(i): The first part of this thesis questions the concept of ‘minority’, and the way it has been used to analyze French imperial policy in Syria (‘divide and rule’). Chapter 1 traces the concept’s emergence, showing that it is not self-evidently valid but rather depends on a set of wider social and political circumstances related to the existence of modern nation-states: the minorities of modern Syria cannot be mapped directly back onto the Ottoman millets or religious communities. Chapter 2 examines the term’s application in Syria between the wars: French imperial policy emphasised divisions in Syrian society, but the term ‘minority’ was only systematically attached to these divisions from the 1930s. The concept’s spread in Syria reflects its growing importance in international public discourse worldwide, as the nation-state became the standard state form after World War One. The second part of the thesis uses case studies of particular themes to show how the emergence of minorities illuminates processes of state-formation that have shaped the modern world. Chapters 3 and 4, on the question of ‘separatism’ and the definition of modern Syria’s northern border, examine the spread of effective state authority across a ‘national’ territory. This process bound culturally-divergent populations more tightly into the fabric of a centrally-controlled state, thereby constituting them as ‘minorities’. Chapter 5 examines the debate about a Franco-Syrian treaty leading to Syrian independence, showing that this made the recently-established body of international law on ‘minorities’ in newly-independent states applicable to Syria: the term only became widespread in Syria at this time. Chapter 6 looks at French efforts to reform personal status law in the later 1930s, when the restructuring, on religious lines, of the institutional relationship between the Syrian state and its population created a new uniformity within communities at the national level (one condition for their developing the sense of being ‘minorities’). It also sparked opposition from groups now claiming to represent the ‘majority’. Other Syrians, though, understood their society in different terms.

Freight Forwarding The content of this thesis is a treatise on the issue of freight forwarding contract conclusion as well as on the topic of freight forwarding in general, namely in the context of Czech laws together with the laws of Germany and Austria. The thesis is divided into five chapters, whereas the author emphasizes, besides the comparison of the current and the previous legislations the clarification of basic terms of the law of transport and conceives the text as an elementary insight into an often overlooked issue. Demonstrated on the historical context, outlined in chapter two of the thesis, is the rather dynamic evolution of the branch as well as the set back of its promising beginnings in our countries caused by the installment of the totalitarian regime in the late 40s of the last century. 61 Abstract The purpose of this thesis is to analyse new legislation on securities and book- entry securities enacted during the recodification of private law. The main legislation moved from the Act no. 591/1992 Coll., On Securities, into the Act no. 89/2012 Coll., The Civil Code. This thesis is divided into five chapters. The first chapter deals with the general definition of the concept of securities and booked-entry securities. It describes the definition of security that has been adopted from the Swiss Code of Obligations and describes the new concept of book-entry securities, which are now a substitute to securities and a separate legal institute. The second chapter briefly describes the functions of the securities. The third chapter describes forms of securities that are crucial for determination of methods of transfer of the securities. It also discusses enactment of legal presumptions of the form of the security that are used to determine form of securities in the case the form of the security is not entirely clear. The presented diploma thesis focuses on the parliamentary immunity of Deputies and Senators in the Czech Republic and consists of two not explicitly titled parts. The first one deals with the genesis of the concept of immunity; the historical course describes the origin of the concept that goes back to the 13th century. Immunity might have been described as protection given by an English monarch towards Representatives; it gradually changed in privileged status recognition of a newly emerging institution, nowadays called Parliament. This excursion back into the 800 year history is supposed to help us understand the basic idea that the immunity of deputies or senators serves as an instrument of protection of a legislative body, or rather the Parliament of the Czech Republic. As for the immunity of deputies (senators) in the Czech Republic, relevant chapters deal with the first attempts to create functional constitutions at the end of the 19th century when Bohemia was part of the Austrian empire. Significant space is dedicated to the 1920 Constitutional Act, which may be considered as a crucial document for today's concept of the immunity of deputies and senators in the Czech Republic. In 2010 the municipal elections took place in the Czech Republic. In this theses there are applied some of the knowledge from the area of the public choice theory and the game theory to the results of the pre-election surveys and results of the elections. Firstly the methods for allocating seats are applied on data from the surveys and election results. The power indices are calculated for all the proportion of allocation of mandates in order to qualify the bargaining power. The results of elections are analysed and compared with two previous periods and with the pre-election surveys. The bargaining power is confronted according to the indices with the results of post-elections negotiations.

