Internetová a počítačová kriminalita / The principle of subsidiarity of criminal law

The internet and computer criminality is a part of a cybercrime which is a very wide and relatively inhomogeneous category of criminal offences. The master's thesis focuses on criminal offences against confidentiality, integrity and availability of computer data and computer systems. These cyber attacks can endanger the cyber security at the national level and inflict immeasurable damage. In the present day, a Cybersecurity Act is being prepared in the Czech Republic whose goal is to respond to these attacks. Master's thesis examines especially penal aspects of this law. Moreover, a large space in the thesis is devoted to the recently ratified Convention on Cybercrime. Besides the two above-mentioned legal norms the master's thesis arises from the Czech and foreign legal regulation and case law, for which it uses literature available in the Czech, English or German language. With regard to the chosen topic, it has been necessary to use also considerable amount of a non-legal literature. The whole work is divided into six chapters. The first chapter provides a brief introduction into the topic and also short explanations of the basic terms. Structure and development of criminality in the Czech Republic In my thesis I dealt with the analysis of the development and structure of crime in the Czech Republic in the years 2007 - 2017. Most of the data I used comes from static surveys of a crime of the Police of the Czech Republic. In the period under review, information about the decline in registered crimes occurred every year. Verifying these claims was one of the main goals of my work. The thesis is divided into five chapters, the first one explains the basic terms that the reader will encounter in the text. The following is a brief historical excursion to post- revolutionary years, which briefly describes the development and structure of registered crime after 1989. The third chapter analyzes the data for 2017 concerning both the structure and intensity of selected types of crime according to the tactical- statistical classification of the Police of the Czech Republic. A similar procedure is used in the fourth chapter, where the method of compression of the structure and intensity of registered crime in 2007 - 2017 is also used. The main content of the thesis is development and structure of juvenile delinquency in the Czech Republic between years 2007 and 2017, focusing on current trends and problematic aspects in this area, on prevention, alternative measures and approaches in criminal proceedings and on recidivism of youth offenders. The premise of the paper is that educational and therapeutic measures should be more used in criminal procedure in juvenile court. The first part of the thesis defines the basic terms used by the author in his analysis, brief historical development of the juvenile justice system as an independent institute and the characteristics and causes of juvenile delinquency, which have their specifics. The main part of the thesis is dedicated to the analysis of development and structure of juvenile delinquency in the years 2007 to 2017. In this part, the author also deals with the imposed sanctions and the structure of crime in 2017 and analyzes the percentage decline of property crime and other current trends that affect structure and tendencies of delinquency. These trends include, in particular, the access of young people to the Internet from an early age and spending time on social networks, which pose some risks in terms of crime. Organizovaný zločin v České republice / Organized crime in the Czech Republic

Diploma thesis is focused on "Organized crime in the Czech Republic", includes a theoretical part and research. The teoretical part defines the notion of organized crime and the types of groups that perpetrated. Furthermore, the work presents the most common forms of organized crime and institutions such used to fight both nationally and internationally. Finally, there is outlined the situation in the Czech Republic and those groups that are in our country most often perpetrated by organized crime now. Research part examines whether the frequency of articles on the subject in the selected journal corresponds to the actual situation and widespread forms of organized crime in the Czech republic in 2015. The context was given to data obtained from the content analysis of the largest number of articles of particular forms of organized crime and was compared with interviews carried out by experts estimates and research. The result was that the data corresponds with 2/3 and the only major difference became violent organized crime, which occurred in a number of articles on second place, but it is no longer among the most frequent activities of organized groups in the Czech Republic.

The theoterical part deals with definition of the central concepts, the specification of individual types of crime and the possibilities of analysis crime. The practical part evaluates the Olomouc Region in terms od solved problems, especially in areas that crime influencing, for example composition of the population, their education and labour market. Subsequently, it is presented and analyzed crime in the Olomouc Region during the reporting period and compared with crime in the Czech Republic. Delinquency and criminal penalties of youth The aim of my thesis is to focus on juvenile delinquency and analyze it as a whole especially from the perspective of the causes, evolution, structure and control of delinquency and subsequent penalties for young offenders. The thesis is comprised of five chapters, each divided into sections. Chapter one follows the Introduction and defines basic terms which occur throughout the thesis. Chapter two is divided into two sections specifying basic indexes of youth delinquency. The second section provides a statistical support for these with a description of youth delinquency evolution since the late 20th century until now. The third chapter focuses on the causes of delinquency of youth and is thematically divided into two sections. The first one deals with the internal factors of crime, as opposed to the second section, divided into three subsections in accordance with the external factors - namely family, school and leisure time. The fourth chapter deals with the control of youth crime, and is again divided into two sections. The purpose of this thesis is to introduce the issue of cyber crime, a phenomenon which is gaining importance in recent years. The first chapter outlines the basic problem: Mass use of information and communications technologies may have downsides. Consequently, the reader learns briefly about development of computers, which resulted in the emergence of the Internet. Especially, how this short evolution affected the terminology regarding crimes related to information technology. The term "cyberspace", from which we derive the term "cyber crime", becomes crucial. This virtual world is not only a place of fun but unfortunately also full of malicious behavior. Further, the work deals with the specifics of cybercrime and its differences that distinguish it from other types of crime. The fifth chapter deals with the legal regulation, both domestic and international. It lists major legislation related to the cyber crime and is especially dedicated to analysis of the Criminal Code, the law on cyber security and the Convention on Cybercrime.
