Val av disciplinpåföljd för fastighetsmäklaren - Erinran, varning och återkallelse av registrering

Fastighetsmäklarens yrkesroll regleras av de bestämmelser som finns i FML och ska omsorgsfullt iaktta god fastighetsmäklarsed enligt 8 § FML. Om en fastighetsmäklare bryter mot hens skyldigheter som anges i FML så kan en disciplinpåföljd tilldelas. Det finns tre disciplinpåföljder som en fastighetsmäklare kan bli tilldelad; erinran, varning eller återkallelse av registrering. Anledningen till att det finns ett system av disciplinpåföljder är för att fastighetsmäklare innehar ett så kallat förtroendeyrke. Det är särskilt viktigt för både köpare och säljare i en fastighetsöverlåtelse att de kan lita på att fastighetsmäklaren gör sitt arbete omsorgsfullt. Gränsdragningen bedöms enligt nedan.Erinran meddelas där en skyldighet finns, men där bristen anses vara mindre allvarlig exempelvis när mäklaren har brustit i sin yrkesroll men ingen av parterna har lidit skada.Varning meddelas där en skyldighet finns, där agerandet är av så pass allvarlig grad att det påverkar någon av parterna. Återkallelse av registrering meddelas när mäklaren har brutit mot de bestämmelser som finns och är av ytterst allvarlig grad. Exempelvis kan en direkt brottslig handling påverka mäklarens lämplighet och redbarhet och således innebära att mäklarens agerande kräver att registreringen återkallas. / Real estate brokers are covered by the regulations that are presented in the law for real estate brokers and they shall carefully consider what is meant by good habit for real estate brokers. Real estate brokers shall act as an unattached suitor between a party. If a broker act against the obligations that exist, they shall be assigned with a disciplinary sanction. A disciplinary sanction is presented as follow, exhortation, admonition and revocation of the license. The reason for an active system of disciplinary sanctions is because a broker has a profession of trust and it’s of interest for every person involved that they have trust in their assigned real estate broker, and that the broker performs correctly. There is unclearness between the different disciplinary sanctions and what specific sanction that should be assigned for which type of behavior. Therefore, there are good reasons to investigate deeper which type of behavior that are assigned with which type of sanction. With the help of past court cases and the use of a judicial dogmatic method, we have presented what we consider as the delimitation between current disciplinary sanctions. In the court cases presented we examine the specific behavior of the real estate broker and what disciplinary sanctions the court has assigned. The study also thoroughly examines the 29 § in the law for real estate brokers and what requirements are obligated to a real estate broker and when supervision of a real estate broker might be required. In conclusion the study found out that; an exhortation is assigned to a real estate broker that breaks the law, although it does not affect any part. An admonition is assigned to a real estate broker that broke the law and his or her behavior affects a part economically. A revocation of the license is assigned to a real estate broker that is no longer suitable or manageable for the job or if the broker no longer fulfils the requirements for registration.

<p>In the essay, the view of mistakes and disciplinary sanctions within the military aviation and health and medical service, are compared. The comparison shows that military aviation and health and medical service could have several points in common on how mistakes may occur, but that the present view of mistakes is different betwen the sectors. The view of mistakes and disciplinary sanctions is explicit within military aviation, and is based on a clear ideology on how mistakes occur, which is characterised of a systematic approach. Within health and medical service, an explicit and unequivocal ideology on how mistakes occur is missing, but, however, there are implicit ideas about infallibility and perfection. The comparison indicates that the view of mistakes is also, possibly directed by a bureaucratic model (instead of an ideology on mistakes), which aims to legitimacy, but that this may happen on the expense of not taking surrounding circumstances into consideration. In that way there may be a certain contrast in the health and medical service’s present system between rule of law and medical service safety.</p>
