Urbanová, Diana January 2020 (has links)
Savings and loan cooperative as a business corporation Abstract This thesis deals with typical features of the savings and loan cooperative as a business corporation. Such specific legal regulation is a matter of a more in-depth analysis of particular provisions and mutual relations thereof. The thesis is organised in three chapters. The first chapter includes classification of business corporations and their particular typical features, some of which are present in savings and loan cooperatives, too. The second chapter deals with historical development and importance of savings and loan cooperatives, while putting accent on the basic cooperative principles, such as cooperative democracy or an emphasize on the membership principle. Then it explains the origin of numerous restraining measures applicable to savings and loan cooperatives and making them similar to banks. The third, crucial chapter contains an analysis of...

The diploma thesis deals with the continuing and reinstated liquidation in two separate parts, which form the core of the thesis. In the individual chapters the legal conditions for the continuation and reinstatement of the liquidation are analysed, as well as the prerequisites that were, in relation to this regulation, specified in more detail or deduced only in the decisional practice of the courts. Změny v distribuci příjmů v USA a dekompozice Giniho koeficientu

Roček, Tomáš January 2017 (has links)
Roček, T. Changes in income distribution in the USA and decomposition of Gini coefficient. Diploma thesis. Brno: Mendel University, 2016. Since the 80s of the last century, the United States has seen a considerable income inequality growth. This diploma thesis analyses the influence of individual income sources on determination of inequality, esteems their significance and formulates instruments that the government can use to affect these sources. This diploma thesis contains decomposition of Gini coefficient. This decomposition revealed, that the source, which is the most important determinant of the total income ine-quality are salaries and wages. Sales of assets contributed the most to the rise of inequality in the analysed period from 2000 to 2014. This income source also has the highest potential for further growth of income inequality. Discussion part, which follows, contains the debate about the main causes of this progression and the relevance of researching the income inequality issue. Based on the approach used in this diploma thesis, it is possible to decompose the Gini coefficient in any state or region, and to explore the inequality determinants in this way. This thesis also offers a comprehensive view on the whole issue.

Mezinárodněprávní odpovědnost nadnárodních společnostíza porušovánílidských práv / Responsibility of Transnational Corporations for Human Rights Violations under International Law

Švandová, Helena January 2020 (has links)
in English The need for an effective regulation of transnational corporations and its responsibility for human rights abuses has been a topic resonating strongly in the international debate for the past three decades. The suggested solutions to the lack of accountability of transnational business, however, still vary. Among them are suggestions that obligations of states under existing international human rights law could be extended to corporations, a new binding international treaty on business and human rights could be adopted, or that transnational corporations should be held to account under national law. This paper was initially inspired by this debate and seeks to identify the gaps and loopholes in legal regulation to provide better understanding of which ways forward are feasible and under what circumstances. Given these specific objectives, this paper firstly identifies the obstacles to holding transnational corporations responsible for human rights abuses under public international law. It focuses on a conceptual analysis of legal personality in public international law and the limits to legal personality of non-state actors, specifically corporations in international human rights law. This paper then turns to international criminal law and examines whether international criminal law is...

Mach, Jaroslav January 2022 (has links)
Status of governing body of business corporation in liquidation Abstract The frequency of cases of business corporations in liquidation has an increasing trend, however, it cannot be said that the academic interest would sufficiently cover the topic of liquidations. There are still a number of insufficiently answered questions that lead to completely opposite conclusions in practice. This diploma thesis deals with one such issue, which is the position of the statutory body of a business corporation in liquidation. In the ranks of the professional community, one can also encounter certain doubts about the existence of the statutory body of a business corporation in liquidation, that the statutory body should cease to exist. This paper seeks to answer this question through a critical analysis of legal regulations and compilations of works by the professional community. At the beginning the work briefly defines the individual terms in the first chapter for the needs of this work in order to maintain the conceptual unity. The terms are business corporation, statutory body, liquidation and its purpose and, last but not least, the liquidator. First, however, the question of the existence of the statutory body of a business corporation in liquidation must be resolved. Here, I conclude, by means of a critical...
