Court decision, Mexican law has been modified to bring it into compliance with the Inter-American Court's decisions. However, their efficacy has been undermined by aspects of the decisions which were not made on a principled basis.

The challenges posed by the digital technology / the difficulties faced by right holders, judiciary, public agencies, international and regional organizations in the implementation stages will be discussed by referring to the legal texts such as the TRIPS Agreement, the EU Enforcement Directive and Regulations. All dimensions of counterfeiting and piracy will constitute an important focus of this thesis. The thesis will seek to clarify uncertainties arising from the jurisdictional conflicts for the determination of the applicable law and competent courts in intellectual property cases involving foreign elements.

The Mediterranean in the English Empire of Trade, 1660-1748Stein, Tristan 10 September 2014 (has links)
This dissertation reintegrates the Mediterranean into the history of the development of the early modern British Empire. During the seventeenth century, the Mediterranean emerged as a distinct political, legal and commercial space within the wider currents of English expansion. The political and legal regimes of the sea shaped the evolution of the English presence there and the rulers of the Ottoman Empire, the North African regencies, and Italian states such as Tuscany and Genoa limited the expansion of English sovereignty. As a result, the sea offers a different perspective on the history of English expansion than that found in imperial histories set in the Atlantic and Indian Oceans. The development of the English presence in the Mediterranean highlights the relative weakness of the early modern English state and the extent to which other polities limited the expansion of its sovereign authority. However, this dissertation also aims to move beyond an imperial historiography that distinguishes the wider development of English trade and navigation from the growth of English empire. Through the latter half of the seventeenth century and first half of the eighteenth, the Crown's claims to jurisdiction over its subjects and their ships projected English authority into the Mediterranean. This dissertation examines how the English state extended its authority within a pluralistic maritime environment that lay largely beyond the reach of its claims to empire. By studying the jurisdictional contests that arose when the Crown’s claims to authority over its subjects and their ships collided with the sovereignty of Mediterranean polities, it shows how the intersection of diverse sovereign and legal authorities defined the organization of English trade and navigation. Moreover, as the English state extended its authority overseas during the early modern period, it called into question the location of sovereignty and jurisdictional authority in Mediterranean waters as well as in the Atlantic and Indian Oceans. English expansion in the Mediterranean and the political evolution of the sea were part of a global process whereby states and empires sought to establish their authority over oceanic space and networks of trade. / History

Magistriniame darbe nagrinėjama interneto teisės termino vartojimo tikslingumas, bei įvardijamos šio termino galimos alternatyvos, kurios sutinkamos moksliniuose darbuose. Apžvelgiami interneto teisei būdingi principai, jų teisinė paskirtis, bei įtaka. Vadovaujantis teisės teorijos sukurtais teisės šakos identifikavimo reikalavimais, iškeliama hipotezė, jog interneto teisė esanti atskira kompleksinė teisės šaka, bei pateikiamas šios teisės šakos apibrėžimas. Siekiant patvirtinti iškeltą hipotezę įvardijamos identifikacinės problemos (reguliavimo, jurisdikcijos) su kuriomis susiduria interneto teisė, ją taikant visuomeniniuose santykiuose, o taip pat šių problemų galimus sprendimus. Nustatoma ir pagrindžiama interneto teisės vieta teisės sistemoje ir jos vidinė struktūra. Trumpai aptariama Jungtinių Amerikos Valstijų, bei Lietuvos Respublikos teisinė praktika susijusi su interneto teise, bei galimi veiksmai siekiant padidinti šios teisės veikimo efektyvumą. / In Master’s Thesis discusses internet law term usage tendencies and expediency. Also it is setting forth the alternatives of this term which can be met in scholar studies. There is given review of basic internet law’s principles, their judicial purpose and influence. Main axes of internet law identification are requirements created by law theory and depending on them there have been raised hypothesis that internet law is a separate complexical law branch. There are shortly described Lithuanian and United State’s law practice based on internet law and the possibilities of raising the effectiveness of this law.

Magistro darbe „Tarybos reglamentas (EB) Nr. 2201/2003 dėl jurisdikcijos ir teismo sprendimu, susijusiu su santuoka ir tėvų pareigomis, pripažinimo bei vykdymo, panaikinantis Reglamentą (EB) Nr. 1347/2000, ir jo įtaką Lietuvos civiliniam procesui“ nagrinėjamos šio ES teisės akto priėmimo priežastys, tikslai, taikymo sritis bei jo įtaka Lietuvos civiliniam procesui. Analizuojamas ES valstybių narių teismu jurisdikcijos nustatymo reglamentavimas, taip pat teismu sprendimu pripažinimo bei vykdymo taisyklės. Aptariami atvejai, kuomet teismu sprendimai pripažįstami bei vykdomi be exequatur procedūros. Dėmesys skiriamas ir centrinių institucijų bendradarbiavimo klausimu analizei. Darbe nagrinėjamos Briuselio IIa Reglamento galiojimo laike, erdvėje ir asmenų atžvilgiu problemos, kadangi jų tinkamai neįvertinus galimi netinkami šio ES teisės akto taikymo atvejai. Pabrėžiama, jog Briuselio IIa Reglamento netaikomas Danijai. Analizuojama Briuselio IIa Reglamento įtaka Lietuvos civiliniam procesui, akcentuojant, jog Briuselio IIa Reglamentas sudaro realias galimybes tam tikrus ES valstybių narių teismų sprendimus pripažinti vykdytinais ir juos vykdyti Lietuvoje be exequatur procedūros. Aptariamas Briuselio IIa Reglamento ir LR CPK juridinės galios klausimas. / In Master‘s thesis “The Council Regulation (EC) No. 2201/2003 concerning jurisdiction and the recognition and enforcement judgements in matrimonial matters and the matters of paternal responsibilities, repealing Regulation (EC) No. 1347/200, and its influence to Lithuanian civil procedure“ the reasons of the enactment of this EU legal act, its purposes, the scope of regulation and its influence to Lithuanian civil procedure is analyzed. The reglamentation of jurisdiction of EU member states courts, as well as the rules of the courts decisions recognition and enforcement are analyzed. Specified issues, when the courts‘ decisions are recognized and enforced without exequatur procedure. Some attention is put on the analysis of the cooperation of the central institutions. In the thesis the problems of the application of the Regulation to the persons, its validity in time and space are analyzed, because the ascertation of these questions is important for proper application of this Regulation. It is emphasized, that the Regulation is not applied to Denmark. The influence of Brussels’ IIbis Regulation to Lithuanian civil procedure is analyzed, emphasizing that Brussels’ IIbis Regulation constitute real opportunities some EU members states decisions recognize and enforce in Lithuania without exequatur procedure. The question of legal power of Brussels’ IIbis Regulation and Lithuanian code of the civil procedure is analyzed.
