The Message of the Jerusalem Council in the Acts of the Apostles: A Linguistic Stylistic Analysis

This study investigates how the book of Acts addresses certain local problems in Luke's community through a linguistic stylistic analysis that utilizes models of verbal art and intertextuality within a systemic-functional linguistic framework. This methodology is suited to demonstrate how Luke symbolically articulates a message to his audience through his stylistic patternings of language of the Jerusalem Council in Acts 15 and the texts with which it shares thematic content. The scheme of the study begins with the analysis of the Cornelius episode in Acts 10:1-11:18, continues with the Jerusalem Council in Acts 15:1- 29, and concludes with Paul's return to Jerusalem where he stands accused of forsaking the Law of Moses in Acts 21:17-26. Each of these episodes, sharing patterns of repetition, plays a role in the symbolic articulation of a message in the book of Acts. First, the Cornelius story establishes the legitimacy of table fellowship among Jewish and Gentile believers against opposing Jewish value positions regarding moral purity. Next, the Jerusalem Council in Acts 15 recapitulates the Cornelius episode but then further develops value orientations concerning social relations among Jewish and Gentile believers in the church, principally by means of the Apostolic Decree. Then, the repetition of the Apostolic Decree in Acts 21 clarifies its meaning according to different situational variables. The thesis of this study is that these patterns reveal contextual elements of a particular conflict the early church faced over the communal integration of Jewish and Gentile believers - namely, that Jews were susceptible to splitting off from multi-ethnic churches due to the pressures of a Jewish separationist ideology. The book of Acts subverts this ideology by means of the foregrounded patternings identified in this study. These patternings, which serve to identify foregrounded thematic formations, orient the reader to the proper heterglossic backdrop and reveal that Luke engages a particular Noahic tradition associated with the discursive practice of rewriting sacred scripture in Second Temple Jewish literature, not to align with its value orientations but to subvert it and thereby convince Jewish believers not to withdraw from the community of God.

An Inquiry Into the Effects of Statutory Climate on the Political Attitudes and Behavior of State-Level Public Administrators

This dissertation examines ways in which differences in states' political activity laws affect the political attitudes and reported behavior of senior state government employees. Of particular concern is whether a stringent little Hatch Act engenders any "chilling effects" that may lead these workers to shy away from permissible political activities. The study included officials employed in Pennsylvania, which has a restrictive political activity statute, and New Jersey, which has generally permissive laws. Mail questionnaires were sent to 962 officials, 512 from Pennsylvania and 450 from New Jersey. Responses were received from 582 employees, yielding a 61.91% response rate. Compared to New Jersey officials, those from Pennsylvania were less knowledgeable about their state's political activity laws. The Pennsylvania employees also reported being less politically active and less satisfied with their activity, and were more likely to indicate that they would increase their level of political activity if state prohibitions were eliminated. However, compared to their New Jersey counterparts, these officials were no less inclined to engage in permissible political activities. This finding casts doubt on the notion that a highly restrictive statutory climate spawns chilling effects. / Ph. D.

