Lobbying and democratic policymaking : A study on the impacts of lobbying on democratic policymaking in the European Union

<p>The overreaching purpose of this study is to examine in what ways lobbying contributes to democratic policymaking in the European Union. Having limited amount of time, a case study has been conducted with the main purpose to examine what impacts lobbying have on the proposed EU-legislation to lower CO2 emissions from newly produced cars, in terms of democratic policymaking. The lobby groups in this case being ACEA and T&E. In order to fulfill the purpose a comprehensive research question is formulated: What impacts do ACEA and T&E have on the proposed EU-legislation to lower the CO2 emissions from newly produced cars, in terms of democratic policymaking?</p><p>The theory and definitions of democratic policymaking were drawn from Rinus van Schendelen´s book “Machiavelli in Brussels; The Art of Lobbying the EU”. Definitions of different components essential to democratic policymaking were given here and used together with the material on ACEA and T&E to answer the research question.</p><p>The material was based on documents, press-statements, speeches and publications from the European Union, ACEA and T&E to find out how ACEA and T&E lobbied the proposed legislation.</p><p>The study has shown mostly positive impacts from ACEA and T&E on the proposed EU-legislation to lower the CO2 emissions from newly produced cars, in terms of democratic policymaking. For the overreaching purpose the conclusion is that lobbying therefore contributes mostly in a positive way to democratic policymaking in the European Union.</p><p>This study can in the future be used in further studies to see what impacts lobby groups have on democratic policymaking in the European Union and also in studies concerning how lobby groups carry out their lobbying.</p>

PROTECTION AGAINST CORRUPTION AND BRIBERY AND THEIR PREVENTION The purpose of this thesis is to analyse the phenomenon of corruption and to describe the relevant legislation, which either states the illegality of the matter or is important as a part of the actions taken against corruption. The main reason why the author has chosen this topic is possibly the frustration about the strong corruption climate in the Czech Republic and also the fear that the country is - concerning this issue - not moving forward at all. The motive was to find out the reasons of this situation and to analyse whether the legislation covering this area is sufficient. This work consists of an introduction, three chapters, each of them dealing with different aspects of the topic, and the conclusion. In the introduction, the author describes the reasons for choosing the topic and summarises the content of the thesis. The purpose of the first chapter, which consists of four parts, is a description of the term "corruption". It gives a number of definitions and tries to further explain the meaning by presenting different types of corruption. The diploma project focuses on lobbying and its regulation in both the Czech Republic and in selected developed countries. The introductory section contains a theoretical analysis of the definition of lobbying, the kinds of consequences, analysis of the draft law on lobbying in 2009 and a description of the regulation of lobbying in selected developed countries and the EU. In the second part area for lobbying in the legislative process is approached through a case study. The final section contains a questionnaire aimed at the general opinion of respondents on lobbying, especially views on lobbying terminology, methods of lobbying, as well as on regulation of lobbying in the Czech Republic and the EU. On this basis, some conclusions are formulated that may contribute to the development of the lobbying culture in the country.

Lobbying: economic and legal aspects Abstract The aim of this thesis is to determine lobbying as a legitimate part of democratic processes and to propose recommendations for the regulation of lobbying in the Czech Republic. To achieve this aim, an analysis of the regulation of lobbying in the USA, EU and neighbour states, is conducted. Emphasis is also put on the analysis of regulation attempts in the Czech Republic with regard to influence of Non-Governmental Organizations. The first chapter is dedicated to a comparison of various lobbying definitions which are presenting main features and similarities across definitions. Among the main features are definitions of lobbying activity, lobbyist and public officials. The second chapter is dedicated to a comparison of government regulation and self-regulation, and the positives and negatives are assessed. The difference between lobbying and corruption is the main focus of the third chapter. Next three chapters are dedicated to the historical and legal analysis of lobbying in the USA, EU and neighbour states. The regulation of lobbying in the USA has the longest history.
