An assessment of South Africa's obligations under the United Nations Convention against torture

Magister Legum - LLM / I attempt to analyze South Africa's legal position pertaining to torture, in relation to the international legal framework. Since it has been established that torture and cruel inhuman and degrading treatment (CIDT) usually occur in situations where persons are deprived of personal liberty, I examine legislation, policies and practices applicable to specific places of detention, such as correctional centres, police custody, repatriation centers, mental health care facilities and child and youth care centers. I establish that although South Africa has ratified the UNCAT and is a signatory to the OPCAT, our legal system greatly lacks in structure and in mechanisms of enforcement, as far as the absolute prohibition and the prevention of torture and other forms of cruel and degrading treatment or punishment are concerned. I submit that South Africa has a special duty to eradicate torture, since many of its citizens and several of its political leaders are actually victims of torture, who suffered severe ill treatment under the apartheid regime. I argue that the South African legal system is sufficiently capable of adopting a zero-tolerance policy toward torture and to incorporate this with the general stance against crime. In many respects, South Africa is an example to other African countries and should strongly condemn all forms of human rights violations, especially torture, since acts of torture are often perpetrated by public officials who abuse their positions of authority. I conclude by making submissions and recommendations for law reform, in light of the obstacles encountered within a South African context. / South Africa

I uppsatsen analyseras filmerna Thriller – en grym film och Exponerad utifrån feministisk teoribildning. Analysen utgår ifrån Laura Mulveys ”Visuell lust och narrativ film” och de freudianska analysverktyg vilka artikeln erbjuder. Dessa ställs vidare emot ytterligare feministisk forskning vilken möjliggör en diskussion kring den psykoanalytiska feministiska filmteorins trovärdighet. / This paper analyzed the films Thriller - a cruel picture and Diary of a rape with feminist theory. The analysis is based on Laura Mulvey Visual pleasure and narrative cinema and the Freudian way of analysis this article offers. These theories are also put up against further feminist film studies which enable a discussion of the psychoanalytic feminist film theory's credibility.

The Evolution of Warfare, the Laws of War, and the Ethical Implications of U.S. Detainee Policy in the Global War on Terror and Beyond

Approved for public release / The atrocities committed by Americans at Abu Ghraib shocked the collective American moral conscience. Guilty of inhumane treatment of its prisoners there, Abu Ghraib did immeasurable damage to U.S. credibility and made clear that American detainee policy is off-track and needs to comply with objective standards of law, morality, and operational effectiveness. The emotional aftermath of 9/11 created a politically permissive environment within which the military organizational structures was unsuited for the critical tasks assigned to them relative to the context of the Bush Administration’s “new paradigm.” Two issues sit at the forefront of the political context of U.S. detainee policy: war powers and human rights. This thesis will utilize a synthesized decision-making model to analyze the President’s decisions leading to the current detainee policy. Policy alternatives require smaller corrections to bureaucratic process, not a major reorganization of bureaucratic structure. This thesis will provide policy-makers with a moral and legal framework for a corrected detainee policy. Adoption of the full framework of the 1949 Geneva Conventions, including U.S. ratification of Additional Protocols I and II (1977), provides the best framework to combat transnational insurgency, while retaining the moral and legal high ground required of the world’s superpower. / Major, United States Air Force

General approach of international law to torture Abstract The prohibition of torture exists at national and international level. The author focuses only on the general approach of international law to torture. He analyzes the individual elements of the definitions of torture contained in international documents. At the same time, he does not forget to mention the cruel, inhuman or degrading treatment or punishment that is inextricably linked to torture. He also highlights the importance of the threat of torture, which may under certain conditions separately constitute torture. He provides an overview of the current international regulation of the prohibition of torture enshrined not only in international human rights treaties, but also in the field of international humanitarian law and international criminal law. He also emphasizes the reflection of international regulation in the practice of individual protection mechanisms ensuring effective control over compliance with the prohibition of torture, specifically universal, European, Inter-American, African and other functioning mechanisms. Also, he places torture in the context of crimes under international law. Stuck in the Impasse: Cynicism as Neoliberal Affect

