The Constitutionality of rule 25 of the CCMA Rules / Nkhone Rhyme Nchabeleng

This study focuses on the impact of legal representation in general as well as on CCMA proceedings involving unfair dismissals relating to conduction on capacity. The study also touches on the common law position before the enactment of Labour Relations Act 28 of 1956 and Labour Relations Act 66 of 1995. Rule 25 of CCMA rules which makes provision that legal representation at CCMA arbitration proceedings relating to fairness of dismissal and party has alleged that the reason for dismissal relates to the employees conduct on capacity, the party is not entitled to be represented by a legal practitioner. The dissertation analyses the effect of this provision on the Constitutional rights to legal representations well as rights relating to fair procedure. Refusal of legal representation in certain instances is justified in the right of legislative requirements on obligation placed particularly on the arbitrator legislative measures which, justifies refusal of legal representation at CCMA that cannot be imposed without giving consideration to the Constitution. The study will highlight the South African case on position with regards to legal representation at CCMA. A literature study will be done using current and researched sources such as textbooks, law journals, and legislation, case law, conferences papers and internet sources. L'arbitrage commercial international et les garanties procédurales

Cette recherche aborde un sujet complexe, qui est en plein débat doctrinal en droit de l'arbitrage international: L'arbitrage commercial international et les garanties procédurales. Au fait, l'arbitrage commercial international revêt le mode traditionnel des règlements de litiges du commerce international et des relations économiques internationales. À cause de l'hybridité de sa nature (contractuelle et juridictionnelle), il est le plus souvent préféré par les parties aux tribunaux étatiques. Cette faveur vis-à-vis de ce mode de règlements de litiges internationaux s'explique par le développement de l'économie internationale, par la globalisation du marché, par la conclusion de nombreuses conventions internationales en la matière, par la création des centres d'arbitrage, enfin par la modernisation des lois et règlements nationaux. En revanche, il est constaté que l'arbitrage souffre d'un déficit de prévisibilité et de certitudes pour les acteurs du commerce international. Que l'on songe seulement à la multiplication des rattachements législatifs et des contrôles judiciaires: conflits de lois, conflits entre les règles de conflits, etc. Nous avons démontré que la solution aux difficultés de la méthode conflictualiste serait l'harmonisation de la procédure arbitrale internationale et que ce mode de règlement de différends débouche de plus en plus sur le rapprochement entre traditions juridiques différentes (Common Law et droit civil).Toutefois, ce mouvement de convergence est loin d'être achevé. Beaucoup d'autres pratiques arbitrales continuent de garder l'empreinte de la diversité des procédures étatiques et celle des grands systèmes juridiques mondiaux. / This research work tackles a complex subject, which is in the heart of a doctrinal debate in International arbitration Law: International Commercial Arbitration and procedural safeguards. In fact, International Commercial Arbitration is a traditional method of dispute resolution in International Trade and International Economic Relations. Parties to a dispute would rather prefer this mode of dispute resolution to state courts because of its hybrid nature (contractual and judicial).One can explain this preference for this method of international dispute resolution by the development of the international economy, the market globalization, the conclusion of numerous international conventions in the domain, the creation of arbitration centers, the modernization of national laws and regulations. By contrast, one can note that arbitration lacks predictability and certainty for parties in International Trade. One can just think of the multiplication of legislative attachments and judicial controls: conflicts of laws, conflicts between methods of conflicts of laws, etc. We have demonstrated that the solution to the difficulties of the conflictualist method would be the harmonization of the International Arbitral Procedures and that this method of dispute resolution would lead, more and more to the approximation between different judicial traditions (Common law and Civil Law). However this convergence movement is far from being achieved. Many other arbitral practices do still keep the imprint of diverse state procedures and of major legal systems worldwide.

This Dissertation is focused on issues concerning the position of an expert in international arbitration proceedings and in international investment disputes. Unlike proceedings conducted before general courts of law, arbitration proceedings have a number of advantages, and therefore they are used very often to resolve disputes in this area, and arbitration proceedings are used almost exclusively with regard to resolution of disputes relating to international investments. The aim of the Dissertation was an analysis of dispute resolution in arbitration proceedings from the expert's point of view and the expert's position in this procedure. It is without any doubt that experts can help arbitrators to reach a qualified resolution of disputes in a significant way. At first, the Dissertation deals with general and historical issues, such as comparison of methods of dispute solution where an international element appears, in both arbitration and judicial proceedings, and it lists the advantages of arbitration proceedings as well. Forgé pour traduire juridiquement la relation nouée tout au long de l’instance arbitrale entre l’arbitre d’un côté, et les parties à la convention d’arbitrage de l’autre, le contrat d’arbitre est depuis longtemps reconnu par la doctrine et la jurisprudence. Sans doute l’origine privée de la mission de l’arbitre alliée à son caractère le plus souvent onéreux, a-t-elle inévitablement contribué à reconnaître l’existence de ce contrat comme une évidence. Cependant, une recherche et une mise à l’épreuve, à la lumière du droit positif, des mérites de l’approche contractuelle de la relation entre l’arbitre et les parties s’avèrent nécessaires. L’étude révèle en effet que le contrat d’arbitre, imposé comme un remède aux problèmes rencontrés par le droit de l’arbitrage à un moment de son histoire, engendre actuellement davantage de difficultés qu’il n’en résout. Cela tient au fait que nombre des obligations de l’arbitre traditionnellement rattachées à ce contrat relèvent déjà de son statut établi par le décret du 13 janvier 2011 portant réforme de l’arbitrage. Il en résulte de nombreuses incertitudes et incohérences mises en lumière à travers l’analyse du contentieux opposant les arbitres aux parties devant les juridictions étatiques de droit commun. À travers une analyse critique du contrat d’arbitre, l’étude se propose d’établir les fondements d’une approche renouvelée de la relation entre l’arbitre et les parties. / The arbitrator's contract is designed to materialize from a legal point of view the relationship built up between the arbitrator and the parties to the arbitration agreement during the arbitral proceedings. In this respect, it has been recognized for a long time by both the doctrine and the case law. It is very likely that the private source of the arbitrator's mission, along with its usually onerous nature, have participated in deeming the existence of such contract a self-evident fact.However, the contractual approach of the relationship forged between the arbitrator and the parties is worth putting to the test in the light of positive law. The study carried out in the present thesis unveiled that the arbitrator's contract, although it has been imposed as a remedy to several difficulties arbitration had once to face, actually leads to more difficulties that it solves. This is due to the fact that various obligations that the arbitrator is considered to have to comply with according to the arbitrator's contract actually preexist as a result of the arbitrator's legal status, in accordance with the Decree of January 13th 2011 on the reform of arbitration law. This results in various uncertainties and inconsistencies brought to light through an extensive analysis of disputes between the arbitrators and the parties that have been brought to State courts. Through critical analysis, this thesis offers to lay the foundation of a renewed approach of the relationship between the arbitrator and the parties.

