Trestní odpovědnost právnických osob / Criminal Liability of Legal Persons

Criminal liability of legal persons Abstract The author of the thesis deals with the issue of criminal liability of legal persons, from the position of her advocate. The purpose of the study is to stress the need to introduce this institute into the legal systems of democratic states, but at the same time to deal with the problems brought by its Czech substantive law. In the first part of the thesis the author discusses the legal aspect of criminal liability of legal persons, summarizes opinions for and against the introduction of criminal liability of legal persons, and examines the criminological aspects of corporate crime. The second part of the thesis focuses on the differences, advantages and disadvantages of three basic models of criminal liability of legal persons - true, false and administrative. The author commends that the Czech Republic has proceeded to introduce true criminal liability of legal persons. The third part explains the term legal person itself. In the pivotal fourth part of the thesis, the author deals critically with the individual substantive provisions of the Czech law implementing the criminal liability of legal persons and proposes a solution de lege ferenda. Postoje žáků ke školnímu podvádění. / Attitudes of pupils to school cheating.

The diploma thesis is focused on the research of school cheating in pupils of the second level of elementary schools. Based on a self-reporting questionnaire survey, the aim of the thesis is to find out what motivates the pupils to cheat and what attitude they take to possibly punish detected fraud. Another goal is to find out the frequency of individual types of school cheating, the influence of gender and the learning benefit of school cheating. It has been found that pupils are relatively often used in cheating on the internet at the primary school. Also, there was greater tolerance for cheating when pupils do not attach the importance of punishment for an exposed fraud, rather they would not punish their exposed classmates. The subject of this text is the organizational culture and the work behaviour. The aim of a dissertation was to identify an elements of the organizational culture that support self-reliance and responsibility in the work behaviour. The second aim was to make a proposal of implementation of desirable organizational culture standard. The organizational culture structure was analysed and the culture standards were described accordance with its effects on work behaviour in the theoretical part of the dissertation. The secondary analyse was realised and described in the empirical part. It was analysed five empirical survey realized in years 1998 -- 2008. The objects of this survey always were the organizational culture and the work behaviour. The results of this dissertation is negation of a thesis that the organizational culture supporting the self-reliance and the responsibility of employees exists.

This diploma thesis deals with the different settings of the current social and political system in the Czech Republic and the People's Republic of China that affect the course of business negotiations between Czech and Chinese business negotiator. The thesis is divided into a theoretical and a practical part. The theoretical part consists of two chapters and the practical part of three chapters. The first chapter is based on the secondary data which characterize how the Czech and Chinese business negotiator perceive a commercial negotiation and its progress. The second chapter describes the effect of setting the current social and political system in the Czech Republic and the People's Republic of China on the personality of Czech and Chinese business negotiators on the individual (my chosen) period of life (offspring, education, marriage, employment and the impact of the welfare system, health system and pension system on the personality of the Czech and Chinese business negotiators) and suitable topics for conversation and maybe a taboo conversation between Czech and Chinese business partner. The third chapter describes how my own research, which was based on qualitative data collection through a questionnaire survey, was performed. The fourth chapter describes the research results. In the fifth chapter I propose how to use new gained knowledge.

The first part of my Diploma Thesis is dedicated to dying, it focuses on the perspective of the dying person. It also deals with the essential topics as hospice and palliative care. The second part tries to analyse ethically and evaluate in what sense is dying activity or inactivity and what possible moral attitudes may engage dying person in process of dying. At the beginning of the second part, there are defined the key words activity and inactivity. Basically, I'm trying to use this analysis to ethnically evaluate in which sense of dying is the dying person actually conducting and in which failures to act. Then follows simple typological analysis and evalauation based on inspiring typology of German philosopher Robert Spaemann. In the final part of the Thesis there are implied some connections between dying and the problem of sense of life. The most important is the answer of this question if needs of the sense is belong to everyone (included of dying people) in the same way. Also, how important is the influence in moral attitude of actual human after the sense of life.

