Summary: International Terrorism and Human Rights Key words: international terrorism, antiterrorist measures, human rights First part of the thesis is centered on characteristics of international terrorism, concept of human rights and three aspects of their mutual relationship: the immediate impact of terrorist attacks on human rights of their direct victims and the society as a whole and aspects linked to the states' response consisting of human rights breaches of suspects during repressive measures and curtailing the rights and freedoms of us all during preventive measures. Many states have tighten their current antiterrorist measures, introduced new ones and strengthened the powers of military and law enforcement at the expense of internationally guaranteed human rights and fundamental freedoms, argumenting with the need of neccessary trade-off between personal rights and freedoms and national security. Nevertheless, there are flexible institutes imbedded into international law that allow for realization of represive and preventive measures whithout compromising the guaranteed human rights. 1 Terrorism in criminal law in the context of evolution of Czech legislation since 1918 Abstract This document covers the evolution of antiterrorist legislation and related legislation since 1918 on the territory of Czechoslovakia. To start with, the concept of terrorism is defined in the introduction in order to set up the wider issue that is covered in the remainder of the text. Four key moments in history that correspond to the definition of terrorism with the relevant law regulations applied have been chosen for the analysis. The aim is to demonstrate readiness of the institutions to address this specific area of criminal justice in their time. At the same time, this paper illustrates the ever changing understanding and terminology related to the crimes, depending on the context and subject that might be adjudicating. The first event is the assassination of finance minister Alois Rasin during the era of the First Czechoslovac Republic. His politically motivated killing is firstly analysed on the basis of ruling of the State Court in the light of criminal law of the time. Follows an analysis from the point of view of the contemporary legal norms. La col•laboració entre el govern espanyol i el francès contra l’organització armada Euskadi Ta Askatasuna (ETA) va començar al gener de 1984 amb l’ús de les deportacions a tercers països. Els refugiats bascos que vivien al País Basc francès i que eren detinguts van començar a ser enviats a llocs americans i africans. Aquesta pràctica va estar vigent entre 1984 i 1990. Però els deportats van continuar vivint als tercers països i hi ha qui encara hi viu. La deportació va ser la mesura que el govern francès va usar abans de decidir-se a extradir cap a Espanya. Va implicar a tercers països que van acollir als bascos a canvi de compensacions econòmiques espanyoles. Aquestes es produïen a través d’Ajudes Oficials al Desenvolupament. Va acabar per convertir-se en una mesura oblidada pel pas del temps. / The collaboration between the French and the Spanish government against the armed organization Euskadi Ta Askatasuna (ETA) began in January 1984 with the use of deportations to third countries. Refugees living in the French Basque Country and who were arrested began to be sent to African and American places. This practice was in force between 1984 and 1990. But the deportees continued living in third countries and now there are someone who are still alive. The deportation was the extent that the French government used before deciding to extradite to Spain. It implied in third countries that they accommodated the Basques in exchange for Spanish economical compensations. These were produced through Official Development Assistance. Le Terrorisme est devenu le mal du système-monde moderne. Comment repenser l’acte du terrorisme est devenue une question pressante, surtout quand l’incompréhension est dominante sinon triomphante. D’où, la nécessité d’étudier l’acte terroriste, de le comprendre loin des idées reçues et des sentiers battus. La politique américaine a axé son ordre de priorité sur la guerre contre le terrorisme, au point d’élever la raison sécuritaire à un nouveau paradigme des relations internationales. Les politiques sécuritaires américaines ont entraîné dans la foulée une mise sous tutelle sans précédent des libertés publiques sur le territoire américain (USA Patriot Act, Projet Patriot Act II, Homeland Security Act, National Strategy of Security…) comme la mise en place d’un véritable état d’exception international: Camp Guantanamo, Abou Gharib, transferts extrajudiciaires des terroristes, prisons secrètes. Ce qui provoque des réactions de rejets et d’oppositions. En effet, si Les Etats de l’Union européenne n’ont pas adhéré du premier coup à la logique antiterroriste américaine, ils finiront par s’aligner sur la politique anti-terroriste américaine. Lemonde arabe est acculé et accusé comme étant le berceau du terrorismemondial,mais il s’avère en réalité, celui qui a plus subi dans les faits les aléas directs et indirects du terrorisme. C’est dans ce contexte que la plupart des pays arabes se sont inscrit tambours battant dans "la guerre contre le terrorisme" mais sans véritable adhésion réelle. Cette politique par contre est devenue un enjeu politique interne et externe. Le choix de "l’immobilisme", du "statuquo" et "l’absence d’initiative" de la part du monde arabe répondent aux contraintes d’être en même temps cible et au cœur de "la guerre contre le terrorisme". / Terrorism has become an illness of the modern World-System. How to rethink the act of terrorism has become an urgent question because it seems that the non understanding is dominant if not triumphant. Thus the necessity to see the terrorist act "included and overcame rather than felt with fantasy". The American policy has remobilized the world around the security objectives to intervene in the international policy. American security policies, based on the reinforcement of exceptional juridical legislation on global techniques of surveillance and on the military mobilization, have led to public liberties, with unprecedented tutoring (USA Patriot Act, Project Patriot Act, Homeland of security, National Strategy of Security) and the establishment of a real international exception state. Refractory to the American antiterrorist logic "war against terrorism", the European Union members have claimed before to be their allies: "we will fight terrorism by the law and in the frame of law". This logic has quickly made the allies adopt the American model. In reality, it is the Arab World that has suffered the consequences of terrorism. The events of the September 11, 2001 have thrown projectors on Islam as a source of terrorism although the Arabs and Muslims were the first targets of Islamic terrorism, and the first to suffer the consequences. One of the effects of this situation is the mitigated and ambiguous reaction of the Arab and Muslim opinions about the September attack. It is in this context that most of the ArabWorld has been inscribed in "War against terrorism" without almost any motivation but with a lot of hesitation because of the pressure made by the international coalition and especially the American one. Indeed to side this position presupposes a recurrent reality in the Arabs political and strategic choices. The choice of "immobilism" of the "statuquo" and "the absence of the initiative" answers to constraints to be at the same time a target and at the center of the "war against terrorism".

Human Rights in Times of Social Insecurity: Canadian Experience and Inter-American Perspectives / Derechos humanos en tiempos de inseguridad ciudadana: experiencia canadiense a la luz del derecho interamericano

Canada’s experience in the war against terrorism goes back to the seventies, and continues to develop nowadays, with the last direct terrorist activity in 2017. The Canadian Government reacted to these terrorist attacks by enacting a number of statutes that reflect a changing international paradigm in relation to the fight against terrorism. Fundamental rights and liberties such as the freedom of expression, the right to private life and to personal freedom have been curtailed by these legislative measures. The practical consequences of these measures are analyzed via a comparative examination of the Inter-American System of Human Rights. In general terms, the war against terrorism produces significant impacts over the human rights. / La experiencia de Canadá en la lucha contra el terrorismo se remonta a inicios de la década de los setenta y se desarrolla hasta la época actual (los acontecimientos más recientes han tenido lugar en el año 2017). Las medidas legislativas fueron la vía adoptada por parte de Canadá para contrarrestar los ataques y reflejar el cambio de paradigma político en la esfera internacional con relación al fenómeno del terrorismo. Derechos fundamentales como el derecho a la libre expresión, a la vida privada y a la libertad personal se encuentran particularmente afectados por estas medidas. Un análisis comparativo del sistema canadiense y el sistema interamericano permite identificar las consecuencias de estas medidas. En términos más amplios, la lucha contra el terrorismo genera impactos significativos sobre los derechos humanos en general.