<p>Recent work in affect theory has addressed the category of what Sianne Ngai terms “ugly” feelings (Ngai 2007, Edelman 2004, Halberstam 2011) and the costs associated with the premium placed on so-called positive modes of thinking and feeling (Berlant 2011, Ahmed 2010, Love 2007), yet cynicism persists in many accounts as the feature of an undesirable political subjectivity. Likewise in popular and political discourse, cynicism is denounced as the mark of an ineffectual subject who chooses to opt out, rather than reach for supposedly obvious markers of (capitalist) achievement. This dissertation refuses these characterizations, instead considering cynicism as an affect bound up in neoliberal sociopolitical shifts. I argue that cynicism describes a feeling of living under structural conditions that curtail—in ways that are often effaced—the kinds of self-determining subjectivities that have been taken for granted as a feature of Western, liberal democracies and remain foundational to imagined modes of dissent. Exploring this situation in the context of three cultural frames—politics and governance, modes of labour in capitalist economies, and a structure of feeling premised on the pursuit of happiness—I examine cynical subjectivities in fiction, film, and American political discourse so as to 1) develop an inquiry into affect as situated between subject and structure; 2) acknowledge the commonality of a feeling of impasse and dominant cultural narratives that mask this frustration of agency; and 3) consider inertia and passivity as sensible orientations in a cultural moment in which the costs of momentum are becoming increasingly visible.</p> / Doctor of Philosophy (PhD)

The South African death sentence under a new constitution

Although s 9 of the new Constitution 1 guarantees the right to life, there is no express provision which abolishes the death sentence. Whereas in the past the death sentence could only be avoided by the exercise of judicial discretion or political and public pressure, its imposition will now have to be entirely re-evaluated. Not only are all the laws of the country subject to the new Constitution, 2 but so too a Constitutional Court will be operational which will have the power to test the constitutionality of any such laws. By looking at the standards and relevant issues which are considered to define the constitutionality of the death sentence internationally, reviewing current application of the death sentence in South Africa, drawing comparisons, and by studying the problems unique to the South African situation, it will be the aim of this dissertation to determine how the death sentence will fare under a Constitutional Court. / Criminal & Procedural Law / LL. No contexto contemporâneo que busca a produção de novos conhecimentos a partir do passado, esta tese procura redimensionar as informações que se tem sobre a escritora mais popular do Brasil entre o final do século XIX e as duas primeiras décadas do século XX, Júlia Lopes de Almeida, contribuindo para enriquecer tanto a Literatura Brasileira quanto nosso patrimônio cultural. O trabalho seguiu duas linhas paralelas. Uma, historiográfica, na qual propus acrescentar informações relevantes sobre a vida da escritora carioca e sua trajetória na “República das Letras” brasileira. Isto incluiu apresentar aspectos particulares de sua escrita, temas e visão de mundo, considerados a partir de sua ótica feminina. Como resultado da pesquisa realizada no Brasil e em Portugal, pontuei os aspectos mais relevantes da recepção crítica de sua obra, no passado e no presente. Neste viés, apresentei material jornalístico e crítico em que ela e sua obra foram avalizadas no tempo em que viveu. Em relação ao presente, dei relevo à crítica acadêmica, integrada ao movimento de resgate das escritoras brasileiras do passado, apresentando de forma panorâmica as abordagens que estão sendo feitas e que demonstram a validade de sua produção para a cultura brasileira. Na segunda linha de trabalho, mais investigativa, busquei uma abordagem do texto romanesco selecionando três de seus romances para integrarem o corpus de análise: Memórias de Marta (1889), A Família Medeiros (1892) e Cruel Amor (1906). Com este propósito, rastreei indícios que pudessem revelar o posicionamento estético-ideológico de Júlia Lopes no qual se reflete a leitura que ela fez da sociedade de seu tempo e das questões mais importantes que estavam em pauta. Para isso, trabalhei com conceitos da narratologia dando destaque à categoria do narrador e a da VOZ. / In the contemporary context that searches new knowledgement looking back to the past, this thesis intends to (re)mesure the information about the most popular female writer betwen the two final decades of the XIX century and the two first of the XX: Júlia Lopes de Almeida. I intend to contribute to improve Brazilian Literature patrimoniun. My work goings on in two paralels lines. An historiographic one, in which I bring more information about the writer´s life and her trajectory in the “República das letras”. It includes to present some particulary aspects from her writing, themes, world vision, considered from a female otic. In this chapter, I brihg the information I collected as a result of two travels.One to Rio de Janeiro and the other to Portugal. In the other hand, I underline the academic critic with the brazilian female writers rescue movement. As a second line of investigation, I propose a textual aproching over three of her novels: Memórias de Marta, A Família Medeiros e Cruel Amor. I look for her aestetic and ideological statements in wich I can see her opinion about the most important questions that are presented in the society of her time. For that, I work with narratological conscepts and investigate the narrator category.
