La loi applicable au fond dans les litiges concernant les noms de domaine

"Mémoire présenté à la Faculté des études supérieures En vue de l'obtention du grade de Maîtrise en droit (L.L.M.)" / Facilitant l'adressage des sites sur Internet, le nom de domaine est devenu un moyen d'identification de l'entreprise, de ses activités et de ses productions, tant dans le monde virtuel que dans le monde réel, ce qui a amené le législateur à chercher comment protéger «cet identifiant» et organiser son mode d'exploitation. Cette «valeur ajoutée» à l'entreprise, qu'est le nom de domaine, déclenche plusieurs conflits entre lui et les «autres» signes distinctifs et pose de nouvelles questions et des réflexions d'ordre juridique. L'étude de la protection des noms de domaine met en relief l'élasticité de la théorie des signes distinctifs, une protection qui s'étend au monde virtuel transnational de l'Internet. Le caractère virtuel des noms de domaine sur le réseau mondial de l'Internet trace aussi un problème de juridiction. Doit on considérer que la protection accordée aux noms de domaine revêt un caractère d'ordre international, ou simplement un caractère d'ordre national où s'appliqueront les règles de droit d'un seul Etat? Toutes ces questions et bien d'autres, feront le noyau de notre étude dans laquelle on essayera le plutôt possible de répondre aux différentes questions d'ordre juridique qui se rattachent aux noms de domaine, tout en se basant sur les divers avis doctrinaux et jurisprudentiels comparés en la matière. / Facilitating web sites addressing on the Internet, domain names have become a means of identification of the company, its activities and its productions, whether in the virtual world as well as in the real world which obliged the legislator to look for the best legal way to protect this "identifier" and organize its mode of exploitation. This "added value" to the company, naming the domain name, provokes several conflicts between him and "the other distinctive signs" by raising new questions and reflexions of legal nature. The study of the protection of the domain names highlights the elasticity of the distinctive signs theory, which extends toward the transnational virtual world of the Internet. The virtual nature of domain names on the Internet traces also a problem of jurisdiction. Must one consider that the protection granted to domain names is of an international nature, or just national? AlI these questions and others as well, will make the core of our study during which we will try to answer, as much as possible, to all related questions, based on various related doctrinal and jurisprudential opinions.

In the diploma work, there are examined domain names, which have become, due to a mass development of the Internet, an economically very valuable estate. Domain names lack, although being a generally known notion, any legal anchoring in the Czech system of law. The absence of legal regulation of domain names is not an anomaly of the Czech legal environment, but it can also be seen in the states with advanced legal culture. Domain names fulfill, in addition to being a very valuable commercial article, identification and/or promotional functions. Just for those reasons, the domain names need to be provided a corresponding legal protection. The introductory part of the diploma work, containing an introduction into the issues of domain names, addresses technical aspects of domain names and the method of their hierarchical structuring. Further, the diploma work contains a list of institutions which play, in the area of domain names, an important role for various reasons. The historical development of the institutions, their organization, and activity contents are briefly described. Then the legal nature of domain names is examined and a question whether a domain name can be considered to be a thing/item, right and/or any other asset value is answered. Protection of domain names Life nowadays is much more dependent on information and the most common source of them right now is Internet. One of the main aspects, that users of Internet have to deal with, is a domain names, as a website address. Nevertheless it's common, that users do not differentiate between internet, browser, search engine or web page, nor are familiar with the legal and technical concept of domain names. Domains are allocated according to a first come first serve basis and that makes them valuable article and thus subject of common legal disputes. The purpose of my thesis is to analyze ways of legal protection of domain names and the absence of its legal regulation, which is not unique for Czech legal system. First chapter of my thesis deals briefly with internet and its basic infrastructure, including internet protocol, with deeper focus on domain names, their technical aspects, hierarchical structure and typology. Next chapter mentions the main organizations involved in creating rules and policies for cooperation among institutions authorized to oversee internet and managing the registration of internet number resources and domain name system. The topic of the paper is the legal aspects of the use of domain names in the electronic space. The domain names are the new individualization tools that are not entered into the system yet. Due to the existing situation the conflicts of interests of the owners of the domain names on one hand and the owners of other individualization tools on the other hand arise. The solution of these disputes that are still very new and very specific causes a lot of problems to the law institutions as well as to legal bodies and natural persons. The goal of the paper is the problems, which arise to the registration and use of the domain names and other individualization tools, such as trade names, personal names, etc., analysis. The paper analyses the procedure of the composition of the domain names and the regulations of their registration. It also deals with the problems related to the registration of the domain names and their use in the electronic space. Efforts have been made to look into conflicts between the domain names and other tools of individualization. The document of „The Uniform Domain Names Dispute Resolution Policy“ adopted by the Internet Corporation for Assigned Names And Numbers and the practice of the courts abroad is being analyzed.

This thesis on the theme Protection of a domain name in relation to other industrial rights strives to provide a comprehensive image of domain names protection in relation to the relevant objects of industrial property, respectively in relation to industrial rights related to these objects, as well as to provide a summary of the interpretative practice to this topic of the courts in the Czech Republic and of the Arbitration Court attached to the Economic Chamber of the Czech Republic and Agricultural Chamber of the Czech Republic with regards to top level domain .cz. For this purpose, the first part of the thesis introduces a basic technical and descriptive introduction to domain names containing a general and comprehensible extract of technical solution and significance of domain names, which are also used in other chapters of this thesis. The following third chapter defines the basic definition of the domain names anchoring in the law in the Czech Republic, including current theoretical and legal concepts of domain names.
