Ageismus v prostředí české společnosti / Ageism in the Czech republic

The diploma thesis "Ageism in the Czech republic" explores areas, where Czech seniors are perceived in discriminatory manners. It maps where they can encounter such behaviors, how do they manifest and which parts of society display those ageist attitudes. For the research I have used a qualitative inquiry way of focus groups and further individual interviews. Research sample was formed partly by seniors living in nursing home and partly by those ones living at home, relatively self-reliantly. The obtained data was analyzed, coded by opened and selective coding and after that evaluated. To achieve good validity of research I have used Q-sorting as an auxiliary method in research sample of young adults working in social services or in related areas. The data I received was analyzed by correlation analysis. I have defined basic and most important points from all levels of research where seniors perceived discriminatory behavior and pressure for young and adult populations. As a suitable prevention I have established the education to values and familiarization with problems of seniors.

Náboženské symboly v evropském antidiskriminačním právu / Religious symbols in European Anti-Discrimination Law

The European continent has been plagued by religious-based conflicts for centuries. While in the past the conflicts arose from disputes between the Catholic and the Protestant church, the main source of the conflicts nowadays is migration to European countries. The migration is what brings significant religious and cultural differences into the functioning traditional European society. One of the currently most discussed topics according to conflicts in Europe is the presence of religious symbols in public spaces. At this point new coming religion symbolized by the Muslim headscarf clashes the traditional religion adhered to by majority and in public areas symbolized by the Christian cross. Except for the conflict between the religions the dispute arises also between religions and the principle of secularism. The aim of my thesis is to analyze the issue of religious symbols in public area, not only in terms of religious freedom, but also in terms of equality and discrimination, protection of the rights of minorities, right to education and gender equality, as these are the issues that need to be considered in its complexity. The topic of the diploma thesis are selected issues of the hiring of employees. Within the scope of this work I would like to refer to wiles, which lie in ambush for aplicants for a job already at the very beginning of selection procedure, and that is why I aimed above all on the issue of discrimination in the course of hiring employees, which is recently by general public very popular subject matter. In introductory three chapters I make a bid for brief explanation of principle of equality, equal treatment and prohibition against discrimination so that I may further devote myself to the principal object of submitted thesis. The content of the fourth chapter is the treatise on unequal treatment in the period prior to beginning of employment, so in the course of selection procedure. As results from the findings of the research of ombudsman and Czech Helsinki Committee, the aplicants for job very often face discrimination already by the first contact with prospective employer, so in job advertisement. Resumé " The equal treatment and prohibition of discrimination in Labour law" This thesis deals with the principles of equal treatment and prohibition of discrimination, which belong to the most substantial principles of European and international law as well as in todays Czech law. These principles are dealt with in many international treaties, in the legislation of the European Union and also in the so called Czech Antidiscrimination Act 2009. Special emphasis is placed particularly on equal treatment between men and women and on the prohibition of discrimination on grounds of gender. The thesis is composed of introduction and seven chapters, each of them deals with different aspects of prohibition of discrimination and equal treatment. Chapter One and Two is introduction into the Czech Labour law and basic principles of Labour law. This Master's Thesis deals with the sociological phenomenon called affirmative action, which has appeared in different forms in many countries during the second half of 20th century. This topic, as rather complex and overlapping fields of more social sciences, is being widely discussed in the society. In some countries, application of affirmative action brings controversy and even division in the communities. This thesis aims to find the substance of affirmative action and compare it with the principles of equality before law. These topics are discussed in their sociological, psychological and legislative dimensions. The analysis stems from examples of particular causes and recent key judicial decisions in the United States of America, the European Union and India, illustrating legal aspects of affirmative action in different regions. Their discussion tries to point out the different dimensions of affirmative action, including the motivations for implementing it in the society and the following public reflections. 6 Title of the Thesis: Equal Treatment and Discrimination in Labor-Law Relationships Summary of the Thesis: The aim of this thesis is to ascertain the level of effectiveness of anti-discrimination law in labor-law relationships on the level of international, EU, and Czech national law. Next, if needed and based on the findings to propose effective and just changes of law or an adoption of extralegal measures. The structure of the thesis corresponds to its aims. In the first chapter, basic terms used in the anti-discrimination law area are defined. In the second chapter, I introduce the (for me) most compelling conception of moral justification of the prohibition of discrimination in any normative system. The thesis includes this chapter because an express elaboration of such a conception is a necessary starting point for the formulation of a just solution to discrimination. The third chapter describes, analyzes and partly also criticizes the valid law on the above mentioned three levels of law (international, EU, Czech). In my thesis I concentrate on the topic of the equal treatment and the prohibition of discrimination. The reason why I have chosen this subject matter is for its topicality and constantly increasing significance. The equal treatment, as well as the prohibition of discrimination, has to be respected in labour relations to create respectable conditions for employees and equal opportunities for job applicants. In practice, these principles support also better productivity in a workplace, because the work environment, where the law is maintained, is the healthy and prosperous one. However, the reality is different and these principles are not always enforced. That is the reason why discrimination or unequal treatment still exist today and it is not phenomenon, which would be typical only for relations between employers and employees or job applicants. Therefore, the international, European and interstate legislation is evolving constantly in this area and it is changing in an effort to reach more efficient application in practice. Výhrada svědomí v evropském právu / Conscientious objection in European law

This thesis is aimed on the social phenomenon of conscientious objection, its theoretical perception as a legal concept and application in the real world, in particular by the supranational protection of human rights in the European area. Priority concern will be given to the transposition of the general assessments to the special "habitat" of EU law. The basis of the study is built on an analysis of definitions and categories refined by the doctrine and reinforced by the roots of natural law, both of which also serve to determine the methodology and legal perception of conscientious objection. A short study of the Czech law then follows to "pump the theory in legal veins". Large part of the thesis addresses the case law adopted by the European Court of Human Rights which serves as an inspiration and authority for the Union and its Member States. Abstracting the main trends in ECtHR reasoning the thesis draws basic limits laid down by the international protection. It also concludes that the Convention (ECHR) does not preclude developing its own pro or contra- objection approach by the EU institutions.
