Who needs fact when you've got narrative? The case of P, C&S vs United Kingdom

Legal arguments and judgements ostensibly rely for their credibility and persuasiveness on the presentation of factual claims and determination of facts through due process. While it should follow that proceedings that are undermined by disregard for facticity and due process should not appear credible or persuasive, in practice this is not always the case. In cases where narratives are not firmly underpinned by factuality and due process a series of narrative techniques and processes can be brought into play to enhance the persuasiveness and credibility of those narratives. These processes include the reliance on a narrative trajectory, the presentation of consensus, drawing on supportive discourses, the privileging of certain narrators and the smoothing over of contradictory evidence. This paper examines these processes in the case of P,C&S vs United Kingdom in which in the absence of fact and due process a local authority and the domestic courts in the UK constructed and confirmed a narrative of a dangerous mother.

Public Involvement in Forest Service Project-level Decision-making: A Qualitative Analysis of Public Comments, Administrative Appeals, and Legal Arguments from Case Studies on the George Washington and Jefferson National Forests

Public involvement and participation in Forest Service decision-making is a contentious issue attended by charges and countercharges, unsubstantiated accusations and counterclaims, and value-based arguments by all entities involved. Yet, the numbers of studies to substantiate the debate is relatively minimal and tend to be sporadic, reoccurring during times of national forest management crises, which is inappropriate and shortsighted. Moreover, the studies tend to be quantitative or anecdotal in nature and have largely failed to identify or resolve the problems associated with public involvement and participation in Forest Service decision-making, as well as litigation, and yet researchers continue to advocate for comprehensive, systematic, empirical examinations without considering the possible benefits that comprehensive, systematic, qualitative research could contribute to identifying and possibly resolving such problems. Thus, a comprehensive, systematic, in-depth, qualitative analysis of public comments, administrative appeals, and legal arguments from 12 Forest Service project-level activities, and their seven associated lawsuits, on the George Washington and Jefferson National Forests, was conducted. The results suggest that there is an interested and vocal minority of individuals and environmental special-interest groups that dominate project-level public involvement and participation processes on the George Washington and Jefferson National Forests, and that these public involvement and participation processes work in reverse, providing incentives for post-decisional challenges and discouraging pre-decisional information-sharing, collaboration, and compromise. Therefore, the public, the academic community, the Forest Service, and Congress, must challenge the status quo and make needed changes to ensure that public involvement and participation processes are truly democratic and to reduce incentives for post-decisional challenges. / Master of Science

Les présomptions en droit de la propriété intellectuelle : analyse à la lumière du droit commun / Presumptions in intellectual property law : analysis in the light of general law

Les présomptions interviennent pour corriger les lacunes du raisonnement juridique. Elles sont traditionnellement définies comme « des conséquences que la loi ou le magistrat tire d’un fait connu à un fait inconnu ». Les présomptions occupent un rôle important en droit de la propriété intellectuelle car la recherche de la vérité ainsi que le traitement du doute en constituent l’essence. Qu’il s’agisse d’appréhender les objets (œuvre de l’esprit, invention, marque, etc.), de désigner les acteurs (titulaires ou contrefacteurs) ou de délimiter le contenu des droits de propriété intellectuelle, l’usage des présomptions est incontournable. Cependant, les nouveaux défis (numérique, mondialisation de l’économie, communautarisation du droit, etc.) auxquels sont confrontées les créations immatérielles conduisent le législateur et le juge à galvauder les présomptions. On assiste à une inflation voire une densification de la « norme présomptive » en droit de la propriété intellectuelle : il y a une présomption pour presque tout, sur presque tout et presque partout. Cela fragilise le système de protection des créations immatérielles et, fatalement, engendre une insécurité juridique en droit de la propriété intellectuelle. L’objectif de notre thèse est d’analyser ce que recouvre réellement l’idée de présomptions en droit de la propriété intellectuelle et de délimiter concrètement leur champ d’action (première partie). Cette démarche envisage à terme de proposer une théorie générale des présomptions à partir de laquelle les présomptions applicables en propriété intellectuelle pourraient s’identifier et tirer leur légitimité (deuxième partie). Une telle approche permettra de fournir une grille de lecture plus pertinente tant aux théoriciens qu’aux praticiens de la matière pour aborder efficacement les problématiques inhérentes à ce domaine dont la complexité n’est plus à présenter. / Presumptions in intellectual property law, analysis in the light of general lawPresumptions intervene to correct shortcomings in legal reasoning. They are traditionally defined as "consequences that the law or the magistrate draws from a known fact to an unknown fact". Presumptions play an important role in intellectual property law because the search for truth and the treatment of doubt are its essence. Whether it is to apprehend the objects (intellectual work, invention, trademark, etc.), to designate the actors (owners or counterfeiters) or to delimit the content of the intellectual property rights, the use of presumptions is unavoidable. However, the new challenges (digital, globalization of the economy, communalization of the law, etc.) faced by intangible creations force the legislator and the judge to squander the presumptions. We are witnessing inflation and even densification of the "presumptive norm" in intellectual property law: there is a presumption for almost everything, on almost everything and almost everywhere. This weakens the system of protection of intangible creations and, inevitably, creates unprecedented legal uncertainty in intellectual property law. The aim of our thesis is to analyze what the idea of presumptions in intellectual property law really covers and to concretely define their field of action. This approach ultimately aims to propose a general theory of presumptions from which the presumptions applicable in intellectual property could identify and draw their legitimacy. Such an approach that will provide a reading grid more relevant to both theorists and practitioners of the subject to effectively address the issues inherent in this area whose complexity is more to present.

