, las cuales se desprenden de dicha estrategia. La marca San Fernando se personificaba como un ingeniero de unos 65 años, exigente y que nunca le daba un abrazo a sus hijos (Klingenberger, 2013). Este fenómeno se dio luego de su relanzamiento, ya que San Fernando pasó de ser una marca respetada que garantizaba calidad, a ser también amada y a volverse parte de la vida de los consumidores. Esta investigación se basó en un análisis realizado en el año 2015 a las tiendas
Camote Soup y Rommate, para conocer la problemática desde las perspectivas de los
dueños de las tiendas, seguidoras de cuentas de Instagram y community managers. Con
la finalidad de actualizar la información recabada del año 2015 se realizó un segundo
estudio cualitativo en el 2017. De esta manera se concluyó que Instagram sí aporta a la
construcción del valor de marca si es que esta es gestionada eficientemente. La buena
gestión, según los resultados del presente estudio, se refiere a seguir una estrategia
orientada en los objetivos que se tenga como marca y sobretodo utilizando contenido en

The goal is to analyze the credibility of Brand Finance and Inter Brand rankings as the examples of companies which publicize global brand rankings. The comparison is done on the specific evaluation of L'Oréal Paris trademark. The potencial is examined in the strategical analysis also with the quality of trademark registered with connection to L'Oréal Paris.The thesis contains financial analysis for the purpose of checking financial health of the company L'Oréal SA. In the last part the trademark is evaluated by the most common valuation methods.. The final value is compared with the ranking values of Brand Finance and Inter Brand.

efficient rescue of financially distressed companies. It is almost four years since the Act
introduced the regime of business rescue, therefor details about its success or lack
thereof must be examined so as to consider its viability in South Africa. With a very higher
degree of certainty, the regime has so far shown some inherent shortcomings embodied
in its application. Business rescue has had implications on corporate governance and
taxation in South Africa. Against this new corporate scene, mini-dissertation analyses the
most controversial aspects and the most telling implications of the business rescue
regime since its inception in South African company law. Furthermore, this minidissertation
analyses the call for further modification of the business rescue regime. Most
importantly it spells out several recommendations which if considered pragmatically will
constructively contribute to the viability of the business rescue regime in South Africa. It
finds that the business rescue regime in South Africa is almost likely to be viable.

The thesis investigates the concept of trademark dilution under international and regional trademark law, and under the laws of selected jurisdictions; namely, the United States of America, Germany, the United Kingdom and the Republic of South Africa. The investigation includes measures undertaken to prohibit the internet-based dilution of famous marks through the registration of confusingly similar domain names. It is noted that dilution is imprecisely formulated under international trademark treaty law. In fact, the term "dilution" does not appear in international trademark treaties. To fill the gap of international trademark treaties, various policy initiatives, or `soft law' have been developed, which to some extent clarify both the concept of dilution, the type of mark protected from dilution, and the scope of such protection. The problem is that the policy initiatives are non-binding on States, so that different States have adopted different common law and statutory approaches to the protection of marks against dilution. This is demonstrated, for example, by the fact that the European Union and its Member States provide protection from dilution to "marks with a reputation", while the United States of America provides such protection only to "famous" marks, and the Republic of South Africa protects "marks which are well-known in the Republic" from dilution. The thesis analyses the protection granted in these jurisdictions, to determine the similarities and differences of approach, and to make appropriate law reform proposals to achieve uniformity of protection. In the final analysis, it is concluded that the burden of enforcing dilution provisions rest on the judiciary. This being so, the judiciary is urged to engage in a balancing exercise in deciding dilution cases. The courts should recognize that dilution provisions are powerful tools at the disposal of owners of trademarks with advertising value. At the same time, the courts should be steadfast in ensuring that protection from dilution does not stultify freedom of trade, or create absolute monopolies or a form of copyright in a trademark. / Jurisprudence / LL.D.

In the diploma work, there are examined domain names, which have become, due to a mass development of the Internet, an economically very valuable estate. Domain names lack, although being a generally known notion, any legal anchoring in the Czech system of law. The absence of legal regulation of domain names is not an anomaly of the Czech legal environment, but it can also be seen in the states with advanced legal culture. Domain names fulfill, in addition to being a very valuable commercial article, identification and/or promotional functions. Just for those reasons, the domain names need to be provided a corresponding legal protection. Protection of domain names Life nowadays is much more dependent on information and the most common source of them right now is Internet. One of the main aspects, that users of Internet have to deal with, is a domain names, as a website address. Nevertheless it's common, that users do not differentiate between internet, browser, search engine or web page, nor are familiar with the legal and technical concept of domain names. Domains are allocated according to a first come first serve basis and that makes them valuable article and thus subject of common legal disputes. The purpose of my thesis is to analyze ways of legal protection of domain names and the absence of its legal regulation, which is not unique for Czech legal system. First chapter of my thesis deals briefly with internet and its basic infrastructure, including internet protocol, with deeper focus on domain names, their technical aspects, hierarchical structure and typology.