Cette thèse appréhende les agents sportifs comme des acteurs évoluant dans un univers professionnel dynamique, complexe et multidimensionnel. Profession, métier et activités de travail, ces trois termes, souvent interchangeables, demeurent pourtant amphibologiques étant donnée leur extrême polysémie. C’est à partir de cette ambivalence que se construit l’objet d’étude, une profession atypique au statut inachevé, entre régulation et autonomie. Dans un premier temps, sous l’angle de la sociologie des professions, cette recherche s’attache à restituer et à éclairer la terminologie utilisée. Ce faisant, elle pose les prémices d’un modèle professionnel de l’agent sportif, marqué par des interventions réglementaires émanant des sphères politiques et sportives. Puis, nous proposons de réinterroger l’organisation et la régulation de la profession d’agent sportif, telles qu’imposées par les instances présumées compétentes en la matière. Nous opérons ensuite un changement de paradigme qui entraîne une modification de point de vue sur la profession car notre regard se déplace sur la pratique quotidienne des activités de travail de l’agent sportif. C’est dans l’interaction acyclique ou continue avec les groupes et les individus qu’il cotie que l’agent sportif acquiert et intègre les compétences nécessaires à la réalisation réussie de son projet professionnel. La carrière de l’agent sportif et l’orientation professionnelle donnée à son activité dépendent de l’authenticité de ses parcours antérieurs lesquels déterminent en partie les choix et les stratégies que celui-ci développe dans la construction de sa carrière. Les analyses des trajectoires biographiques et des tâches professionnelles d’agents sportifs présentés dans cette thèse permettent de comprendre comment se développe et évolue l’identité professionnelle au cours de la carrière. La profession d’agent sportif est abordée par la manière dont les agents sportifs parlent de leur métier au quotidien et reconstituent les étapes de leur engagement dans les activités d’intermédiation. / This thesis views sports agents as actors evolving in a dynamic, complex and multi-dimensional work environment. Profession, occupation and work, these three terms, although often used interchangeably yet, remain amphibological given their extreme polysemy. The object of this research arises in light of that ambivalence as a study of an atypical profession with an uncompleted status, teetering between regulation and autonomy. The first section of the study aims to help specify and clarify the terminology being used. In doing so, using the literature from the sociology of professions, it provides a starting point for a suitable theoretical framework that could be applied to the profession of sports agent or to the (sports) agency practice, as a whole. The occupational model of sports agent is framed in such a way that the professional self-regulation is restricted by Sports governing Bodies and State regulatory interventions. Therefore we propose to re-examine the organization and regulation of the sports agents’ activities. The findings indicate significant differences between the regulations applicable to sports agents. The inefficiency of the current regulations whether they are enacted by national sports federations, international sports federation or by the State is closely related to the internal professional dynamics that these regulations disturb. The thesis examines therefore the tasks of sports agents, the individuals that carry them out, and the variable and inconstant connections that tie one to the other. In this respect, as a means of a more accurate conceptualization of its object of analysis, this research describes sports agents’ activities quantitatively and qualitatively, exploring various dimensions and aspects such as the foundations of the profession, the social role of sports agents, the different typologies of sports agents and the occupational tasks accomplished by each. This thesis examines the development of a national identity and the ideology of nationalism, and the formation of nation-state in Iraq under the British Mandate from 1920 to 1932. The study focuses on the influences of the early Arab nationalist movements during the last decades of the Ottoman Empire and under the British Mandate over Iraqi nationalism and nation-state process. The study specifically examines the Mosul question and its effects on the formation of the territorial unity of the state in Iraq. The study also explores the successive civil administration during Mandate period while making Iraq a &ldquo / nation-state&rdquo / by taking actions concerning the politics, social structure, the government, army and economy. The British Mandate period in Iraq witnessed many important developments such as the drawing of Iraq&rsquo / s boundaries and the shaping of the foundations of the state structure. These developments continue to affect the country in a variety of ways even today. In the final part of the thesis, it is pointed out that understanding some of the policies and strategies implemented in Iraq by the British can help to make meaningful interpretations of current affairs in this country.

The main aim of this thesis is to examine the history of Sanjak of Alexandretta in the Turkish nationalist historiography. In this respect, it is important to comprehend how this region as a territory was tried to present as a homeland with ethnic-nationalist connotations and idioms through the discipline of history by Kemalist nationalists in the late of 1930s. Thus, in order to pay attention to the process of annexation of the region into Turkey requires focusing on how and by whom this nationalist history was written in order to gain different perspective. In general, the history of region has been considered on the basis of Turkish-Arab animosity. According to this approach, the history of region is the narration of encountering of these nationalist movements. On the other hand, the question of how this history was shaped by Turkish Kemalist nationalists and to interrogate the impact of the self-determination principle and mandate system on this nationalist history through which myths was created and the historical events were distorted in the process of integration of the region are also vital. Besides, while considering this local history, giving priority to the local narratives can open the path to investigate this nationalist history critically and understand the period of annexation from the view of ordinary people.
