Applying the prohibition of discrimination in employment relations. Abstract This thesis is about discrimination in employment relations. The objective of the text is to concentrate on applying the prohibition of discrimination in fields, where disparate treatment is most common, on the legal means of protection against employment discrimination and on the activities of public institutions, which have been entrusted with supervision over compliance with the principle of equal treatment. The thesis is divided into introduction, five separate sections, which are further divided into chapters, and conclusion. The first two sections are rather theoretical, containing definitions of basic terms, important for overall understanding of the thesis (such as equality, discrimination, harassment and others) and introduction of the EU and Czech Republic anti- discrimination law in employment relations. In the third section I focus more closely to employment relations, where the problem of discrimination is widespread, or where it is highly undesirable. In individual chapters of this section applying for a job (including advertisements), remuneration or termination of employment are examined. The issues of discrimination at the labour market are discussed frequently and according to the available sources of information these issues are not overlooked. When you imagine all manners of discrimination at the labour market, the most frequent manner is gender discrimination. It means that women are the most discriminated group. In this thesis I had focused on: the issue of women discrimination on the labour market and the topic of women versus men in the workplace. The society tells us the way how men and women have to look like and how they should behave according to their gender. Every person can observe these patterns since their childhood. The gender is formed by the external influences. The topic of gender discrimination belongs to sociology, however, there is a management sector which deals with the influence of gender inside the company ? it is called the management of gender relations. This is the theme which comes close to the women discrimination and to equal opportunities for men and women in the organization of the company. If the company is interested in establishing equal opportunities at the labour market, it is necessary to see women and men as two different parts of the company. It is impossible to replace the two parts with each other, because both of them have their tasks and the first part cannot work without the second part. The two parts are complementing each other in the family life and in the career life as well. The European Union has one of the most advanced antidiscrimination law in the world. The principle of equal opportunities of men and women is a part of the entrance conditions that have to be fulfilled by all member states and the candidate countries which want to enter the European Union. In the Czech legislative we can find the provision of equal treatment in The Charter of Fundamental Rights and Freedoms. Another important document is the Labour Code and last but not least is the Antidiscrimination Act. For employers it is necessary to claim equal opportunities for women and men if they want to be popular in the society of the 21st century. The whole society has to take a part in solving this global problem and then the situation at the labour market might become better. Equal opportunities are an important value and it is the sign of a fair company which is based on democracy. That is why the equalization of the relationships between men and women should be the significant aim of companies.

The aim of my thesis entitled Equal treatment and prohibited discrimination against employees is to provide a complete view of international, European and Czech legislation on this topic and inform about how to protect oneself against discrimination. The thesis is divided into four chapters. The first chapter is general. It deals with basic concepts relevant to this area, such as equality, equal treatment, discrimination and its types and others. The second chapter focuses on the most important international treaties regulating equal treatment and discrimination in labour-management relations. It has three parts and each part consists of conventions adopted by one international organization - The United Nations, International Labour Organization and Council of Europe. The third chapter concentrates on the legislation of European Union, both primary and secondary legislation and also deals with judgements of European Court of Justice. The fourth chapter is concentrated on Czech legislation which deals with the principles of equal treatment and prohibition of discrimination of employees, at first place on Anti - discrimination Act. This chapter also treats with various means of protection available to victims of discrimination.

This work focuses on the contemporary form of the constitutional principles of equality and non-discrimination. These are human rights which have been formed in the society during last decades, and these changes have usually been dynamic and also crucial. For the purpose of understanding these principles and their position in the society, this work deals with analysis, development and influential factors related to these principles. First of all, this work provides general description of principles, which is a terminological basis, it also analyses constitutional principles and legal interpretation. Then it focuses on the principles of equality and non-discrimination, their relation and possibility of restriction. Besides from explanation of the relevant terms, this work also contains their more detailed analysis. The second chapter describes the process of enshrining these principles and strengthening their role in the society. Furthermore, it focuses on the process of enshrining itself, and provides examples of subjects and processes supporting this extension. The thesis analyses Czech and EU legislation which is intended to prevent discrimination in the labour market and focuses on the three main models of discrimination: Discriminatory preference, Statistical discrimination and Displacing discrimination. In the opening chapters, the thesis presents the reasons leading to the differences in men's and women's wages not originating from discrimination and also partially disproves the myths about discrimination of women. The analytical and theoretical part is followed by empirical part whose conclusions do not disprove the hypothesis of discrimination in Czech labour market, nevertheless comes to the conclusion that the part of the differences in average income, that exist, can be explained mainly by following factors: the number of worked hours, education level, time spent mainly by women on maternity / parental leave and child care and other factors. The results of questionnaire survey realised on the territory of one region and within one area of intervention of Structural funds confirm that the discrimination between men and women doesn't exist.

The theoretical part deals with gender and gender-integrated organizations, feminism and emancipation movement, discrimination against women in the labor market, anti-discrimination measures by the State and the European Union, the development of the labor market position of women in the labor market position of women in the family and the possibility of harmonizing work and family life. Vliv tělesných proporcí na vztah pacienta a lékaře / The impact of body shape on the patient-practitioner relationship

The study involves an experimental procedure which addresses the influence of body shape (i.e. obesity), on contact between the doctor and patient. The theoretical part includes studying and describing the current literature relevant to the topic, defining concepts of obesity, prejudice, and weight stigma. The theory concludes with a critical reflection of the current level of knowledge. For the experimental part, participants are randomly assigned across several experimental conditions, which consist of video views an expert advice from the doctor. Conditions vary gender and weight physician, as well as the content of the information the doctor gives to the potential patient. The main research aims are to provide an evidence on how is the weight stigma influenced by various factors, especially gender of HCPs, the information they are providing, their weight status, and other relevant sociodemographic characteristics on the side of a participant. Data are analysed with multivariate analysis of covariance and analysis of covariance. The study results are consistent with previous findings in literature. The Prohibition of Discrimination Based on Disability in the Field of Employment Relationships Abstract The aim of this master's thesis is to evaluate the standard of the protection of people with disabilities from discrimination in the field of employment relationships in the Czech Republic, to identify the reasons of this state and especially to provide de lege ferenda proposals, that could lead to the increase of the standard of the prohibition of discrimination based on disability in the field of employment relationships. The used research methods are mainly analytical and empirical methods. The master's thesis starts with the legislative regulation of the prohibition of discrimination based on disability in the field of employment relationships on the international law level, where the Convention is crucial, and continues toward the level of EU and national law. Czech anti-discrimination law embodied especially in the Antidiscrimination Code and regulating the prohibition of discrimination based on disability in the field of employment relationships, is based on the Framework Directive.
