Para desenvolvimento do assunto foi necess?rio compreender o processo hist?rico de forma??o do Estado Moderno, ber?o do surgimento dos direitos fundamentais, que conjuntamente com a limita??o de poder estatal, constitui a base do discurso constitucional. As teorias contratualistas foram ressaltadas n?o s? pela influ?ncia que exerceram para a evolu??o do estado moderno, mas, sobretudo diante da rela??o que estabelecem com o direito de propriedade. O aporte te?rico nas obras dos contratualistas Thomas Hobbes, John Locke e Jean Jacques Rousseau, p?e em evid?ncia a necessidade da celebra??o de pactos entre as pessoas, que viabilizassem dentre outros objetivos a prote??o da propriedade. A dignidade da pessoa humana conjuntamente com o Estado de Direito por representarem princ?pios que justificam a exist?ncia dos direitos fundamentais, foi demonstrada sob o vi?s do reconhecimento de que todo ser humano, pelo simples fato de ser humano, aglutina em torno de si um n?cleo de direitos b?sicos que n?o devem e nem podem ser violados. A pessoa humana ? dotada, portanto de dignidade, e enquanto titular do direito fundamental de propriedade precisa ter preservado o seu exerc?cio, sobretudo quando atende as exig?ncias contidas na Constitui??o para desfrutar do que lhe pertence, seja nas rela??es estabelecidas com o Estado, seja nas rela??es constru?das horizontalmente com outros particulares. A horizontalidade do direito fundamental de propriedade foi examinada a partir das constru??es te?ricas em torno das teorias mediata e imediata de vincula??o dos particulares aos direitos fundamentais. Por fim, buscou-se identificar a forma e extens?o do exerc?cio do direito de propriedade nas rela??es entre os particulares, e eventual colis?o com a autonomia privada e seguran?a jur?dica, enquanto princ?pios vetores do universo privatista. A vincula??o dos particulares aos direitos fundamentais parte da constata??o de que a realidade brasileira sinaliza a exist?ncia de outros grupos com aptid?o para restringirem a liberdade do outro, colidindo muitas vezes, portanto em suas a??es com os direitos fundamentais de outros indiv?duos. Ao final chega-se a conclus?o de que o princ?pio da solidariedade estabelece conex?es importantes com a produtividade e a fun??o social, enquanto restri??es impostas pelo legislador brasileiro e acolhidas pelo judici?rio, ao exerc?cio do direito fundamental de propriedade, cujo manejo atualmente precisa se dar de forma a agregar valor ao grupo social. / The purpose of this master thesis is to highlight the contemporary legal position, as regards the horizontality of the fundamental right to property, from limiting criteria to exercise imposed by the Brazilian legislature. For development of the subject it was necessary to understand the historical process of formation of the modern state, birthplace of the emergence of fundamental rights, which together with the limitation of state power, forms the basis of the constitutional discourse. The contractarian theories were highlighted not only by the influence exerted on the evolution of the modern state, but especially on the relationship they establish with the right property. The theoretical contribution in the works of contractualist Thomas Hobbes, John Locke and Jean Jacques Rousseau, highlights the need for the conclusion of agreements between people, which enabled among other objectives to property protection. The dignity of the human person together with the rule of law because they represent principles that justify the existence of fundamental rights was demonstrated under the bias of the recognition that every human being, by virtue of being human, coalesces around him a core of basic rights that should not and can not be violated. The human person is endowed therefore dignity, and as holder of the fundamental right to property must have preserved their exercise, particularly when it meets the requirements contained in the Constitution to enjoy what belongs to you, whether in relationships with the state, or in relations built horizontally with other individuals. The horizontality of the fundamental right to property was examined from the theoretical constructions around the mediate and immediate theories linking the particular fundamental rights. Finally, we sought to identify the shape and extent of the right of property in relations between individuals, and collision with the private autonomy and legal certainty, as principles vectors of privatizing universe. The linking of individual fundamental rights of the fact that the Brazilian reality indicates the existence of other groups with ability to restrict the freedom of the other, clashing often so in their actions with the fundamental rights of others. At the end one comes to the conclusion that the principle of solidarity establishes important connections with productivity and social function, while restrictions imposed by the Brazilian legislature and accepted by the judiciary, the exercise of the fundamental right to property, whose management must now be given to order to add value to the social group.