Limites de critérios econômicos na aplicação do direito: hermenêutica e análise econômica do direito / Limits of economic criteria in the application of law: hermeneutics and the economic analysis of law

Esta tese volta-se para conflitos de sentido normativo que a análise econômica do direito (AED) traz para o ambiente jurídico ao aplicar métodos econômicos na interpretação jurídica, métodos estes que colocam como deve ser o direito. A AED associa-se ao método econômico como portador de verdade racional de índole científica, criando uma espécie de metalinguagem jurídica com pretensões explícitas de fixar juridicidade precisa. O direito nunca teve ambições tão extensas e totalizadoras. Ele se ajusta às necessidades históricas do conhecimento e vida do homem, e é, por isso, fracamente científico. A hipótese de trabalho é a de que a análise econômica pode ter usos viáveis no direto, se respeitar as condições fundamentais de entendimento jurídico. Sendo capaz de assumir que o direito, necessariamente, predica a correção do agir, tendo por referência o justo, as normatividades econômica e jurídica têm uma direção unívoca. Daí ser possível a interferência da economia no direito como padrão argumentativo empírico consequencialista, direcionado a resultados jurídicos que concretizem a distribuição do produto social, elemento de base da justiça socioeconômica nos estados liberais contemporâneos. O trabalho pretende, primeiramente, investigar as causas de incorreções, apontar para os equívocos e indicar as circunstâncias em que eles ocorrem, de modo a estabelecer, ao final, usos possíveis do método econômico no direito. A tese conclui que a AED adequada para o direito é a que consegue demonstrar, pela empiria, que uma decisão deve ser tomada porque tem efeitos distributivos concretos, patrocinando a justiça. Desenvolvimento do homem e não só crescimento econômico tem que ser a fórmula de integração interdisciplinar. Por se tratar de um problema de significado, optou-se pela perspectiva da hermenêutica jurídica como ponto de partida para o trabalho. A preocupação central da hermenêutica é o entendimento jurídico, não como método para tratar objetos jurídicos observados, mas como forma de revelar o sentido jurídico correto. Pela hermenêutica é que se mostram as dificuldades mais profundas da AED e as perspectivas mais promissoras de uso da economia no direito. / This thesis is aimed at dealing with normative conflicts that the economic analysis of law (EAL or, law and economics) brings to the legal knowledge applying economic methods to legal reasoning. Such methods determine how the law should be. The EAL is associated to the economic method as a bearer of rational truth of scientific nature, creating a kind of legal metalanguage with a clear intent of precision when bringing law into existence. The Law has never had such extensive and totalitarian ambitions. It adjusts itself to the historical needs of mans knowledge and life and this is why it is weakly scientific. The hypothesis of this work is that the economic analysis can have viable uses in law, if it complies with the fundamental conditions of legal knowledge. Being capable of establishing that the law mandatorily preaches the correction of action, having justice as a main reference, both economic and legal standards must have a common direction. That is why the interference of economy in law is possible as a consequential empirical standard argument, aimed at legal results that materialize the distribution of the social product, a base element for socioeconomic justice in contemporary liberal States. The work initially intends to investigate the causes of errors, pointing out the mistakes and indicating the circumstances in which they occur, in order to establish, in the end, the possible uses of the economic method in the law. The thesis concludes that the adequate EAL for the law is one that is able to demonstrate, through empirical arguments, that a decision should be taken because it has concrete distributing effects, sponsoring justice. The development of men and not only economic growth should be the form of interdisciplinary integration. Since the thesis reflects a question of meaning we have decided to establish the legal hermeneutics perspective as a starting point for the work. The main concern of hermeneutics is legal understanding, not as a method to treat observed legal objects, but as a way to reveal the correct legal sense. Through hermeneutics we can find the most profound difficulties of EAL and, at the same time, the most promising perspectives of use of economics in law.