O presente trabalho de pesquisa tem por objetivo analisar algumas das inúmeras decisões do Supremo Tribunal Federal e do Superior Tribunal de Justiça, bem como do Tribunal de Justiça de São Paulo, em matéria de controle jurisdicional dos atos administrativos discricionários e verificar se é possível identificar mudança substancial nos limites desse controle. O trabalho foi dividido em duas partes, sendo a primeira constituída por uma pesquisa bibliográfica destinada, essencialmente, a situar o tema da discricionariedade administrativa, num enfoque conceitual e histórico. A segunda parte refere-se à pesquisa sobre o tema na jurisprudência do Supremo Tribunal Federal, Superior Tribunal de Justiça, Tribunal de Justiça de São Paulo e, ainda, no acórdão relativo à apelação cível nº. 1.422 do Tribunal de Justiça do Rio Grande do Norte, cuja relatoria ficou a cargo de Miguel Seabra Fagundes. Os atos administrativos discricionários, por muito tempo foram considerados insindicáveis pelo Poder Judiciário, ou seja, imunes à apreciação jurisdicional. Contudo, é possível identificar o surgimento de alguns parâmetros jurídicos que objetivaram restringir a atividade administrativa discricionária, inserindo-a, sob determinados aspectos, no âmbito da apreciação jurisdicional. O balizamento inicial restringiu-se à lei, permanecendo o mérito do ato administrativo intocado. Nesse processo de tentativa de contenção dos atos administrativos discricionários desenvolveram-se teorias de controle, como a teoria do desvio de poder e a teoria dos motivos determinantes. Cite-se, também, a teoria dos conceitos jurídicos indeterminados e, mais recentemente, a teoria da vinculação dos atos administrativos aos princípios constitucionais. O mérito do ato administrativo é o espaço que ainda suscita algumas controvérsias. A pesquisa jurisprudencial foi realizada, em sua maioria, diretamente nos sítios do Tribunal respectivo. It is noted, when considering the case law, that there is a trend in the STF and STJ to welcome the idea of a wider appreciation by the judiciary, like was the case Resp 429570/GO, whose rapporteur was in the responsibility of the Minister Eliana Calmon, although it is still quite common, the judgments stating that it is not for consideration by the judiciary under the aspect of convenience and opportunity of the administrative act, in other words, the act of merit.

Šiame darbe analizuojamos nusikalstamų veikų daugeto formos ir jų įtaka bausmės skyrimui. Tačiau turint omenyje tai, jog nusikalstamų veikų daugetas ne retai suprantamas skirtingai, o nuo jo priklauso formų išskyrimas, šiame darbe pirmiausia siekiama apibrėžti daugeto sampratą, parodyti jog daugetas nėra vien tik situacijos, kai asmuo padaro kelias nusikalstamas. Siekiant įvertinti daugeto formų įtaką bausmės skyrimui, pirmiausia apžvelgiamos įvairios daugeto teorijos pateikiamos įvairiuose doktrinos šaltiniuose ir pagrindžiamas idealiosios ir realiosio sutapties kaip daugeto formų išskyrimas tiek teorijoje, tiek galiojančiame Lietuvos Respublikos baudžiamajame kodekse. Nors pavienė nusikalstama veika yra nusikalstamų veikų daugeto komponentas, kai kurios pavienės veikos išoriškai yra panašios į daugetą. Dėl to siekiant aiškiai apsibrėžti daugeto formas, šiame darbe pateikiami pavienių tęstinių, trunkamųjų ir sudėtinių nusikalstamų veikų skirtumai nuo jų daugeto, taip pat atskleidžiami jų charakteringi bruožai. Atlikus išsamią šio instituto analizę, darbe plačiai vertinama jo įtaka bausmės skyrimui. Apžvelgiamos tiek pagrindinės bausmių už kelias asmens padarytas nusikalstamas veikas skyrimo sistemos, tiek ir Lietuvos Respublikos baudžiamojo kodekso straipsniuose įtvirtintos taisyklės. [toliau žr. visą tekstą] / This thesis provides a detailed analysis of existing forms of multiple criminal acts and their significance the sentencing. Having in mind that the institute of multiple criminal acts is often interpreted in various different ways this work attempts to define this institute as much more complex than a situation when a person commits more than one criminal act. The definition has a major influence in the understanding of different forms of multiple criminal acts, therefore, in order to comprehend the influence of multiple criminal acts to sentencing various theories of multiple criminal acts are discussed in this work. In this discussion the author presents the forms of multiple criminal acts not only from various doctrinal sources but also from the penal code of the Republic of Lithuania. Even though an individual criminal act is a constitutive part of multiple criminal acts, some individual criminal acts are similar to multiple criminal acts. For this reason, in order to define the two forms of multiple criminal acts, the author attempts to provide a solid analysis of those single criminal acts which have similar features to the forms of multiple criminal acts. After this analysis the work depicts a full picture of the influence of the forms’ of multiple acts significance to sentencing according to both the penal code of the Republic of Lithuania and foreign systems of sentencing.