Esta dissertação estuda a possibilidade de utilização do instituto da arbitragem e sua pertinência na solução de conflitos de consumo. Sabe-se que o processo judicial é o instrumento ordinário existente no ordenamento jurídico brasileiro para solucionar os conflitos existentes na sociedade. Contudo, em razão das dificuldades decorrentes do abarrotamento do Poder Judiciário, como a ineficiência e a morosidade na solução jurisdicional prestada por esse Poder, o Estado vem fomentando a utilização de mecanismos extrajudiciais, onde se inclui a arbitragem. Esse instituto obteve tratamento especial dado pelo legislador brasileiro em 1996, quando foi publicada a Lei de Arbitragem, conhecida como Lei Marco Maciel. Vários doutrinadores e o próprio Estado apresentam a arbitragem como meio extrajudicial célere e hábil para a solução de contendas, inclusive as que envolvem consumidores e fornecedores. Esse estudo inscreve-se, metodologicamente, nas investigações tradicionais do Direito, ou seja, analisa-se as normas contidas na Lei de Arbitragem (Lei n 9.307/1996) e no Código de Defesa do Consumidor (Lei n 8.078/1990) e estuda-se o entendimento de doutrinadores e dados jurisprudenciais. A contribuição dessa pesquisa para o Direito consiste em verificar se a solução dos conflitos onde exista, de um lado, o fornecedor, e, do outro, o consumidor, parte vulnerável da relação jurídica de consumo, cujo objeto refere-se a produtos e serviços, através da arbitragem, atende aos requisitos legais e constitucionais na obtenção de um processo justo, ou seja, pretende-se analisar se há possibilidade legal da utilização da arbitragem na solução de conflitos de consumo e se os interesses e direitos dos consumidores estão sendo realmente protegidos quando as controvérsias consumeiristas são submetidas a essa forma de jurisdição privada / This paper has the objective to study the arbitration and to verify if this extrajudicial way can be used to solve conflicts of consume. The judicial process is main way that is used by Brazilian to get a solution to their problems. However, because of the difficulties that are generated by the Judiciary Power overfill, such as the inefficiency and the slowness in the jurisdictional solution by this Power, the State has been instigating the population to utilize extrajudicial mechanisms, where we can include the arbitration. The Brazilian legislator gave it a special treatment in the year of 1996, when the Law of Arbitration, known as Marco Maciel Law, was published. Many doctrinaires and the State itself present the arbitration as a fast and able alternative way to resolve disputes, including also those that involve consumers and producers. That study is methodologically inscribed in traditional investigations of the Law, that is to say, it analyses rules contained in the Arbitration Law (n. 9.307/1996) and in the Consumer Defense Code (Law n. 8.078/1990) and it studies the doctrine and jurisprudential understanding. The contribution of this search to the Law consists of verifying if the solution of conflicts where exists, in one side, the producer and, in the other side, the consumer the vulnerable part of the consume relation, which object refers to products and services, through the arbitration, attends the legal and constitutional requisites to obtain a just process, that is to say, it is pretended to analyse if there is legal possibility in the use of the arbitration in the solution of conflicts of consume and if the consumers interests and rights are really being protected when the consumer controversies are submitted to that private jurisdiction form

The master thesis first deals with definition of business contractual relationship (sources, formation, freedom of contract) and indicates ways of resolving disputes arising from it within the Czech legal code. Through defining the concept of cross-border element the master thesis attains on how to resolve business disputes over contractual obligations at the EU level. Core topic of thesis deals with jurisdiction in commercial matters, the law applicable to contractual obligations, alternative dispute resolution as well as the recognition and enforcement of judgements or of different rulings. The last part of the thesis deals with a practical procedure which shows how to resolve dispute between domestic businessman and foreign businessman via legal proceedings.
