Location Of Sinkhole Confining Breach Using Groundwater Flow Patterns Derived From Cone Penetration Testing

Dynamic forces in the hydrologic cycle move underground water through Florida's carbonate rocks dissolving chemical components of the rocks, leaving behind caves, solution pipes, and other voids that result in a karst terrain. Ravelling is the common subsidence mechanism throughout most of Florida where unconsolidated materials filter downward into voids in the underlying limestone. A cavity in the overburden develops and enlarges over a period of many years. The enlarged cavity is also known as sinkhole. The investigations of sinkhole characteristics and potential involve studying the regional geology, hydrology and mapping historic sinkholes that have occurred in the area. Use of Cone Penetration Test (CPT) soundings, in conjunction with conventional soil borings are becoming more common in the assessment of subsurface soil conditions in the vicinity of sinkhole-related ground surface. The penetration resistance data by CPT can determine the presence and extent of raveled soil zones characteristic of sinkhole features, and the penetration pore water pressure data can be used to determine the integrity of the clay confining unit at each test sounding location. The objective of this study is to identify the possible location of the confining breach at a sinkhole in Seminole County. The methods used in the assessment of the sinkhole's subsurface conditions were Standard Penetration Test (SPT), which provided information that helped to identify the location of the ravelled zones within the soil profile, and Cone Penetration Test that gave information of the piezometric water levels obtained from the pore pressure dissipation curves. The total head was calculated from the piezometric water levels corresponding to the different elevations. The data were found to exhibit a downward behavior of the total head, starting at around elevation 50 feet, NGVD that extended towards lower elevations. The SPT boring log identified a ravelled zone starting at 31 feet approximately. From both information it was possible to establish that the hydraulic head was influenced by the proximity of the ravelled zones, where the head precipitated rapidly as the elevation decreased. From the result of this study, it was concluded that the location of the breach in the confining layer started at 61.8 feet deep below the ground surface. Potentiometric contour lines at elevation 24.40 feet denoted flow patterns of water from the surroundings of the depression towards the approximate location of the center, which is the existing of subsurface cavity.

An Experimental Study of Psychological Contract Breach: The Effects of Exchange Congruence in the Employer - Employee Relationship

Although the psychological contract has been a popular topic in managerial research for the past twenty years, recent critiques of the research in this area point to several shortcomings. These are believed to result primarily from the overwhelming use of field studies, survey questionnaires, and other correlational procedures in the study of this construct. One particular research question that has generated mixed results involves the effect that one's underlying contract (either transactional or relational) has on individuals' perceptions of contract breach and feelings of violation following an employer's breach. This study sought to gain insight into this question by using an experimental study design to assess the impact that exchange congruence — or the match between the nature of the underlying contract and the nature of the breach — has on employees' perceptions of breach and feelings of violation. An experimental design was used and data was collected from 421 subjects in six treatment groups and two control groups. The treatment groups examined the effects of withdrawal breach (without resource substitutions) and both congruent and incongruent resource substitutions in transactional and relational work contexts. Also, two control groups in which no psychological breach was induced were examined. The results of the experiment differ for the transactional and relational treatments. No significant differences in perceptions of breach or violation were found with regard to the type of breach induced among the transactional treatments. Among the relational treatments, subjects that received incongruent resource substitutions perceived significantly higher levels of breach and violation than those that received congruent substitutions. Also, among the relational treatments, levels of perceived breach were significantly higher for the incongruent substitute treatment than for the withdrawal breach treatment. Therefore, the results of this study indicate that breach perceptions and feelings of violation vary for employees depending not only on the type of contract they hold, but the type of breach that they experience. In addition, the study demonstrated that an experimental design is applicable to this literature and that it could advance our understanding of the psychological contract in ways that are not possible with cross-sectional field studies. / Ph. Efficient breach theory – a análise do rompimento eficiente dos contratos empresariais à luz da legislação brasileira e da law and economics

O presente trabalho examina a teoria da quebra eficiente do contrato, oriunda do direito anglo-saxão, segundo a qual, sinteticamente, um contrato só será cumprido se os custos para adimplir a obrigação forem inferiores àqueles incorridos pelo descumprimento, admitindo-se, portanto, o inadimplemento voluntário dos contratos. O objetivo é, além de apresentar a teoria, verificar a possibilidade de aplicação da mesma no Brasil, com enfoque especial nos contratos empresariais. Para tanto, o trabalho é estruturado em introdução, quatro capítulos de desenvolvimento e encerra com a conclusão. Superada a introdução, que apresenta mais profundamente as razões que levaram à pesquisa sobre o tema, o capítulo 2 versa acerca dos paradigmas clássicos de responsabilidade contratual, com destaque às modalidades de extinção do contrato sem a consecução do seu objeto bem como às regras indenizatórias aplicáveis nestes casos, em que se busca cotejá-las com o entendimento jurisprudencial. A seguir, o capítulo 3 traz as premissas teóricas da Law and Economics focadas no Direito dos Contratos necessárias à compreensão, no capítulo seguinte, da teoria da quebra eficiente do contrato, que representa o tema central do presente estudo. Les modes amiables de rupture du contrat de travail sont en plein essor. Même si la rupture amiable de la relation contractuelle, issue de l’article 1134 du Code civil, est reconnue depuis plusieurs décennies, son manque d’appréhension par la législation sociale en limite l’usage alors même que son efficacité, en ce qui concerne les contrats de travail à durée déterminée et le contrat d’apprentissage, n’a plus à être prouvée. Le regain actuel que connait ce type de rupture résulte de la création d’un nouvel acte par la loi de modernisation du marché du travail du 25 juin 2008. La rupture conventionnelle, voulue comme un acte permettant d’assurer la sécurité de la cessation relationnelle, a redonné confiance, aux employeurs et salariés, en l’utilisation du consensualisme lors de résiliation du contrat qu’ils ont créé. Ainsi, sans véritablement remettre en cause l’existence de la rupture issue du droit commun, la rupture conventionnelle semble être l’acte le plus à même de mettre fin à l’hégémonie des actes unilatéraux de rupture / The ways to break a work contract amicably are booming . Even if the amicable break of the contractual relationship , from Article 1134 of the civil code , has been recognized for several decades , its lack of real understanding and use by the social legislation limits its use , even though its effectiveness,regarding the fixed period employment contracts and the training contract does not need to be proven any more ! The current revival of this way to break a contract comes from the creation of a new act : the 25 th june 2008 modernization of the labour market law . The conventional breach, supposed to be an act which permits to reinforce the safety of the relational breach has boosted the confidence of employers as well as employees, when the use of consualism , they had created, has to be broken .So, without really putting into question the breach itself the origin of which being the common law, the conventional breaking is the most likely act to put an end to the hegemony of unilateral acts of breach
