Výběr uchazečů o zaměstnání / The selection of job seekers

The thesis deals with selected legal aspects of the process of selection of job seekers. Through the study of professional literature and other sources, legal regulations and also own small research, the author deals mainly with the issue of the principle of equal treatment and the prohibition of discrimination and protection of personal data. The thesis also describes the job position of the job seeker, the pre-contractual liability and the dishonest behavior of the potential employee and the employer, the ways of getting employees and other connections, because the theme of the thesis is more extensive than it might seem at first sight. The possibilites of the defence are also mentioned. The process of selection of job seekers can not be considered as a purely personalist discipline. The thesis works with legislation such as the Labor Code, the Employment Act, the Anti-Discrimination Act on the Personal Data Protection Act. Although the selection of a prospective employee is the employer's responsibility, employers have to observe the legal requirements, for example, they can not discriminate the job seekers or infringe the privacy of the job seeker unwarranted. This thesis is focused on foreigners employing in Czech Republic with special attention on Prague´s labour market. The influence of foreign workers grows with increasing number of those people. Finding the equal working position for foreigners significantly helps to integrate them to the society smoothly. The main goal was to get and describe responses from working foreigners that reflects current situation of work environment. The main question of this research was: What kind of barriers has to foreigner overcome to be employed in Prague? Next questions were focused on foreigner´s experiences with discrimination from the side of employers. This thesis showing the Prague employer´s attitude to employing of foreigners from third countries, from European Union, European Economic Community and from Switzerland.

Globalization requires a new understanding of the effect of attitudes in the decision making process, particularly when regional differences arise from different cultural and social norms. Information behavior is the part of behavioral economics that explores decision making stakeholders - consumers, businessmen or politicians, under conditions of bounded rationality. For consumers it is primarily important to buy local products from family farms. The aim of the thesis was to verify the effectiveness of that model in the Czech Republic, especially to fill in the empirical aspect of behavioral economics, relating to consumer behavior under unclear information as well as normal environments, thus understanding the indirect effect of perception on product information. Today these issues are gaining in importance in developed countries as well as in the Czech Republic. The high probability of "never researching product information" resides more within consumers with negative attitudes toward global issues (30%) than in consumers with positive attitudes towards those issues (about 1%). Attitudinal changes affect decreases among those "never searching for product information" (by 30%) as well as increasing "search-rates" (by 60%). In other words, the changes in attitude have significant effects on consumer behavior (Spillover effect). Predicting decision making behavior under unclear information also shows important results. Changes of attitude toward nutrient security, milk of origin or ingredients is associated with relative changes in behavior. A change of attitude will reduce the probability to sometimes buy products with unclear (15%) and increases the probability of buying products with clear information (17%). Empirical research of behaviors under uncertainty are long-term projects, however methodologies may vary differentially. By connecting the theory of planned behavior to the theory of information, these theses fill in the issues of behavioral economics theory. The practical implication is a methodological approach of the model.

1 Summary The focus of the thesis are the issues of equal status and equal opportunities for individuals caring for children, i.e., mothers and fathers, as this is an important topic of the current society and working relationships. The reason for that is the gradual transition from the classical family model of the father-breadwinner and the mother-caregiver to a modern dual-breadwinner model, with a significantly more equal position of women in society, in which both parents want to be involved both in the care and upbringing of their children as well as in the working environment. This work compares legal regulations of the Czech Republic and the Nordic countries, namely Finland, Sweden, Norway, Denmark, and Iceland, whose family policies are described in the introductory chapters. Nordic countries have a rather specific approach in the area of family policy leading to a gender-neutral state where gender plays almost no role. They are focused on creating a fairly equal society with a pro-father approach in the form of a strong involvement of men in childcare and education. The other side of such equality is the emergence of discrimination, described in detail in the third chapter. Theme of this diploma work are problems of equal opportunities at the labour market. The first part concentrates on unequality between men and women, causes of different social statuses, basic terms and legislative framework of equal opportunities of men and women in the European Union and the Czech Republic. Overview of present social status of women at the labour market is given by the analysis of basic statistic indicators differentiated by gender. Apart from the European Union, which set up equal opportunities as one of its fundamental goals, important initiators of gender precautions are individual companies. Therefore following parts of my work concentrate on companies' attitude to equal opportunities and first of all on main reasons for implementation of individual precautions and concrete steps, which should support the improvement of present situation. The last chapter deals with costs and benefits consequent upon implementation of equal opportunities and shows those precautions that certify in practice.

Prohibition of diskrimination, constitutional legal level of protection of the rights of ethnic minorities against discrimination Abstract The thesis deals with the concept of discrimination from a theoretical and practical point of view and focuses closely on the issue of ethnic minorities and racism. To clarify the whole issue, the work is presented by the theoretical inclusion of anti-discrimination law in the legal framework of human rights law in both the Czech Republic and the global framework in the form of international agreements. It deals with ideological sources, including the historical origin of law related to discrimination. It also contains a definition of basic concepts, which are necessary to clarify this complex phenomenon. It thematically defines both the legal regulation of individual protection of the individual and the collective concept of protection against discrimination and the rights of ethnic minorities as a whole. The main part of this work refers about case law in the field of discrimination on the grounds of ethnicity or nationality and all other forms of protection against illegal exclusion or segregation. Becker's discrimination theory predicted that the discrimination by employers on competitive markets should cease to exist. However, in past decades, it was shown that discrimination on the labour market is a prevalent phenomenon. In this thesis I analyse what is the impact of agency problem on the theory of discrimination. I show that when an agent (in the thesis called 'agent employer') is deciding whether to employ or not to employ a worker, his motivation is different compared to principal's. The outcome of the analysis is such that under certain assumptions, the agent employer with non-zero taste for discrimination will always choose to discriminate.