[pt] As ocupações de escolas estaduais de 2016 no Rio de Janeiro acenderam uma fagulha de resistência entre secundaristas. Partindo desse contexto, esta pesquisa se propõe a analisar, sob uma ótica local, como a horizontalidade, parâmetro central nas propostas dos movimentos de ocupação, se apresenta nas falas sobre o movimento dos jovens ocupantes. Examinaremos como sentidos e identidades se constroem em narrativas sobre a ocupação, focalizando como gênero e poder orientam tais construções. Adota-se a entrevista de pesquisa semiestruturada para a geração de dados e, para a análise, a perspectiva Sociointeracional e a Análise da Narrativa, situadas no paradigma qualitativo e interpretativista da pesquisa. A análise foca nas narrativas coconstruídas nas entrevistas, pois as compreende como um espaço de criação e negociação dos significados que transitam no âmbito macrossocial. Os resultados apontam para estratégias narrativas que procuram justificar discursivamente as interferências na horizontalidade, responsabilizando as circunstâncias por atitudes assimétricas dos participantes. Nota-se que o caráter generificado do discurso, relacionado com cenários onde o binarismo das categorias homem e mulher prevalece, ainda sustenta um lugar socialmente marcado. Em contrapartida, percebe-se que o letramento social da ocupação, que trouxe a horizontalidade como possibilidade normativa, gerou questionamentos que promoveram posturas agentivas, contrárias à lógica tradicional patriarcal. Por fim, esta dissertação levanta um debate crítico e multidisciplinar, que convida à reflexão sobre as possibilidades práticas de, no espaço escolar, se desconstruir paradigmas de gênero muitas vezes problemáticos e potencialmente limitantes para a realização subjetiva do eu. / [en] The occupy movement in Brazilian state schools, in Rio de Janeiro, 2016, ignited a spirit of resistance among secondary students. Starting from this context, the present study seeks to analyze, from a local perspective, how the concept of horizontality, a central parameter of such a movement, occurs in the participants’ speeches. I intend to examine the way meanings and identities are constructed in its narratives, focusing on how gender and power direct these discursive constructions. The in-depth interview is used here as a means for generating data. As for the analysis, the perspective of Interactional Sociolinguistics and Narrative Inquiry present in the qualitative and interpretative paradigm were applied. The analysis focuses on the coconstructed narratives emerged from the interviews, understood here as a space for construction and negotiation of meaning taking place in the macro social sphere. The results point to narrative strategies used to formulate discursive accounts, justifying actions that interfere in the horizontality, blaming the circumstances for asymmetrical actions taken by the participants. Also, gender aspects of speech related to scenarios where binary understandings of the categories men and women prevail, still sustain a rigid pattern ruled by society. Conversely, the space for social literacy provided by the occupy movement, together with the notion of horizontality as a normative possibility, generated questions that promoted a change in attitude in the students, contrary to the traditional patriarchal logics. Finally, this dissertation raises a critical and multidisciplinary debate, stimulating the reflection on practical possibilities for deconstruction of problematic gender paradigms in the school environment. Furthermore, it allows other forms of subject realization of the self.

[pt] A proliferação de movimentos sociais que se organizam em uma estrutura dita horizontal vem despertando a imaginação daqueles que questionam as formas atuais de fazer política. Esta tendência suscita a questão de saber até que ponto sujeitos diversos encontram voz em meio a esses grupos e a alegada horizontalidade se concretiza. Visando lançar luz sobre esta questão, esta pesquisa qualitativa interpretativista debruça-se sobre as lutas urbanas contemporâneas, tomando as práticas discursivas de cicloativistas engajados em grupos de debate no Rio de Janeiro como seu objeto micro. A partir da compreensão de que suas reivindicações se encontram atravessadas pelas lutas de grupos minoritários na esfera pública, elege como norte analítico a noção de gênero enquanto performance. Embora diversas assimetrias possam manifestar-se nas interações, o enfoque aqui conferido decorre de observações proporcionadas pelo estudo de campo e pelo contato aproximado aos dados gravados. No intuito de ouvir vozes tradicionalmente marginalizadas, a pesquisa propõe uma escuta (auto)etnográfica, privilegiando narrativas contadas por protagonistas mulheres. A microanálise é dividida em duas lâminas: a primeira centrada na construção do mundo narrado e a segunda nas interações que se desenvolvem no mundo narrativo. Buscando compreender a articulação e a negociação dos significados emergentes, bem como os possíveis diálogos com as contingências macrossociais que posicionam os atores sociais de forma diferenciada nas interações, o estudo se baseia na concepção da prática narrativa enquanto modo de resistência, assim como terreno fértil para a negociação de performances identitárias e o acúmulo de poder simbólico. A partir dessa perspectiva, o percurso analítico busca mapear a navegação pelas dinâmicas de poder em jogo nas interações. As práticas discursivas identificadas indicam que as narradoras desestabilizam concepções essencialistas de gênero, contestando assimetrias convencionais e reivindicando a criação de relações mais simétricas ‒ tanto no nível micro, como na sociedade mais ampla em que buscam efetuar mudanças. Isso posto, a valorização de traços simbolicamente masculinos frisa a linha tênue trilhada