Arabská menšina v íránském Chúzistánu / Arab Minority in Iranian Khuzestan

This diploma thesis focuses on the minority Arab population in Khuzestan, Iran. The thesis is based on research conducted during the summer of 2014 in the province of Khuzestan. It is consisted of theoretical part as well as data taken during the research period. Additional data was taken from respondents via internet and social networks. The aim of the thesis is an objective analysis of the Arab community life in Iran. Research questions focus on the status of this minority, tribal organization of Khuzestani Arabs and preservation of their cultural identity and heritage. The first two chapters consist of the introduction and set the framework for the methodological basis. The third chapter provides geographical and historical information of this province. Acquaintance with the geographical and historical facts is necessary for better understanding of the character of the Arab community in Khuzestan. The fourth chapter is dedicated to the Mesopotamian dialect and Khuzestani dialect of this community. The fifth chapter analyzes the question of religious identity of Khuzestani Arabs. The topic of this thesis are selected legal aspects of the hiring of employees. During the lifetime, possibly every one of us experiences the selection process and therefore it is worth knowing all the rights and duties of both parties to the process, either rights and duties of an employer or a job applicant. Particular aspects chosen are the equal treatment and the prohibition of discrimination and the protection of personal data and especially related to the proceedings before the commencement of the employment relationship. Both aspects are closely related to each other and therefore they are described in one work, so it is easier to understand the whole content and meaning of them. RESUMÉ This thesis is concerned with equal treatment and prohibition of employment discrimination. I deal with international, European and Czech antidiscrimination law. The text is divided into an introduction, four main chapters, divided into subchapters, and a conclusion. The first chapter defines the fundamental terms, which are equality and discrimination. At first, I distinguish formal and substantive equality. In context of substantive equality, I explain the concepts of equal opportunity and equality of outcome. In the following part of the chapter I deal with the concept of discrimination. I describe the basic forms of discrimination: Direct and indirect discrimination. I also briefly discuss the issue of multiple discrimination. The second chapter concerns the most important international conventions that are related to my thesis topic. Those are the conventions of United Nations, Council of Europe and International Labour Organization. The third chapter focuses on the European Union law. Diskriminace Romů na trhu práce? / Roma discrimination on the labour market?

This diploma deals with the problem of the participation of Roma in the work market. The scope of the investigation is focused on the Broumov region, where I look for possible causes, hurdles and reasons for Roma unemployment. The empirical part deals with gathering data from three different informants. The goal of this research is a complex overview of the actual situation from the view of employers, Roma themselves, and the state, represented by the Job Centre (Work Offive). To this end I used the involved observation method, and in-depth interviews. The target of the diploma was to find out what the main hurdles are in the scope of the participation of Broumov Roma in the work market, and what are the main obstacles to the participation of Roma in the work market. The result of the completed research is that among the main obstacles are insufficient education, low qualifications, frequent property re-possession and the unwillingness of employers to employ Roma. The source of this unwillingness is distrust of Roma due to bad experience with this minority.

This work examines the compatibility of prohibition of discrimination in private law and the principle of autonomy of will which is the leading principle of private law. For this purpose, the work analyses both principles and their limits, examines their conflict and possible coexistence. First of all, this work deals with the prohibition of discrimination in private relationships and the extend of its effect. This extend is limited by the scope of the Antidiscrimination Act as well as by certain exceptions from equal treatment. Considering the fact that antidiscrimination law does not have a long tradition in the Czech Republic, this work uses international law and EU law, as well as relevant case law, to interpret the norms of antidiscrimination law. Further, this work focuses on the principle of autonomy of will which is the fundamental prerequisite for realization of the will of individuals in private law. Besides the content of the principle of autonomy of will, this work analyses its limitations given by private law acts, especially Civil Code and Labour Code. I selected this topic based on both my own work experience in this area, especially trainings for disabled persons, as well as provision of advice to persons with disabilities and insight gained during the above- mentioned activities as well as my efforts to deepen the related knowledge in the area. Based on the activities in this field of law I learned about problematic aspects, problematic and old legislation, frauds in the area of substitute performance and secondary problems related to employment of persons with disabilities, especially in the area of numerous changes in the area of cards for special benefits or compensatory aids. The more problems I knew about, the more I was convinced that I wanted to deal with them in my scientific work. Apart from that, the thesis analyses a sample of four magazines focused on seniors: Generace, Revue 50plus, Vital plus, Magazín 55+ (or Magazín Plus), year 2010. In order to understand the subject matter of this thesis, the first chapter deals with definitions and their interpretation. Estimating disparities in the treatment of foreign nationals in the criminal justice process in the Czech Republic / Odhad disparit v zacházení s cizizími statními příslušníky v trestním procesu v České Republice

This thesis examines the effect of foreign nationality on the outcomes of criminal process in the Czech Republic. Foreign citizens are overrepresented by 2% compared to their share in population in all stages of the criminal process, suggesting possible discrimination by domestic authorities. Using rich case level datasets from 2005 to 2015 observed gaps are decomposed to part explained by a difference in the objective characteristics of the cases and unexplained part, suggesting possible inequality of treatment. Foreigner gaps in probability of charge, probability of conviction, probability of imprisonment, length of the sentence and probability of release from prison on parole are decomposed. Majority of observed disparities in the outcomes can be attributed to higher involvement of foreigners in more serious crimes compared to nationals. Unexplained disparities remain in probability of imprisonment and probability of release on parole, suggesting possible unequal treatment in these two outcomes.
