Spotřebitel a jeho ochrana v soutěžním právu EU / Consumer and its protection in EU competition law

The submitted work concerns itself with the topic of protection of consumers and their welfare as an objective of the EU competition policy, as well as with the regulation of EU competition law and the way in which this objective has changed over time, both in fact and in legal perception. The first, theoretical, part of this thesis explains concepts essential for this analysis - the concept of "consumer" and its specifics in the context of the EU competition law, the definition of "consumer welfare" and the general relationship between consumer protection law and competition law. The second part deals with the historical development of consumer protection as an objective of EU competition policy. Particular attention is paid to the progress made in understanding the importance of this objective over time. An emphasis is placed on it in the political declarations of the Commission's representatives and subsequently, whether and how these political declarations and efforts were reflected in the actually adopted documents of competition law. This section therefore analyses the processes that formed the ideological basis for consumer protection under competition law and how they were reflected in formal sources of law. Does information form(at) matter? Consumer response to mortgage disclosures

On October 3rd, 2015, the Consumer Financial Protection Bureau changed the presentation of information within mortgage disclosures such that monthly payments and upfront costs are more salient. Using proprietary bank account data, I document that after closing on the mortgage, treated consumers receiving the re-designed disclosures log in more into their liquid checking accounts, spend less on debit cards and cash, but spend more on credit cards. I argue that the more salient disclosures caused consumers to prioritize having funds to make monthly obligations. Accordingly, I find that liquidity constrained consumers reallocate more of their debit card and cash spending to credit card spending. Other channels related to underestimation of mortgage costs, financial advice, and regulatory enforcement cannot fully explain the results. The reform benefits consumers as they do not accumulate credit card charges despite making more timely mortgage payments. The results collectively demonstrate that modifying information presentation is a low-cost way to change consumers’ behaviors.

Knowledge of consumer rights and unfair and deceptive practices: a comparison of older and younger consumers

The problem of this study was to measure older and younger consumers' knowledge or awareness of selected consumer rights and legal protections, and their perceptions of and experience with unfair and deceptive business practices. A 34-item instrument was developed and administered by telephone to a random sample of 1,305 consumers nationwide. The data were examined by analysis of frequencies, Chi-square, and analysis of variance. The findings revealed (p<.01) that consumer knowledge was related to the age and marital status of the respondent. Married consumers and consumers aged 25-49 were the most knowledgeable about the eight consumer laws and legal protections. Consumer experiences with unfair and deceptive business practices were related to age, marital status, and gender. Younger, married, and female consumers had experienced three or more of the unfair and deceptive business practices. Married consumers and consumers aged 25-74 are more perceptive than consumers aged 75 and over in correctly identifying a business practice as unfair or illegal. The gender of the respondent does not always influence their perceptions of whether or not a particular business practice is fair. Significant differences existed between the knowledge score means and the age and marital status of the respondent. Regulation of fixed-term contracts under the South African Consumer Protection Act 68 of 2008

