Current aspects of the fraud crime under section 209 criminal code of the Czech republic Abstract The author deals with theoretical and practical issues related to the fraud crime, which is one of the enriching property crimes. After the theft and damage to a thing of another, fraud has been the third most frequently committed property crime in the Czech Republic. Except of its topicality, the reason for choosing the topic of the Master's thesis is mainly the considerable variability of this crime. Law enforcement authorities encounter different modes of committing (modus operandi) this crime in practice. The presented work describes the historic developmental tendencies of codification of fraud and then looks into the individual changes (amendments) of criminal code in the Czech Republic related to fraud crime. Furthermore, there is a detailed analysis of fraud crime under section 209 of the Criminal Code and the interpretation of selected legal features. For this purpose it was mainly drawn from current precedens (case law) that significant influences the practice of law enforcement authorities. The role of modus operandi in criminalistics Abstract The reflection of a person's personality can be observed in every single one of his actions and criminal activity is no exception. The modus operandi of a crime is currently a very neglected topic within the professional public. The aim of this diploma thesis is to describe in detail the concept of modus operandi of a crime and to outline its criminal significance. The secondary goal of the thesis is then to show in practical cases whether the assumption of perseverance of the offender is true. The thesis is divided into two parts - theoretical and practical. The theoretical part deals with the history of the perception of this issue by criminologists across the centuries, the very definition of the term modus operandi of a crime, its systematic classification, its definition and its possible understanding in other fields and countries. It also describes the components of the modus operandi of a crime and their possible division, discusses the determinants of modus operandi of a crime, both subjective and objective, and the mechanisms that contribute to the formation of modus operandi a crime. Syftet med denna studie var att undersöka känsloresponserna, och dess anledningar, till olika kyrkotonarter. Tidigare studier (Dalla Bella et al., 2000; Gagnon et al., 2003; Gerardi et al., 1995; Webster et al., 2005) visar att stycken skrivna med dur- och mollskalor ger olika känsloreaktoner. Kyrkotonarterna, som också delas in i dur och moll, följer övergripande ett liknande mönster men deras karaktärstoner ger upphov till vissa förändringar när det kommer till emotionell respons (Ramos et al. 2011). Fyra versioner av den traditionella barnvisan Bä-bä vita lamm arrangerades i olika kyrkotonarter för att sedan spelas upp för fyra respondenter som deltog i den kvalitativa intervjustudien. Resultatet visade, likt tidigare forskning, att kyrkotonarterna följde dur- och molltonarternas kategorisering av känsloresponser men att karaktärstonerna resulterar i vissa förändringar i de emotionella reaktionerna. Framtida studier skulle kunna använda musik som inte respondenterna är bekanta med för att se om liknande resultat uppnås.

Die indirekte Rede ist eine Konstruktion im Deutschen, die schwierig sein kann. Die Schwierigkeit liegt vor allem darin, dass das Prädikat in verschiedenen Modi stehen kann. Welche Form gewählt wird, hängt u.a. von grammatischen Faktoren, vom Dialekt des Sprechers, vom Stil und von der Art der Sprache (der geschriebenen/gesprochenen Sprache) ab. In dieser Arbeit wird der Modusgebrauch in der indirekten Rede untersucht. Die Untersuchung ist auf die Schriftsprache beschränkt; mit Hilfe von drei verschiedenen Textsorten: Zeitungsartikeln, einem Roman und einer Umfrage unter Deutschsprachigen wird der Gebrauch untersucht. Das Ziel dieser Arbeit ist zu untersuchen, ob der tatsächliche Gebrauch des Konjunktivs innerhalb der indirekten Rede mit den in Grammatikbüchern angegebenen Regeln überinstimmt.

The dissertation examines in detail the concept of neutrality in political theory literature and assesses the arguments of the defenders and critics of Turkey’s laicism in light of such an examination. After showing the weaknesses and problems in the arguments of various political actors in Turkey, the dissertation defends “modus vivendi liberalism” as a possible solution for the conflicts about Turkey’s laicism. In that regard, the dissertation argues that certain aspects of liberal political theory can be appropriated for Turkish politics for the sake of ensuring stability and peace even if there might be problems with the possibility and desirability of neutrality. The dissertation also discusses what can constitute Turkey’s modus vivendi and offer certain ideas about what may and may not ensure stability and peace in Turkey.