The result is the systematic of proof in the Brazilian right constitutional process. The study admits to have the investigative deficit in Brazil on the practice of evidential reasoning in making judgments of (un)constitutionality of laws. Which justifies asking about the ideas and trends related to a methodical approach to talk about the proof as one more element in the praxis of the decision about unconstitutionality of law in the context of Brazilian Constitutional Justice. The thesis intends to review a methodologically referred to this praxis. The investigative attention focuses on the factual issues and evidentiary issues in the context of Supreme Court, while exercising control of the constitutionality of laws. Addressing this problem is to place the significance at the epicenter of unconstitutionality and also the institute of proof, which are discussed in terms of their own legal and constitutional arguments. The displacement studies of the right to the proof in the strict procedural law to the constitutional land is a deficit constitutional issue in the doctrine, that, in this work, expected to challenge / A presente tese propõe reduzir as observações ao sistema constitucional brasileiro a um modelo de explicação dogmática da inter-relação entre dois tradicionais institutos do Direito, aparentemente, antagônicos: a prova e a inconstitucionalidade. O resultado investigativo é a sistematização da prova-da-inconstitucionalidade no direito constitucional processual brasileiro. O estudo parte da admissão de um déficit investigativo no Brasil sobre a prática da racionalidade probatória no juízo decisório da (in)constitucionalidade das leis. Fato que justifica perguntar sobre as concepções e as tendências referentes à postura metódica diante da prova como um elemento a mais na práxis do processo de decisão da inconstitucionalidade na Justiça Constitucional brasileira. A tese pretende uma análise crítica, metodologicamente, referida a essa práxis. A atenção investigativa está centrada nas questões fáticas e nos problemas probatórios em âmbito de Supremo Tribunal Federal no exercício do controle de constitucionalidade das leis. Procura ainda o estudo compreender quais os possíveis contornos jurídicos de uma cultura cada vez mais colaborativa em relação à produção de conteúdo e licenciamento. Por fim, tenta determinar quais as consequências e possíveis necessidades de adequação da legislação brasileira necessárias frente à uma nova dinâmica de relações jurídicas. Expondo o conteúdo das licenças Creative Commons, será analisado o conteúdo jurídico das mesmas, bem como dados estatísticos da distribuição das licenças, quem as usa, como as usa e ainda quais as tendências apontadas a partir dos dados. Com fundamento no Marco Teórico do “Direito Como Integridade” na obra de Ronald Dworkin, a presente dissertação traz os resultados pesquisa, que consistem em uma comparação do comportamento habitual dos usuários das obras autorais licenciadas sob o Creative Commons, em relação à proposição legislativa do sistema jurídico brasileiro, e quais as possíveis consequências jurídicas e necessidades de atualização legislativa, tendo em vista essa nova dinâmica de produção e comercialização de conteúdo em ambiente virtual. / This study aims to examine the adequacy of the copyright licensing system developed by Creative Commons Foundation to Brazilian copyright laws. Also, the study intends to understand what possible legal contours of an increasingly collaborative culture in the production of content and licensing. Finally, it tries to determine what are the consequences and possible adaptation needs of the Brazilian legislation towards a new dynamic of legal relations. By exposing the contents of the Creative Commons licenses, it will analyze the legal content of the same, as well as statistical data on the distribution of licenses, who uses them, how they are used and also what the trends identified from the data. Based on the theoretical framework of "Law as Integrity" from the work of Ronald Dworkin, this dissertation brings the research results, which consist of a comparison of the usual behavior of users of copyrighted works, licensed under Creative Commons, in relation to the legislative proposal of the Brazilian legal system, and what are the possible legal consequences and legislative updating needs regarding the new dynamics of production and marketing of content in a virtual environment.