In this thesis the position of parties under a fixed-term agreement under section 14 of the Consumer Protection Act 68 of 2008 is analysed critically. The purpose of this thesis is first to establish whether parties to a fixed-term agreement are better protected in terms of section 14 of the CPA when the consumer needs to terminate the contract based on the material failure to perform by the supplier, than under the common law. Second, this thesis explores whether the maximum duration of fixed-term agreements should be limited by statute. Various aspects affecting parties to these agreements, for instance the freedom to contract, pacta servanda sunt, and standard-form agreements, are considered. The South African position is then compared to the position in Singapore under the Consumer Protection (Fair Trading) Act, and to the United Kingdom under the Consumer Rights Act, to gain perspective and objectively evaluate the provisions of section 14 of the Consumer Protection Act 68 of 2008 to establish whether South Africa can benefit from lessons learnt from these jurisdictions. Finally, principle-based amendments to the provisions of the CPA are recommended to improve the position of the consumer under fixed-term agreements to effect best practice solutions and ensure adherence to the aims and purposes of the Consumer Protection Act 68 of 2008 and international guidelines. This thesis is based on the law as at 18 June 2020, found in sources available in South Africa, and Singaporean law available in the database of the National University of Singapore. / Hierdie proefskrif is ’n kritiese analise van die posisie van partye tot vastetermynkontrakte ingevolge artikel 14 van die Suid-Afrikaanse verbruikersbeskermingswetgewing, die Consumer Protection Act 68 van 2008 (CPA). Die doel van die analise is eerstens om vas te stel of partye tot ’n vastetermynkontrak ingevolge artikel 14 van die CPA beter beskerming geniet ingevolge die CPA wanneer die verbruiker die vastetermynkontrak moet beëindig weens die wesenlike wanprestasie deur die verskaffer, as ingevolge die gemenereg. Tweedens ondersoek die proefskrif of dit wenslik is dat die maksimum duur van vastetermynkontrakte deur wetgewing beperk word. Verskeie aspekte wat die posisie van partye tot vastetermynkontrakte beïnvloed word ondersoek, onder andere kontrakteervryheid, die leerstuk pacta servanda sunt en standaardkontrakte. En el presente trabajo de suficiencia profesional se han analizado los problemas jurídicos más importantes de dos casos uno de naturaleza pública y otra privada. En cuanto, al expediente de protección al consumidor se tiene como controversia si el proveedor ha vulnerado o no el derecho a la información sobre los precios de los productos y servicios que ofrece, así inicialmente la Comisión de Protección al Consumidor sancionó al proveedor por vulnerar el artículo 5, inciso 3 del Código de Protección y Defensa del Consumidor pues no se había exhibido la lista de precios al exterior del establecimiento; no obstante, la Sala Especializada en Protección al Consumidor consideró que sí era suficiente que el proveedor (para el tipo de servicio que se realizó) exhiba los precios al interior y que no se vulneraría la norma antes referida. De otro lado, en el expediente de naturaleza privada se tiene como problemas principales la asignación de la tenencia a favor de un menor al padre, así como la aplicación de la flexibilización de la congruencia pues la parte demandada no solicitó la tenencia a su favor. Ello en la medida que en la primera sentencia de vista se otorgó tenencia a favor de la madre demandada pese a no solicitar tenencia del menor, lo que se declaró nulo por parte de la Corte Suprema al considerar que se habría vulnerado el debido proceso. Por tanto, en ambos casos se verificará si la normativa se interpretó adecuadamente y si se aplicó la que fuera pertinente; además verificar una correcta valoración de los medios probatorios. / Trabajo de suficiencia profesional

Consumer Contracts Focusing on Sales Contract - Comparison of Old and New Legislation Consumer contracts as contracts concluded with consumer who is the weaker party make integral part of our everyday life. Although we usually consider consumer protection an area of contractual law, it is a category with an overlap into commercial, european, criminal and administrative law. Consumer law which is strongly affected by EU legislation stands on the border between private and public law. Practical aspects of consumer law, however, do not in any way exclude its main purpose - seeking justice, i.e. balancing equality on one side and freedom on the other side. This branch of law is even more topical nowadays as we are exposed to advertising anywhere. Moreover we are experiencing financial crisis at the moment when most of people are suffering from lack of money which sharply contrasts with insufficient financial knowledge of Czech population. Legislation changes slowly and does not correspond to the development of society. Reality is then quite different to the way we know it from textbooks. Building savings - legal and economical issues The aim of the thesis is the analysis of selected problematic issues - crucial to the functioning of building savings and also in relation to consumers and protection of its rights. The thesis is composed of six chapters which are dealing with legislation of building savings, especially with amendment in historical development with inheritance, with deposits of minors and valid way of terminating the contract of minors, with the bank charges in the context of preparatory transposition of 2014/17/ EU Directives on housing loans, and compares the economic aspects of both component of building savings with competitive products in the financial market. In the thesis I use the method of analysis, synthesis and induction in chapters in which I work with jurisprudence and in which I advocate a position of building savings in the banking market. In anticipation of the upcoming law on housing loans I require to include information obligation into the proposed legislation with emphasis not only on formal form but the content of communication.
