Elektronizace justice v České republice / Electronification of the judiciary in Czech Republic

This thesis deals with questions connected with the electronification of the judiciary in the Czech Republic majoring in the civil judicial proceeding. The first part focuses on the description of the background of electronization of judiciary in the Czech Republic, benefits and barriers associated with computerization. The author describes the conditions to implement e-justice (which are reform of judiciary, development of information society or technical readiness). Process of electronification of the judiciary is illustrated by introduction of eJustice project. There are disscused three basic elements of e-justice in the main part of thesis. These are the electronic judicial record, electronic filing and electronic delivery. Author describes the conditions to implement these features, ascertains the current situation and identifies assets and imperfections of actual solution. Main goal of this thesis is to provide reader with the view of the electronification of the judiciary in the Czech Republic and sum up the most importatnt parts of electonical civil judicial proceeding.

This thesis deals with the house arrest sanction which is one of alternatives of the unsuspended sentence of imprisonment. The author tries to summarize accessible information on the history of house arrest and electronic monitoring. The main aim of the thesis is to briefly present substantive and procedural legal regulation of the house arrest sentence in the Czech Republic. This thesis also covers other issues such as the role of the Probation and Mediation Service in the process of imposing the sanction of house arrest and in the enforcement of this sanction, advantages and disadvantages of house arrest and the outline of legal regulation of house arrest in some other states.

The aim of my thesis is to analyse regulation of electronic communication market with regard to competition law aspects. Electronic communication sector of nowadays globalized world is developing rapidly and represents a precondition for the economic growth. Due to the characteristics of a network industry and the fact that this sector was regulated historically by monopoly firms owned by the state, the purpose of this paper is to identify which difficulties this market has to face through the dualistic regulation. To secure a fair competition with equal conditions for competitors operating electronic communication networks or providing electronic communication services is not an easy task, nevertheless it's essential for the welfare of the consumers. My thesis is composed of six main chapters. In the first one, I provide the definitions of the main terms which are related to this topic. Moreover, I focus on the characteristics of the electronic communication sector and integrate the topic into the historical context. In particular, I describe the beginning of the liberalisation of this sector and provide an outline of the harmonisation process which is represented by the legal provisions adopted by the European Union. The purpose of my thesis is to analyse the regulation related to the Internet and private international law. The Internet is a quickly developing system of interconnected computer networks. Recent expansion of the internet caused that it becomes almost an essential part of our lives which serves either to communicate or to contract. A growing number of internet-users raised a question of a need for more specialized legislation related to the Internet and e-commerce. The thesis is focused on the regulation applicable to the internet and e-commerce and questions raising when rules intended for real-life obligations are being applied on the Internet. The thesis is composed of six chapters, each of them dealing with different aspects of the topic. Chapter One is introductory. It explains the connection between private international law and the Internet and presents relevant legislation of the Czech Republic and the European Union. Chapter Two and Chapter Three explain where the contracting party can expect to be sued and which jurisdiction's law will be applied. Consumer protection is an issue affecting a very broad group of citizens of the European Union. EU reflects customer protection in all its policies. I have focused on electronic communication because of my work experience in that field. In my thesis I am trying to compare my experience with valid legislation. In addition, electronic communication services are used by European consumers every day widespread through society. I have tried to follow the development of EU legislation in electronic communication sector focusing on consumer protection. This topic is very closely connected with price regulation and the whole situation on the electronic communication market. My goal is to define main problems of legislation by using case law and my knowledge from practice. In the first chapter of my thesis, I focus on general consumer protection in EU, which is applicable to all contracts concluded by consumers (unfair terms, contracts negotiated away from business premises etc.). I am pointing out issues I encountered in practice. I also compare implementation of EU legislation by EU member states. This thesis should give a brief view on the matter of imposing, executing and control of the house arrest sentence in the Czech Republic. House arrest is a type of sentence when offender serves his sentence at home instead of prison. He or she must stay at home at night from 22.00 till 5.00 or in time determined by court and all the weekends and public holidays. It means that the sentenced person is able to perform his job or studies and take care of his/her family. Other reason for enacting the house arrest sentence is that the convicted person is not affected by the prison environment, which makes his return to normal life difficult or even impossible. Very important is also the financial matter of the sentence, because compared to imprisonment, the house arrest should save more than 2/3 of expenses. A court may impose house arrest when the criminal offence is punishable by the prison sentence in maximum duration of 5 years. The aim of this thesis is to provide an overview of the rights and obligations of mobile virtual network operators in the Czech Republic and the corresponding rights and obligations of mobile network operators. The first part of the paper looks at electronic communications in general. It begins with a description of the development of European Union electronic communications legislation, the currently valid Electronic Communications Act and its relation to the Code of Administrative Procedure. The paper then presents the legal regulation of administrative supervision, competition law, public consultation procedure, notification procedure and the procedural regulation of adopting a measure of general nature. The authority and the organization of the Czech Telecommunication Office (CTO) and a classification of the business models used by mobile virtual network operators is then detailed. The second part of the text addresses legal rules directly governing mobile virtual operators, commencing with the legal prerequisites for the provision of electronic communications services and a notification of intention to commence the provision of these services. This thesis deals with the problems of e-Health in the Czech Republic within the European Union. The thesis is divided into five main parts. The first of them describes the definition and concept of e Health together with other selected topics. It also describes the reasons why e-health needs support. The second part is focused on the computerization of health care and describes the recommendations of the EU standards and documents for support of e-health. The third part describes the state of e-health in selected EU Member States. The fourth part is focuses on e-health in the Czech Republic. The final part suggests possible ways how to solve problems of IZIP project in the Czech Republic to be more useful. The first goal is to analyze the e-Health environment and current trends in this area in the Czech Republic. The goal is to analyze the EU initiative on data interoperability and support from European Union to member states. The third goal is to analyze the situation of e-health in at least three other EU countries (excluding the CR). All the objectives will be achieved by studying available electronic materials issued by the EU, national government agencies, private experience and consultations with professional public. The benefit of this work is the current view of the state of e-Health in the Republic and in selected EU countries, according to available resources. Another benefit is the proposal addressing some of weaknesses IZIP project in the CR, which I chose as the most important representative e-health solution in the country.
