The research is on the assessment of municipalities within the Eastern Cape Province to determine the capacity they have towards implementing the Municipal Finance Management Act No 56 of 2003 (MFMA). The research targeted Municipal Managers and Chief Financial Officers as these are the people charged by the Act with the responsibility of ensuring proper implementation and compliance by the Municipalities with the Act. The project was conducted at the level of the district municipality. This level of municipalities was considered sufficient as it would ensure a broad and in depth coverage of the assessment throughout the Province. This project aims to uncover strengths and weaknesses of municipalities. Municipalities with strong features are appraised of their strengths and recommendations are given towards the end of the dissertation to change the negatives into positives. The prime source used in developing the questionnaire is the MFMA. The questionnaire looks at various aspects of the Act and assesses capacity in terms of fourteen specific areas. / Thesis (MBA)-University of KwaZulu-Natal, Durban, 2006.

The impact of the National Credit Act, 2005 on the affordability of home loans in Pinetown

Submitted in fulfilment of the requirements of the Masters of Technology degree in Cost and Management Accounting, Durban University of Technology, Durban, South Africa, 2015. / The National Credit Act No. 34 of 2005 (NCA) was introduced by the South African government mainly to bring about accessibility to credit markets, protect consumers from malpractices and market abuses by credit providers and reduce consumer over indebtedness. As a result, credit providers are compelled to apply stringent rules and regulations when assessing a credit consumer’s affordability prior to granting home loans. This study aims at investigating the impact of the NCA on the affordability of home loans within the Pinetown metropolitan area. The literature review presents an overall view of affordability of home loans in developed and emerging countries and also provides an in-depth explanation of factors that affect affordability of home loans in South Africa. The predominant factors, amongst others that hinder the housing market, are: an increase in house prices; elevated interest rates and household debt which include inflation, transportation cost and low wage increase. A mixed methods approach was utilized for the research, analyzing both quantitative and qualitative data. Respondents (home loan borrowers) completed a questionnaire by indicating if assessments were conducted in terms of their affordability prior to the approval of their home loan and their view on the impact that the NCA had on their home loan. The data suggested strongly that credit providers had conducted proper credit and affordability assessments prior to granting home loans and that most home loan borrowers’ level of debt had remained stable since acquiring their home loans as they continue to meet their debts. An overall analysis revealed that the application of the NCA had a positive impact on the affordability of home loans in the research area and that compliance with NCA, when granting credit, resulted in the reduction of reckless lending, a decline in the level of consumer indebtedness and a reduction in payment default.

The demise of corporate insolvency law in India

The subject of this thesis is the operation of corporate insolvency law in post-colonial India. Indian corporate insolvency law has been widely condemned as dysfunctional, critics complaining of extreme delays and a series of associated harms to creditors in the disposal of formal proceedings. Surprisingly little is known, however, about why the law has ‘failed’ creditors in this way - why the law operates as it does. That is the question that motivates this thesis. The thesis reports the results of an in-depth study of the introduction and development of India’s two principal insolvency procedures for corporate debtors: liquidation (under the Companies Act 1956) and rescue (under the Sick Industrial Companies (Special Provisions) Act 1985, for industrial companies). The most significant contribution made by the thesis is the reporting of new evidence of the influence of judges on the development of these two insolvency procedures over time, drawn from an original analysis of a large body of Indian case law. This evidence suggests that the role of the courts (or more specifically, the role of judges) has been significantly underestimated in previous attempts to explain the demise of corporate insolvency law in post-colonial India.

O presente trabalho visa investigar em que medida o contingenciamento (artigo 9º da Lei de Responsabilidade Fiscal) tem sido aplicado fora de seus parâmetros jurídicos e, consequentemente, representado um obstáculo à concretização do Direito Financeiro. Por trás desse objetivo está a ideia de que, atualmente, o grande desafio do Direito Constitucional Financeiro é a sua concretização. O trabalho está estruturado em cinco capítulos. No primeiro capítulo, são estabelecidas as premissas: o que se entende por concretização do Direito Constitucional Financeiro e quais são os principais obstáculos para esta. Nessa linha, destaca-se, em primeiro lugar, que o Direito Financeiro está inserido em um novo paradigma, no qual o orçamento deve ser encarado como meio de dar efetividade à Constituição, como instrumento de implementação do Estado Democrático de Direito e dos direitos fundamentais. Em segundo lugar, discute-se a prática relativa aos instrumentos de flexibilização orçamentária e como esta representa, em larga medida, um entrave à concretização do Direito Financeiro. No segundo capítulo, adentra-se na análise do instrumento de flexibilização orçamentária objeto de estudo o contingenciamento , interpretando-se o artigo 9º da Lei de Responsabilidade Fiscal. Delineados os principais aspectos da norma que prevê o contingenciamento, no terceiro capítulo passa-se a olhar para sua aplicação. A partir de uma revisão doutrinária e de um levantamento de dados da execução orçamentária federal dos anos de 2010 a 2013, verifica-se em que medida há uma prática relativa ao contingenciamento fora dos parâmetros jurídicos. O quarto capítulo aponta para os efeitos do contingenciamento na execução do orçamento sob quatro perspectivas: (i) da realização de políticas públicas e consolidação de direitos sociais, (ii) do planejamento, (iii) da transparência e (iv) da legitimidade democrática do gasto público. Por meio dessa análise, além de reforçar as considerações do capítulo anterior, é possível configurar que a prática do contingenciamento tem sido um obstáculo à concretização do Direito Financeiro no Brasil. From a doctrinal review and from a data collection of 2010-2013 federal budget execution, we demonstrate that there is an illegal use of the curtailments. The fourth chapter points out to the effects of curtailment in budget execution from four perspectives: (i) the accomplishment of public policies, (ii) the budget planning, (iii) the fiscal transparency and (iv) the democratic legitimacy of public expenditure. By this analysis, we conclude that the use of the curtailment in the federal budget execution has been an obstacle to the achievement of the Public Finance Law in Brazil. Finally, the fifth chapter presents some proposals for controlling the budget curtailment within the Federal Court of Accounts, the Legislative and the Judiciary. We verify that it is possible a legal control of the budget curtailment to strengthen the achievement of Public Finance Law.

The researcher is of the belief that the results of this research can be applied in most former historically disadvantaged African schools. Also this study can help Provincial Departments of Education in their future training on Financial Management for poor African schools.

Funding and governance of cooperatives: a case study of Magwa and Majola tea estates in the Eastern Cape Province

The purpose of this research study is to assess the funding and governance models utilised in the operations of cooperatives, with specific reference to Magwa and Majola Tea Estates in the Eastern Cape. Luyt (2008) observes that poverty levels in South Africa remain high, and have not been greatly reduced since 1994. There is general agreement amongst Eastern Cape communities that more than two decades after apartheid has ended, nearly half of South Africa’s population continue to live in poverty. A common understanding, is that cooperatives are geared and established to address poverty, address both social and economic development, even though they also emphasise a social focus, they are expected to be operated on sound business principles.