pelas narradoras na busca por status, e na evitação de sanções sociais sutis, no contexto de uma cultura pós-feminista. O questionamento de suas performances, a partir da prática de conarração, sinaliza a emergência de disputas tácitas por aprovação, por reconhecimento e pela pauta, saldo do embate entre práticas de resistência e pressupostos generificados conflitantes. As interlocuções multifuncionais das quais seus pares lançam mão: práticas de higiene verbal, alternâncias de código e problematizações, representam eventuais obstáculos à participação significativa na construção de significados e na deliberação da agenda. Simultaneamente, a análise destaca a dinamicidade de valores socioculturais ‒ passíveis de renegociação a partir da prática intersubjetiva de segundas narrativas e a negociação de práticas identitárias atreladas a meios distintos de fazer política, entre as quais os participantes oscilam. Estes entendimentos indicam que a ação discursiva dos ativistas ora desafia noções binárias de gênero, se aproximando do ideal da horizontalidade, ora as reifica, tornando a criação de espaços discursivos mais igualitários objeto de contestação. Desse modo, a pesquisa salienta a urgência de um olhar mais crítico direcionado a interações localmente situadas a fim de fazer avançar uma compreensão mais nuançada da construção da horizontalidade. Assim, será possível identificar eventuais atropelamentos microdiscursivos, arena para resistência; bem como práticas discursivas, potencialmente, fomentadoras da participação ativa de vozes plurais, para que as próprias práticas transformacionais almejadas pelos movimentos sociais possam ser colocadas em ação. / [en] The notion of horizontal organization continues to hold resounding appeal for those in pursuit of fairer societies, disillusioned with archaic models of representation. To an extent, overriding enthusiasm for such a model has led to the concept becoming something of a rallying cry for contemporary activists. Yet further reflection on the role of their own discursive practices in its construction can be scarce on the ground. This qualitative interpretive case study therefore asks to what extent symmetrical relations may materialize discursively within an ostensibly horizontal group, by taking a critical look at the narrative and interactional practices of a group of bicycle advocates, guided by a view of gender as performance. This is based on the understanding that the group s claims over the use of public space are intertwined with the struggles of minority groups in civil society more generally. Though numerous social asymmetries may manifest themselves in such a group s discursive practices, the focus here lies on gendered asymmetries. This choice stems from observations gained during fieldwork, as well as those made possible by audio recordings of face to face debates held in Rio de Janeiro. With the aim of zooming in on these traditionally marginalized voices, data selection prioritized narratives told by women protagonists, as part of what is deemed an (auto)ethnographic listen. Microanalysis of these narratives is split into two layers: the first centered on the construction of the narrated world and the second on the interactions which unfold during the narrative world. In order to further comprehend this process, the analysis draws on constructs of narrative practice as a form of resistance, as well as identity as performance. Such practices are conceived of as fertile terrain for the negotiation of social roles and the accumulation of symbolic power. Such locally produced meaning is understood here as part of the geopolitics of gender on a macro scale, at once informed by and informing such structures. Based on this view, we seek to trace the navigation of power dynamics at play between those whose perceived social identities are understood to be organized hierarchically. The analysis indicates that essentialist notions of gender are destabilized by narrators who contest conventional social asymmetries and lay claim to the creation of more symmetrical relationships, both at the level of micro interaction as well as in wider society in which they seek to effect change. Having said that, the extolling of symbolically masculine traits highlights the fine line which must be negotiated in the quest for status while simultaneously avoiding tacit social sanctions in a postfeminist culture. The questioning of these performances, via conarration, suggests that discursive struggles arise over claims for approval and recognition, which may result from conflicting gendered assumptions brought to bear on the interactions. The deployment of multifunctional discursive phenomenon, such as practices of verbal hygiene, code switching and problematization appears to hinder more significant participation in the construction of meaning as well as agenda setting. At the same time, the analysis highlights the fluidity of sociocultural values, which may be subject to renegotiation via the intersubjective practice of second narratives and the (re)negotiation of identity claims bound up with distinct ways of doing politics, between which the participants oscillate. Such insights suggest the activists linguistic action at once reifies and challenges binary notions of gendered social roles, rendering the creation of fairer discursive spaces fraught with discursive contestation, albeit subtle. This study therefore highlights the need to critically examine locally situated interactions in order to obtain a more nuanced understanding of the construction of horizontality. As a result, it may be possible to identify discursive practices which potentially foster the active participation of less privileged groups. This might then enable the very transformative practice sought out by those engaged in social movements.
