La réception par la jurisprudence de la législation sur le crédit à la consommation / The reception by the jurisprudence of the legislation on the consumer credit

Le consommateur, lorsqu’il souscrit un contrat de crédit pour les besoins de sa vie courante, achat d’une automobile par exemple, bénéficie d’un certain nombre de protections. Différentes sources du droit sont susceptibles d’être articulées : les mécanismes du droit commun des contrats présents dans le Code civil, mais aussi une législation spéciale, née de la loi dite SCRIVENER I du 10 janvier 1978, présente dans le Code de la consommation. Cette législation spéciale, bien que récente, a été modifiée à plusieurs reprises, la dernière modification d’importance étant la transposition en droit français de la directive européenne du 23 avril 2008 par la loi du 1er juillet 2010. Le droit du crédit à la consommation est un droit jeune, dense, foisonnant, ambitieux, qui revendique un haut degré de protection du consommateur et fait du formalisme son cheval de Troie. Mais c’est aussi un droit de passion, élaboré souvent dans l’urgence, sensible politiquement, médiatisé, objet de lobbies, parfois maladroitement rédigé ou transposé, approximatif, lacunaire. Au sein de la Cour de cassation, c’est à la Première Chambre civile qu’il appartient de connaître des questions en lien avec le droit de la consommation. Dès lors, comment la Première Chambre civile parvient-elle à manipuler ce droit spécial du crédit à la consommation ? Parvient-elle à en gommer les défauts, à en pallier les manques ? Comment articule-t-elle les protections en présence ? Doit-elle faire face à des résistances de la part des juridictions du fond ? Dans cette tâche unificatrice, le droit commun lui apporte-t-il un secours bienvenu ? Et la CJUE ? In fine, le consommateur emprunteur est-il protégé efficacement ? / Consumers often engage themselves in a consumer habit in order to purchase domestic appliances or furniture. They can stand by protection when the parties begin to negociate and during the whole life of the contract. Consumer protection can be effected through a multiplicity of rules. First of all, there are the common rules. This rules are in the Code civil. A special law for consumers was born during the seventies. The first consumer credit law in France was the SCRIVENER law, 1978. Often modified since this date. The last significant modification resulted from an European directive, which was transfered by a law n°2010-737 on first july 2010. The main purpose of my research is to observe how the Cour de cassation articulates special and common rules. Does the special law really protect consumers ? Special law is very formal. Is it a chance or a problem for consumers ? If it is a problem, how the Cour de cassation can get around it ? Are common rules useful ?

The subject of this comparison is the substance of the law clauses but also the overall level of legal protection, consistency, system and comprehensibility of the laws and quality of european directives implementation. The thesis is divided into chapters - definitions, information, advertising, consumer contracts, safety and quality of products and consumer associations. In the conclusion some potential changes that could be made to czech system, based on good experience in Italy, are suggested.

The main objective of my diploma thesis was to explain the principles and basic terms of drug policy in the Czech Republic, and to illustrate all the issues of government regulations in this area. This paper is trying to confront two different kinds of health services. The first one based on liberal principles, without any government intervention (system in USA), and the second one demarcating with regulations and restrictions, devoid of any free market fundamentals (system in EU). It describes the relationship between patient and doctor, and points out the different number of information, they dispose of. This paper is trying to explain the problem of skewed distribution of information in society. It presents how the government regulations in the free market area destroy the source allocation efficiency and goes against the satisfaction of customers' needs.

Is described the Project of the Ministry of Industry and Trade for Ensuring Out of Court Settlement of Consumer Disputes which presents new opportunities for Czech consumers. The analytical part of the work represents an analysis of the functioning of the two-year pilot phase of Project, an evaluation its results on the basis of statistical data on the number of complaints, on the basis of results of ADR questionnaire and on the basis of results of questionnaire surfy aimed to general awareness about the Project. Obtained data are evaluated and suggested solutions to improve the operation of the Project.

In this thesis we explore the importance of consumer protection (concretely protection against misleading advertising and minimal quality standards of product) for providing consumers' utility. Our target is to discover whether these protections are necessary for providing consumers' utility or not, and whether are the consumers able to provide themselves equal or higher utility (then can mentioned protections do), scilicet through their mutual communication and buying behavior. Furthermore, we want to discover, if can happen a situation in which the mentioned protection decline the consumers' utility, in comparison with situation, when no protections exist. These conclusions are stated for concrete product (LCD TV) and concrete society (little community within the Czech Republic society), whereas we explore the influence of consumer protection both on utility of whole community and on utility of each social class within different proportions of these classes within society. For this research has been created an original multi-agent model, in which we simulate consumer behavior and companies behavior on market. The important parts of the model architecture are presented in this thesis: principles of social structure creation (based on the knowledge about social groups and different types of social ties), buyer behavior and principles of consumer communication through social network, and decision of companies about product characteristics. In conclusion we have interpreted the simulation results and have stated an importance of consumer protection in tested society buying tested product.

Consumer protection is one of the recent trends in the private law and goes nowadays through very dynamic development. Its driving force is especially the European law through directives of the European Parliament and the Council. The necessity of their transposition greatly influences our national law. The last change was an adoption of the Law no. 89/2012 Sb., the Civil Code. The aim of this thesis is to analyze the information duties of entrepreneurs which have been adopted to protect consumers. The thesis evaluates whether the given regulation does not burden disproportionately entrepreneurs on the one hand and provides an adequate protection for the consumers on the other hand. The thesis also deals with the consequences that may arise in particular cases for failure to comply with the information duties.
