European legal regulation of the remuneration of women and men Abstract This thesis focuses on the legal regulation of the principle of equal pay in European law. Despite the fact that the priciples of equality of men and women are anchored in the international, regional and national laws, the actual fulfulment of the principle of equal pay in the European countries is not satisfactory. This thesis is trying to provide a systematic overview of the relevant legal regulation of the principle of equal pay on the international and European level. Within the respective legal systems, this thesis focuses on the particularity of the regulation, on the existence of controll and enforcing mechanism and on the actual aplication of the principle of equal pay through these mechanisms. The thesis is divided into four chapters. The first chapter defines the concepts essential for this thesis. In particular, it contains definitions of concepts of equality and discrimination. Furthermore, the concepts of sex, gender and diferences in remuneration are defined. The second chapter focuses on the legal regulation of equal pay as adopted by the UN. No. of bitstreams: 1 Montagner_MariaInez_M.pdf: 1837606 bytes, checksum: acada823b58f22312530451771cd3e30 (MD5) Previous issue date: 2007 / Resumo: A proposta desta pesquisa é realizar um resgate histórico e social da trajetória das mulheres pesquisadoras da Universidade Estadual de Campinas, partindo de seus trabalhos como cientistas e professoras dentro da Faculdade de Ciências Médicas. Imbuída do referencial teórico dos estudos de gênero, dentro da sociologia da ciência e mais especialmente na área da saúde, buscarei entender a trajetória dessas mulheres, as escolhas pessoais e profissionais articuladas às suas estratégias sociais. Para tanto, assumo que o gênero se expressa em muitas áreas da vida social, por exemplo, a cultura, a ideologia, a ciência e as práticas em geral. No entanto, estou especificamente interessada em como essas mulheres conseguiram articular, concomitantemente, as práticas de pesquisa, as suas atividades de ensino, administração e extensão universitária, com suas vidas cotidianas e familiares. Esta pesquisa compõe-se de três momentos. Num primeiro, o levantamento da documentação das pesquisadoras (Plataforma Lattes) buscando sua trajetória no meio acadêmico e suas estratégias dentro do campo científico. Um segundo, a realização de uma entrevista focada, elaborada com base nas informações e pressupostos formulados por meio da análise dos documentos, que permitirão configurar o processo de construção social das trajetórias acadêmicas. Por fim, em um terceiro momento, com base na teoria de Pierre Bourdieu, buscaremos esboçar o habitus dessas pesquisadoras. Este estudo está sendo realizado dentro de uma perspectiva sociológica, e os estudos de gênero comporão nossos trabalhos, auxiliando-nos como a base de nossas análises. Os estudos históricos são de grande importância e valia, quando procuramos desvelar esse tema, pois compreendemos que é necessário o entendimento do contexto histórico e cultural para podermos bordar a relação entre as falas e as teorias. Com este trabalho, esperamos contribuir para o entendimento do papel e da posição dessas mulheres no campo acadêmico, como se conformaram seus habitus e quais são as relações desses habitus com a questão do gênero, especialmente pelo fato dessas atividades inscreverem-se em uma quádrupla dimensão: ensino, pesquisa, administração e extensão / Abstract: The proposal of this research is to carry through a historical and social rescue of the trajectories of the searching women of the State University of Campinas, leaving of its works while scientists and teachers inside of the College of Medical Sciences. Using the theoretical reference of the gender studies, inside of the sociology of science and more especially in the domain of the health, we will search to understand the trajectories of these women, the personal and professional choices, articulated with its social strategies. For in such a way, we assume that the gender can be express in many areas of the social life, for example, the culture, the ideology, science and the practical ones in general. However, specifically I am interested in as these women had obtained to articulate practical of research, concomitant the its activities of education, administration and university extension, with its daily and familiar lives. This research is composed by three moments. In a first one, the survey of the documentation of the researchers (Lattes Platform) searching its trajectories in the academy and its strategies inside of the scientific field. As, the accomplishment of an 'focused interview¿, elaborated on the basis of the formulated estimated information and through the analysis of the documents, that will allow to configure the process of social construction of the academic trajectories. Finally, at one third moment, on the basis of the theory of Pierre Bourdieu, we will search to sketch the habitus of these researchers. This study is being carried through inside of a sociological perspective, and the gender studies will compose the base of our analyses. The historical studies are the great importance and value when we look for to understand this subject; therefore the agreement of the historical context is necessary to be able to embroider the relation between the speeches and the theories. With this work, we hope to contribute for the agreement of the paper and of the position of these women in the academic field, as its had been satisfied habitus and which are the relations of these habitus with the question of the gender, especially for the fact of these activities are enrolled in a quadruple dimension: education, research, administration and extension / Mestrado / Saude Coletiva / Mestre em Saude Coletiva