Environmentální gramotnost studentů Učitelství pro 1. stupeň základní školy a možnosti jejího zjišťování / Environmental literacy of pre-service teachers of primary school and possibilities of its assessment

In recent decades, the environmental literacy and its output dimension, responsible environmental behavior represents an important construct, which is studied by a number of researchers from many countries. In this dissertation, firstly we introduce environmental literacy from a theoretical point of view, then the development of approaches to this construct as well as a review of research in past decades. In our own research, we initially sought for a suitable research instrument to be used to identify and measure selected aspects of environmental literacy among pre-service primary teachers. The research tool was found in a combination of Nature relatedness scale and Environmental Behavior scale, supplemented by data collection using concept mapping with the central concept of the greenhouse effect. The variables that affect various aspects of environmental literacy were found on a sample of more than five hundred of the respondents using this tool and its modifications. Higher values were found within the respondents who were engaged in regular environmentally-themed activities, respondents from villages up to 100 inhabitants and the older respondents. The nature relatedness has moderately positive effect on the responsible environmental behavior, cognitive component of environmental literacy does not have such influence. The international comparison showed lower results from the respondents from Slovakia in comparison with students from the Czech Republic and Turkey. Nature relatedness scale proved to be useful for measuring a particular element of the affective component of environmental literacy across countries, by contrast, Environmental behavior scale reached low psychometric results on all foreign respondents.

Správní delikty a přestupky dle stavebního zákona / Administrative torts and misdemeanors according to the construction law

This degree thesis deals with administrative torts and misdemeanours according to the construction law in the Czech Republic. First, the paper describes in general the development of imposition of administrative sanctions together with legislation currently in force, focusing on individual facts of administrative torts and misdemeanours according to the construction law. In compliance with its objective the degree thesis is focused namely on the legislation in force, basic principles and rules of administrative proceeding, application of relevant legal regulations and procedures within administrative proceedings differentiated according to the nature of the person being sentenced. The procedures and possible decisions in administrative proceedings are presented in the thesis both from the view of the first-instance authority and the appellate authority, including other methods of defence against decisions issued. Based on the data obtained from employees of building authorities the degree thesis also describes the development of behaviour of persons in the Region of Pilsen while respecting the construction law and summarizes the problems occurring in administrative proceedings. It also follows up the relations of administrative proceedings and factors causing infringement of the construction law and offers possible solutions for better general awareness of the existence of legal regulations and possible sanctions imposed for the breach thereof.

Porušování pravidel hospodářské soutěže v rámci EU / Violating European Union competition rules

The objectiv of my dissertation is mainly to introduce the problems of economic competition to the readers and to refer to the incidents of anti-competitive practices. In the introduction I defined the European Community from the historical aspect and I named all the legislative rules and contracts, that are pivotal to the European Community. In order to define in more profound terms I applied myself to Treaty of the establishement of the European community (articles 81 and 82 EC). Moreover, the readers can gain insights into various forms of violating the rules of economic competition such as abuse a position of dominance, dumping, mergers and acquisition, cartels, developing countries, ect. The practical part is based on the most serious anti-competitive practices in the European Community, which was handled by the European Commission, European Court of First Instance and by the antimonopol offices. At the end of my work, there are some practical tips for the companies, which either consciously or unconsciously behave anti-competitively which influences the common European market. The main sources of my dissertation were the basic treaties of the European Community, the Treaty of Maastricht, the Treaty of Amsterdam and treaty of Nice.

The theme of my graduation theses is ?The contribution to study and prevention of ephebic suicides?. More and more attention has been payed to problems of suicide behavior nowadays. But the prevention of suicide behavior has not been properly described yet and open to the public especially to teachers and pedagogical workers. It is necessary to focuse on a group of teenagers because there are more suicide attempts among these young people recently. Psychologists and doctors as well as teachers and pedagogical workers should pay more attention to these problems. Good knowledge of these problems and a readiness to help could often prevent suicide attempts. In the first / theoretical part I will describe problems of suicide behavior with a view to a group of teenagers. Basic terms will be explained, I will describe kinds of suicides, the influence of age, gender, seasons and week days on comitting suicides. I will define a suicide with a view to medical, psychological and sociological aspects. At the end of this part I will write about myths and facts concerning suicides and about the prevention of suicide behavior. In the second / practical part I will use a comparative method to confront case studies of teenagers who tried to commit suicide. I will search for especially pedagogical aspects and marks leading to the determination of abnormal behaviour to be able to prevent teenagers from comitting suicides.
