The role of traditional leaders in rural local government : a case of Vulindlela and Impendle traditional areas.

Approximately three-quarters of the population in South Africa live in rural areas and are under the governance of traditional leadership, whose practice has been the source of controversy in the post-apartheid era. The institution of traditional leadership has been historically regarded as the main ruling system closest to and accepted by the people at grassroots level. The aim of this research is to investigate the role of traditional leaders in local government in the Vulindlela and Impendle areas, Pietermaritzburg. The objective is to present a historical overview of the role of traditional leaders and to analyse the role traditional leaders have to play in development. The research examines whether the tension between traditional leaders and municipal councillors hinder development to the masses in Vulindlela and Impendle areas. The methodology adopted for this study was a qualitative research approach, which was used to analyse the roles played by traditional leaders in rural local government development. The main findings of the study reveal that traditional leaders and authorities are essential political, social and economic structures for maintaining the socio-political order that is a prerequisite for rural development. Any endeavor to create a full democratic society in South Africa must utilize the intrinsic strengths of traditional leaders. The institution of traditional leaders should be transformed to move with the times. Many traditional leaders accept the role they have to play as part of the new order as well as the resulting challenge associated with the process of transformation. In principle, traditional authorities should not be drawn into party politics and their role should remain one of neutral leadership. Traditional leadership in local economic development : a case study of the uMgungundlovu District.

Inequality in South Africa in terms of access to education, finance, food security, and public amenities is worse in rural areas under traditional leadership than in urban areas not under the control of traditional leaders. In most of these areas, people live in abject poverty and underdevelopment is rife with no access to economic opportunities, basic services and economic and social infrastructure. This study attempts to ascertain the involvement of traditional leadership in the Local Economic Development (LED) of these areas. It also explores the mandate given to traditional leadership through government legislation, policies and programmes in LED. The study further seeks to suggest through a model how traditional leadership could be involved in LED. This study focuses on the following questions:  What are the fundamental causes of the exclusion of traditional leadership in LED?  What government policies and programmes are in places that explicitly spell out the role of traditional leadership in LED? and  What are the perceptions of traditional leadership implicit in the government’s LED initiatives? The scope of the study covers the uMgungundlovu District which has 24 traditional councils that form the local House of Traditional Leaders. These traditional councils spread across the seven local municipalities that form part of the District. The data was collected using a qualitative research methodology which focused on interviews with government officials and traditional leaders, to get their perceptions on the role of traditional leadership in LED. Government legislation, policies and programmes have also been reviewed to check the official government position on the role of traditional leadership in LED. Engagement with government officials, traditional leaders and government publications reveals that traditional leadership is not playing a role in LED. There are no LED programmes directed to traditional communities that are led by traditional leaders. There is then a justifiable perception that traditional leaders are being deliberately excluded from government LED initiatives. A review of the government legislation, policies and programmes indicates that they do not bar the traditional leaders from playing a role in LED. The constitution of the Republic of South Africa provides a broad framework with regard to the role of traditional leaders by stating that the national government may provide for a role of traditional leadership in matters affecting their communities. The White Paper on Traditional Leadership and Governance recognizes traditional leadership as an institution located in rural areas that has a role to play in the fight against poverty. The Traditional Leadership Governance and Framework Act states that government may provide a role for traditional leaders in respect of economic development. This study provides a model through which traditional leadership could be involved in LED. The model provides for a role to be played by the provincial House of Traditional Leaders, as part of LED policy formulation; a role for the local House of Traditional Leaders as part of LED strategy development; and for a Traditional Council, as part of LED implementation monitoring. Traditional ward’s headmen are envisaged as assisting in coordination and a ward committee, in which traditional leadership is represented, is envisaged as contributing towards evaluation. The study finally recommends that the Provincial Department of Economic Development and Tourism in collaboration with the Department of Cooperative Governance and Traditional Affairs should establish a fund for a LED programme for traditional communities. The study further recommends that the conceptualization of LED programmes should be done in consultation with traditional leadership, and that traditional leadership should lead the implementation of the programme in their respective areas. / Thesis (M.Com.)-University of KwaZulu-Natal, Westville, 2012.

The role of traditional leaders in enhancing service delivery in Mbhashe Local Municipality

This study investigates the role of traditional leaders in enhancing service delivery in Mbhashe Local Municipality. The aim is to examine the involvement of traditional leaders in the provision of services to traditional communities. To achieve this goal, it was necessary to review literature on traditional leadership to advance an argument that by utilising the existing channels of communication such as traditional councils, government programmes could be more efficiently advertised. A secondary objective was to examine the relationship between traditional leaders and democratically elected councillors in the delivery of services. The problem in Mbhashe Local Municipality is that traditional leaders and the democratically elected leaders do not work together for service delivery. In order to address this problem, face-to-face interviews were conducted with the identified sample and conclusions drawn from their responses. The research revealed that if properly utilised and capacitated traditional leaders can indeed play a pivotal role in the enhancement of service delivery in Mbhashe Local Municipal area and in South Africa as whole.

The effectiveness of traditional leaders in the development of the rural Eastern Cape

Traditional leadership is a contested field in social and political environments. The new, democratic government has created an environment that accommodates the existence of traditional leadership by introducing policies that guide their functioning. The White Paper on Traditional Leadership of 2003 spells out the roles and responsibilities of traditional leaders. This document when used with the Municipal Structures Act 117 of 2003 may minimise the existing tensions between the traditional leaders and the democratically elected councillors. The White Paper on Traditional Leadership of 2003 has been designed accordingly with the Bill of Rights. Equality and prevention of unfair discrimination, has been entrenched in the Bill of Rights of the Republic of South Africa. Traditional leaders, therefore, do have a space in the governance of South Africa. They are expected to participate in development programmes and in promoting service delivery. This study used the method of a case study. It is a qualitative study. Questionnaires and interviews are tools used to collect data. Various observations and findings were made with proposed recommendations. Most important to note is that, the traditional leaders are aware of the White Paper on Traditional Leadership but do not know what to do about it. This reveals that there is a gap between practice and policy. is the recommendation of the study that, the officials from Local Government and Traditional Affairs and those from the municipalities workshop and mentor the traditional leaders as well as the democratically elected councillors. Such a practice could minimise if not eliminate the tensions that result in poor service delivery.

Appraisal of community-based childcare practices in rural Malawi: the case of Malili traditional authority area, Lilongwe District

The government of Malawi established the community based childcare (CBCC) programme with the aim of addressing early childhood problems and achieve national development in the long run. The CBCC programme, as one of the approaches to early childhood development (ECD), is guided by the national early childhood development policy. It promotes some practices that somehow deviate from the traditional childcare ways that communities have always known. Experience has shown that programmes that have elements of conflict with commonly held beliefs are bound to meet with resistance in society. The study employed a mini survey, focus group discussion, observation and document review to understand how the CBCC childcare practices in Malili intersect with commonly held beliefs about childcare as well as how they reflect on the national ECD policy. The study also focused on understanding the perceptions of community members on the CBCC programme. The study revealed that while some aspects of CBCC delivery conform to commonly held beliefs about childcare in the area under study, others diverge from such beliefs. Such convergence and divergence appear to be in line with the propositions of transformalist globalisation theory- one of the perspectives adopted for the study. The study also found that care practices at CBCC are not a true reflection of the national ECD policy as community members’ perceptions, poor community participation, poverty and lack of caregiver training in ECD contribute towards poor quality of care in CBCC, contrary to what is defined in the national ECD policy. The study also found that while both CBCC caregivers and sampled community members perceived the quality of care at the centers as poor, caregivers had a more positive perception towards the CBCC than community members. The study indicated that CBCC are centres of desperation for low economic status communities. Findings from the research have revealed that cultural values and commonly held beliefs, and exposure to new knowledge through globalisation play a role in determining childcare practices as well as perceptions towards them. In this sense the study has indicated that meanings that communities attach to development interventions influence their actions and perceptions towards it.

This study explores the interactive process between decentralized structures and traditional authorities in Wenchi district, with a view to generating lessons and insights that can guide the recommendation of a more appropriate decentralization framework to tap the strengths of traditional authorities towards accelerated rural development. Within the framework of action research methodology, mixed-methods were used to triangulate findings and enhance research rigour. Specific methods employed were focus group discussions (FGDs), in-depth interviews (IDIs), and observation, complemented by context analyses of relevant documents. It was found that the interactive processes between traditional authorities and decentralized structures are characterized mainly by competition for power and legitimacy, leading to mistrust and an inability to take advantage of the synergy effect between the two systems of local governance in accomplishing accelerated rural development. Key recommendations are that traditional authorities should not be fused with the decentralized structures, but should remain as countervailing institutions to check the misuse of power by the decentralized structures. However, traditional authorities should be given the ceremonial role of the right to address meetings of the District Assembly and the Area Councils. Traditional leadership and the use of cultural laws in land administration: implications for rural women's land rights in a transforming South Africa

This dissertation critically examines how traditional leaders use cultural laws to allocate land to women and to allow women to participate in land administration in communal areas. Given the government's commitment to gender equity in all spheres of life as stipulated in Section 9 (3) of the South African Constitution (Act 108 of 1996), the dissertation examines whether related legislation and policy (such as CLARA and TLGFA) alone can guarantee equitable access to land for women and their participation in land administration structures in communal areas where patriarchy dominates. In essence, the study interrogates whether state intervention through formalizing laws that govern land matters do achieve gender equity while cultural laws still exist in communal areas. Based on the view that land in communal areas is held by the state and administered by traditional leaders who have historically discriminated against women, the dissertation employs a case study method to examine whether cultural laws are exercised when women apply for a piece of land at the three levels of traditional authority viz: village, sub-village and traditional council levels in the Matolweni village of the Nqadu Tribal Authority. Although women are often the de facto rights holders in rural areas as a result of male migration to urban areas, findings seem to indicate that it is difficult and/or sometimes impossible to translate paper laws into practice while cultural laws are still operating. For effective transformation to occur, the study recommends that unless a strong women's rural movement emerges, coupled with a socialist feminist position that advocates for a radical transformation of rural society to defeat the patriarchal norms and standards, traditional leaders will continue to discriminate against women in land issues.
